26 | 26 | | Section 1. Subsection (e) of section 5-278 of the general statutes is 1 |

27 | 27 | | repealed and the following is substituted in lieu thereof (Effective July 1, 2 |

29 | 29 | | (e) [Where] (1) Except as provided in subdivision (2) of this 4 |

30 | 30 | | subsection, where there is a conflict between any agreement or 5 |
---|
31 | 31 | | arbitration award approved in accordance with the provisions of 6 |

32 | 32 | | sections 5-270 to 5-280, inclusive, on matters appropriate to collective 7 |

33 | 33 | | bargaining, as defined in said sections, and any general statute or special 8 |
---|
34 | 34 | | act, or regulations adopted by any state agency, the terms of such 9 |

35 | 35 | | agreement or arbitration award shall prevail; provided if participation 10 |
---|
36 | 36 | | of any employees in a retirement system is effected by such agreement 11 |
---|
37 | 37 | | or arbitration award, the effective date of participation in said system, 12 |
---|
38 | 38 | | notwithstanding any contrary provision in such agreement or 13 |
---|
39 | 39 | | arbitration award, shall be the first day of the third month following the 14 Raised Bill No. 5407 |

48 | 48 | | (2) For any agreement or arbitration award approved on or after July 18 |

49 | 49 | | 1, 2020, in accordance with the provisions of sections 5-270 to 5-280, 19 |

50 | 50 | | inclusive, on matters appropriate to collective bargaining, as defined in 20 |

51 | 51 | | said sections, where there is a conflict between a provision of any such 21 |
---|
52 | 52 | | agreement or award and the provisions of the Freedom of Information 22 |

53 | 53 | | Act, as defined in section 1-200, the provisions of the Freedom of 23 |

54 | 54 | | Information Act shall prevail. 24 |
