1421 AN ACT CONCERNING TH E PROVISION OF ALTERNATIVE
1522 EDUCATIONAL OPPORTUN ITIES FOR EXPELLED STUDENTS BY
1623 BOARDS OF EDUCATION.
1724 Be it enacted by the Senate and House of Representatives in General

20-Section 1. Subsection (d) of section 10-233d of the general statutes is 1
21-repealed and the following is substituted in lieu thereof (Effective July 2
22-1, 2019): 3
23-(d) [No local or regional board of education is required to offer an 4
24-alternative educational opportunity, except in accordance with this 5
25-section. Any pupil under sixteen years of age who is expelled shall be 6
26-offered an alternative educational opportunity, which shall be (1) 7
27-alternative education, as defined by section 10-74j, with an 8
28-individualized learning plan, if such board provides such alternative 9
29-education, or (2) in accordance with the standards adopted by the State 10
30-Board of Education, pursuant to section 10-233o, during the period of 11
31-expulsion, provided any parent or guardian of such pupil who does 12
32-not choose to have his or her child enrolled in an alternative 13
33-educational opportunity shall not be subject to the provisions of 14
34-section 10-184. Any pupil expelled for the first time who is between the 15
35-ages of sixteen and eighteen and who wishes to continue his or her 16
36-education shall be offered such an alternative educational opportunity 17
37-if he or she complies with conditions established by his or her local or 18 Substitute Bill No. 1023
27+Section 1. (NEW) (Effective July 1, 2019) For the school year 1
28+commencing July 1, 2019, and each school year thereafter, each local 2
29+and regional board of education shall develop and implement a policy 3
30+regarding the provision of alternative educational opportunities, 4
31+offered pursuant to subsection (d) of section 10-233d of the general 5
32+statutes, as amended by this act. The provision of alternative 6
33+educational opportunities under such policy shall exhibit the following 7
34+characteristics: (1) A whole student approach, (2) a curriculum aligned 8
35+with guidelines approved by the State Board of Education, (3) high 9
36+expectations, and (4) research-based practices. Each local and regional 10
37+board of education shall submit such policy annually to the 11
38+Department of Education. 12
39+Sec. 2. Subsection (d) of section 10-233d of the general statutes is 13

45-may include, but shall not be limited to, the placement of a pupil who 20
46-is at least seventeen years of age in an adult education program 21
47-pursuant to section 10-69. Any pupil participating in any such adult 22
48-education program during a period of expulsion shall not be required 23
49-to withdraw from school under section 10-184. A local or regional 24
50-board of education shall count the expulsion of a pupil when he was 25
51-under sixteen years of age for purposes of determining whether an 26
52-alternative educational opportunity is required for such pupil when he 27
53-is between the ages of sixteen and eighteen. A local or regional board 28
54-of education may offer an alternative educational opportunity to a 29
55-pupil for whom such alternative educational opportunity is not 30
56-required pursuant to this section.] Any pupil who is expelled shall be 31
57-offered an alternative educational opportunity during the period of 32
58-expulsion, which shall be (1) alternative education, as defined by 33
59-section 10-74j, with an individualized learning plan, if such board 34
60-provides such alternative education, or (2) in accordance with the 35
61-standards developed by the State Board of Education pursuant to 36
62-section 10-233o. Such alternative educational opportunity may include, 37
63-but is not limited to, the placement of a pupil who is at least eighteen 38
64-years of age in an adult education program pursuant to section 10-69. 39
65-No pupil participating in any such adult education program during a 40
66-period of expulsion shall be required to withdraw from school under 41
67-section 10-184. No parent or guardian of a pupil who chooses not to 42
68-enroll his or her child in an alternative educational opportunity in 43
69-accordance with the provisions of this section shall be subject to the 44
