2020 AN ACT CONCERNING TH E SUPERSEDENCE OF CO LLECTIVE
2121 BARGAINING AGREEMENT S AND THE FREEDOM OF INFORMATI ON

2323 Be it enacted by the Senate and House of Representatives in General

2626 Section 1. Subsection (e) of section 5-278 of the general statutes is 1
2727 repealed and the following is substituted in lieu thereof (Effective July 1, 2
2828 2020): 3
2929 (e) [Where] (1) Except as provided in subdivision (2) of this 4
3030 subsection, where there is a conflict between any agreement or 5
3131 arbitration award approved in accordance with the provisions of 6
3232 sections 5-270 to 5-280, inclusive, on matters appropriate to collective 7
3333 bargaining, as defined in said sections, and any general statute or special 8
3434 act, or regulations adopted by any state agency, the terms of such 9
3535 agreement or arbitration award shall prevail; provided if participation 10
3636 of any employees in a retirement system is effected by such agreement 11
3737 or arbitration award, the effective date of participation in said system, 12
3838 notwithstanding any contrary provision in such agreement or 13

4545 month in which a certified copy of such agreement or arbitration award 15
4646 is received by the Retirement Commission or such later date as may be 16
4747 specified in the agreement or arbitration award. 17
4848 (2) For any agreement or arbitration award approved on or after July 18
4949 1, 2020, in accordance with the provisions of sections 5-270 to 5-280, 19
5050 inclusive, on matters appropriate to collective bargaining, as defined in 20
5151 said sections, where there is a conflict between a provision of any such 21
5252 agreement or award and the provisions of the Freedom of Information 22
5353 Act, as defined in section 1-200, the provisions of the Freedom of 23
5454 Information Act shall prevail. 24
