20	19		AN ACT CONCERNING SO LITARY CONFINEMENT.
21	20		Be it enacted by the Senate and House of Representatives in General
22	21		Assembly convened:

24	23		Section 1. Section 18-96b of the general statutes is repealed and the 1
25	24		following is substituted in lieu thereof (Effective October 1, 2019): 2
26	25		(a) As used in this section: 3
27	26		(1) "Administrative segregation status" means the Department of 4
28	27		Correction's practice of placing an inmate on restrictive housing status 5
29	28		following a determination that such inmate can no longer be safely 6
30	29		managed within the general inmate population of the correctional 7
31	30		facility; and 8
32	31		(2) "Restrictive housing status" means the designation of an inmate 9
33	32		by the Department of Correction that provides for closely regulated 10
34	33		management and separation of such inmate from other inmates. 11
35	34		(b) The Department of Correction shall publish on its Internet web 12
36	35		site the formula for calculating an inmate's mental health score and a 13

45	43		(c) The Department of Correction shall [at least annually] not later 16
46	44		than November 1, 2019, submit to the Criminal Justice Policy and 17
47	45		Planning Division established under section 4-68m a report containing 18
48	46		as aggregated and anonymized the following data for the period of 19
49	47		time since the department last reported under this subsection: 20
50	48		(1) The number of inmates on restrictive housing status in this 21
51	49		state's correctional facilities, as of the first day of each of the [twelve] 22
52	50		months [preceding the date of the submission of] covered by the 23
53	51		report. The department shall report and disaggregate such data based 24
54	52		on an inmate's age, gender identity, ethnicity, mental health score as 25
55	53		calculated by the department, if any, and the form and phase of 26
56	54		housing in which such inmate is held on restrictive housing status; 27
57	55		(2) The number of inmates on administrative segregation status who 28
58	56		have spent the following cumulative durations of time on 29
59	57		administrative segregation status: 30
60	58		(A) One to fifteen days; 31
61	59		(B) Sixteen to thirty days; 32
62	60		(C) Thirty-one to one hundred eighty days; 33
63	61		(D) One hundred eighty-one to three hundred sixty-five days; 34
64	62		(E) Three hundred sixty-six to seven hundred thirty days; 35
65	63		(F) Seven hundred thirty-one to one thousand ninety-five days; 36

90	87		on administrative segregation status. The department shall report and 55
91	88		disaggregate such data based on an inmate's age, gender identity, 56
92	89		ethnicity, mental health score as calculated by the department, if any, 57
93	90		and the form and phase of restricted housing in which such inmate is 58
94	91		held; and 59
95	92		(4) Actions taken by the department during the [twelve months 60
96	93		preceding the date of the submission of] period of time covered by the 61
97	94		report to minimize reliance on administrative segregation status and to 62
98	95		mitigate the harmful effects of administrative segregation status on 63
99	96		inmates, staff and the public. 64
100	97		(d) [The] On and after October 1, 2019, the department shall not 65
101	98		hold any person [under eighteen years of age] on administrative 66
102	99		segregation status or restrictive housing status. 67

115	111		[(f)] (e) The provisions of subsections (a) to (d), inclusive, of this 74
116	112		section do not apply to any inmate described in subsection (a) of 75

118	114		[(g)] (f) Within available appropriations, the Department of 77
119	115		Correction shall provide training to employees of the department who 78
120	116		interact with inmates concerning the following: 79
121	117		(1) The recognition of symptoms of mental illness; 80
122	118		(2) The potential risks and side effects of psychiatric medications; 81
123	119		(3) De-escalation techniques for safely managing individuals with 82
124	120		mental illness; 83
125	121		(4) Consequences of untreated mental illness; 84
126	122		(5) The long and short-term psychological effects of being on 85
127	123		administrative segregation status; and 86
128	124		(6) De-escalation and communication techniques to divert inmates 87
129	125		from situations that may lead to the inmate being placed on 88
130	126		administrative segregation status. 89
131	127		[(h)] (g) Within available appropriations, the Department of 90
132	128		Correction shall take measures to promote the wellness of employees 91
133	129		of the department who interact with inmates. These measures may 92
134	130		include, but need not be limited to: 93
135	131		(1) Employee assistance programs; 94
