ARESIMOWICZ, 30 th Dist. AN ACT AMENDING THE CONVEYANCE OF CERTAI N PARCELS OF STATE LAND IN THE TOWN OF MANSFIELD. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 3 of special act 89-54 is amended to read as 1 follows (Effective from passage): 2 (a) Notwithstanding any provision of the general statutes to the 3 contrary, the [commissioner of mental retardation] Commissioner of 4 Developmental Services shall convey to the town of Mansfield, subject 5 to the approval of the [state properties review board] State Properties 6 Review Board and at a cost equal to the administrative costs of making 7 such conveyance, two parcels of land located in the town of Mansfield, 8 having a total area of approximately 16 acres. The first parcel of land 9 contains approximately 15.6 acres, is a portion of a larger parcel 10 conveyed to the state of Connecticut by William P. Kelley and 11 recorded in the Mansfield Land Records at Volume 47, Page 227 and is 12 the same property shown on a map entitled "Map Showing Land of the 13 Bill No. LCO No. 11144 2 of 3 State of Connecticut to be Acquired by the Town of Mansfield" dated 14 December 1988, scale 1" = 40 feet, 2 sheets certified A-2 by Grant 15 Meitzler, RLS #10,005, which map is filed in the Mansfield Land 16 Records. Said parcel of land shall be conveyed subject to an access 17 easement of record in favor of Raymond E. and Marianne Gergler, 18 which is of unspecified width giving a right to pass over said parcel 19 from a point near the top of the hill (at land of Gergler) to Depot Road. 20 The second parcel of land is a triangular parcel of land located 21 westerly of the southwesterly corner of land of Gergler, easterly of the 22 Central Vermont Railroad Company land, and northerly of the 23 northwesterly corner of the first parcel herein described and is the 24 same property shown on a map entitled "Map Showing Land of State 25 of Connecticut to be acquired by the Town of Mansfield", dated 26 January 1989, scale 1" = 20 feet, sheet 2-A of 2, certified Class D by 27 Grant Meitzler, RLS #10,005, which map is to be filed in the Mansfield 28 [land records] Land Records. The conveyance of said parcels of land 29 shall include transfer of rights to the abandoned railroad siding on said 30 parcels to the town of Mansfield, and the right to the use of the existing 31 sewer line, water line, and utility lines located on Connecticut Light 32 and Power Company poles 21, 22, 23 and 24, on terms negotiated by 33 the [commissioner of mental retardation] Commissioner of 34 Developmental Services and the town of Mansfield. The locations of 35 such utility service lines are shown on the above referenced map 36 showing the first parcel of land herein described. 37 (b) The town of Mansfield shall use said parcels of land for [a day 38 care facility] municipal purposes and shall compensate the state of 39 Connecticut for [such facility's] use of the utilities and services of the 40 Mansfield Training School. If [said parcels are not used for such 41 purpose, the parcels shall revert to the state of Connecticut.] the town 42 of Mansfield: 43 (1) Does not use said parcels for said purposes; 44 (2) Does not retain ownership of all of said parcels; or 45 Bill No. LCO No. 11144 3 of 3 (3) Leases all or any portion of said parcels, other than a lease for 46 municipal purposes, 47 the parcels shall revert to the state of Connecticut. 48 (c) The [state properties review board] State Properties Review 49 Board shall complete its review of the conveyance of said parcels of 50 land not later [that] than thirty days after it receives a proposed 51 agreement from the [commissioner of mental retardation] 52 Commissioner of Developmental Services. The land shall remain 53 under the care and control of said commissioner until a conveyance is 54 made in accordance with the provisions of this section. The [state 55 treasurer] State Treasurer shall execute and deliver any deed or 56 instrument necessary for a conveyance under this section and the 57 [commissioner of public works] Commissioner of Administrative 58 Services shall have the sole responsibility for all other incidents of such 59 conveyance. 60 This act shall take effect as follows and shall amend the following sections: Section 1 from passage SA 89-54, Sec. 3
