24 | 24 | | Section 1. (NEW) (Effective July 1, 2020) (a) As used in this section: 1 |
---|
25 | 25 | | (1) "Perfluoroalkyl or polyfluoroalkyl substance" means a class of 2 |
---|
26 | 26 | | fluorinated organic chemicals containing at least one fully fluorinated 3 |
---|
27 | 27 | | carbon atom; and 4 |
---|
28 | 28 | | (2) "Class B firefighting foam" means a foam used for the purpose of 5 |
---|
29 | 29 | | extinguishing flammable liquid fires. 6 |
---|
30 | 30 | | (b) On and after January 1, 2021, no person, local government or state 7 |
---|
31 | 31 | | agency may use a class B firefighting foam that contains an intentionally 8 |
---|
32 | 32 | | added perfluoroalkyl or polyfluoroalkyl substance in any amount for 9 |
---|
33 | 33 | | any purpose. 10 |
---|
34 | 34 | | (c) The Department of Public Health shall assist any person, local 11 |
---|
35 | 35 | | government or state agency in transitioning to the use of class B 12 |
---|
36 | 36 | | firefighting foam that does not contain an intentionally added 13 Raised Bill No. 5288 |

43 | 43 | | (d) The provisions of this section may be enforced, within available 15 |

44 | 44 | | appropriations, by the Commissioner of Public Health. 16 |

45 | 45 | | Sec. 2. Subsection (i) of section 25-32 of the 2020 supplement to the 17 |
---|
46 | 46 | | general statutes is repealed and the following is substituted in lieu 18 |
---|
47 | 47 | | thereof (Effective from passage): 19 |
---|
48 | 48 | | (i) (1) The department may perform the collection and testing of 20 |
---|
49 | 49 | | water samples required by regulations adopted by the commissioner 21 |
---|
50 | 50 | | pursuant to this section, in accordance with chapter 54, when requested 22 |
---|
51 | 51 | | to do so by a water company. The department shall collect a fee equal to 23 |
---|
52 | 52 | | the cost of such collection and testing. Water companies serving one 24 |
---|
53 | 53 | | thousand or more persons shall not request routine bacteriological or 25 |
---|
54 | 54 | | physical tests under this subsection. 26 |
---|
55 | 55 | | (2) Not later than January 1, 2021, the department shall develop and 27 |
---|
56 | 56 | | implement a plan for (A) testing water supply sources, water supplies 28 |
---|
57 | 57 | | and bottled water, as defined in section 21a-150, for contamination by 29 |
---|
58 | 58 | | perfluoroalkyl and polyfluoroalkyl substances, and (B) educating the 30 |
---|
59 | 59 | | public regarding the potential risks of drinking water that has been 31 |
---|
60 | 60 | | contaminated by such substances. The plan shall include methods of (i) 32 |
---|
61 | 61 | | identifying every potential source of water contamination by such 33 |
---|
62 | 62 | | substances, and (ii) identifying and prioritizing the testing of water 34 |
---|
63 | 63 | | supply sources and water supplies that are most vulnerable to 35 |
---|
64 | 64 | | contamination by such substances and of water supplies serving a 36 |
---|
65 | 65 | | population whose health could be at greater risk from exposure to such 37 |
---|
66 | 66 | | substances. For purposes of this subdivision, "perfluoroalkyl and 38 |
---|
67 | 67 | | polyfluoroalkyl substances" means a class of fluorinated organic 39 |
---|
68 | 68 | | chemicals containing at least one fully fluorinated carbon atom. 40 |
---|
69 | 69 | | This act shall take effect as follows and shall amend the following |
