LCO No. 1811 1 of 3 General Assembly Raised Bill No. 5288 February Session, 2020 LCO No. 1811 Referred to Committee on PUBLIC HEALTH Introduced by: (PH) AN ACT CONCERNING PE RFLUOROALKYL AND POLYFLUOROALKYL SUBS TANCES. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective July 1, 2020) (a) As used in this section: 1 (1) "Perfluoroalkyl or polyfluoroalkyl substance" means a class of 2 fluorinated organic chemicals containing at least one fully fluorinated 3 carbon atom; and 4 (2) "Class B firefighting foam" means a foam used for the purpose of 5 extinguishing flammable liquid fires. 6 (b) On and after January 1, 2021, no person, local government or state 7 agency may use a class B firefighting foam that contains an intentionally 8 added perfluoroalkyl or polyfluoroalkyl substance in any amount for 9 any purpose. 10 (c) The Department of Public Health shall assist any person, local 11 government or state agency in transitioning to the use of class B 12 firefighting foam that does not contain an intentionally added 13 Raised Bill No. 5288 LCO No. 1811 2 of 3 perfluoroalkyl or polyfluoroalkyl substance. 14 (d) The provisions of this section may be enforced, within available 15 appropriations, by the Commissioner of Public Health. 16 Sec. 2. Subsection (i) of section 25-32 of the 2020 supplement to the 17 general statutes is repealed and the following is substituted in lieu 18 thereof (Effective from passage): 19 (i) (1) The department may perform the collection and testing of 20 water samples required by regulations adopted by the commissioner 21 pursuant to this section, in accordance with chapter 54, when requested 22 to do so by a water company. The department shall collect a fee equal to 23 the cost of such collection and testing. Water companies serving one 24 thousand or more persons shall not request routine bacteriological or 25 physical tests under this subsection. 26 (2) Not later than January 1, 2021, the department shall develop and 27 implement a plan for (A) testing water supply sources, water supplies 28 and bottled water, as defined in section 21a-150, for contamination by 29 perfluoroalkyl and polyfluoroalkyl substances, and (B) educating the 30 public regarding the potential risks of drinking water that has been 31 contaminated by such substances. The plan shall include methods of (i) 32 identifying every potential source of water contamination by such 33 substances, and (ii) identifying and prioritizing the testing of water 34 supply sources and water supplies that are most vulnerable to 35 contamination by such substances and of water supplies serving a 36 population whose health could be at greater risk from exposure to such 37 substances. For purposes of this subdivision, "perfluoroalkyl and 38 polyfluoroalkyl substances" means a class of fluorinated organic 39 chemicals containing at least one fully fluorinated carbon atom. 40 This act shall take effect as follows and shall amend the following sections: Section 1 July 1, 2020 New section Sec. 2 from passage 25-32(i) Raised Bill No. 5288 LCO No. 1811 3 of 3 Statement of Purpose: To limit the public's exposure to perfluoroalkyl and polyfluoroalkyl substances.
