9-AN ACT AMENDING THE CONVEYANCE OF CERTAI N PARCELS

26+AN ACT AMENDING THE CONVEYANCE OF CERTAI N PARCELS OF
27+STATE LAND IN THE TOWN OF MANSFIELD.
1128 Be it enacted by the Senate and House of Representatives in General
1229 Assembly convened:

14-Section 1. Section 3 of special act 89-54 is amended to read as
15-follows (Effective from passage):
16-(a) Notwithstanding any provision of the general statutes to the
17-contrary, the [commissioner of mental retardation] Commissioner of
18-Developmental Services shall convey to the town of Mansfield, subject
19-to the approval of the [state properties review board] State Properties
20-Review Board and at a cost equal to the administrative costs of making
21-such conveyance, two parcels of land located in the town of Mansfield,
22-having a total area of approximately 16 acres. The first parcel of land
23-contains approximately 15.6 acres, is a portion of a larger parcel
24-conveyed to the state of Connecticut by William P. Kelley and
25-recorded in the Mansfield Land Records at Volume 47, Page 227 and is
26-the same property shown on a map entitled "Map Showing Land of the
27-State of Connecticut to be Acquired by the Town of Mansfield" dated
28-December 1988, scale 1" = 40 feet, 2 sheets certified A-2 by Grant
29-Meitzler, RLS #10,005, which map is filed in the Mansfield Land
30-Records. Said parcel of land shall be conveyed subject to an access
31-easement of record in favor of Raymond E. and Marianne Gergler, Senate Bill No. 1206

35-which is of unspecified width giving a right to pass over said parcel
36-from a point near the top of the hill (at land of Gergler) to Depot Road.
37-The second parcel of land is a triangular parcel of land located
38-westerly of the southwesterly corner of land of Gergler, easterly of the
39-Central Vermont Railroad Company land, and northerly of the
40-northwesterly corner of the first parcel herein described and is the
41-same property shown on a map entitled "Map Showing Land of State
42-of Connecticut to be acquired by the Town of Mansfield", dated
43-January 1989, scale 1" = 20 feet, sheet 2-A of 2, certified Class D by
44-Grant Meitzler, RLS #10,005, which map is to be filed in the Mansfield
45-[land records] Land Records. The conveyance of said parcels of land
46-shall include transfer of rights to the abandoned railroad siding on said
47-parcels to the town of Mansfield, and the right to the use of the existing
48-sewer line, water line, and utility lines located on Connecticut Light
49-and Power Company poles 21, 22, 23 and 24, on terms negotiated by
50-the [commissioner of mental retardation] Commissioner of
51-Developmental Services and the town of Mansfield. The locations of
52-such utility service lines are shown on the above referenced map
53-showing the first parcel of land herein described.
54-(b) The town of Mansfield shall use said parcels of land for [a day
55-care facility] municipal purposes and shall compensate the state of
56-Connecticut for [such facility's] use of the utilities and services of the
57-Mansfield Training School. If [said parcels are not used for such
58-purpose, the parcels shall revert to the state of Connecticut.] the town
59-of Mansfield:
60-(1) Does not use said parcels for said purposes;
61-(2) Does not retain ownership of all of said parcels; or
62-(3) Leases all or any portion of said parcels, other than a lease for

67-the parcels shall revert to the state of Connecticut.
68-(c) The [state properties review board] State Properties Review
69-Board shall complete its review of the conveyance of said parcels of
70-land not later [that] than thirty days after it receives a proposed
71-agreement from the [commissioner of mental retardation]
72-Commissioner of Developmental Services. The land shall remain
73-under the care and control of said commissioner until a conveyance is
74-made in accordance with the provisions of this section. The [state
75-treasurer] State Treasurer shall execute and deliver any deed or
76-instrument necessary for a conveyance under this section and the
77-[commissioner of public works] Commissioner of Administrative
78-Services shall have the sole responsibility for all other incidents of such
79-conveyance.
