1919 AN ACT CONCERNING VA RIOUS REVISIONS AND ADDITIONS TO
2020 THE EDUCATION STATUT ES.
2121 Be it enacted by the Senate and House of Representatives in General

2424 Section 1. Subsection (a) of section 10-145 of the general statutes is 1
2525 repealed and the following is substituted in lieu thereof (Effective July 1, 2
2626 2020): 3
2727 (a) No teacher, supervisor, administrator, special service staff 4
2828 member or school superintendent, except as provided for in section 10-5
2929 157, shall be employed in any of the schools of any local or regional 6
3030 board of education unless such person possesses an appropriate state 7
3131 certificate, nor shall any such person be entitled to any salary unless 8
3232 such person can produce such certificate dated prior to or on the first 9
3333 day of employment, except as provided for in section 10-157; provided 10
3434 nothing in this subsection shall be construed to prevent the board of 11
3535 education from prescribing qualifications additional to those prescribed 12
3636 by the regulations of the State Board of Education and provided nothing 13
3737 in this subsection shall be construed to prevent any local or regional 14

4444 approved by the Commissioner of Motor Vehicles for the behind-the-16
4545 wheel instruction of a driver instruction course, to be given by driving 17
4646 instructors licensed by the Department of Motor Vehicles. No person 18
4747 shall be employed in any of the schools of any local or regional board of 19
4848 education as a substitute teacher unless such person (1) [holds a 20
4949 bachelor's degree, provided the Commissioner of Education may waive 21
5050 such requirement for good cause upon the request of a superintendent 22
5151 of schools] (A) holds at least an associate degree if such person will be 23
5252 in the same assignment for more than ten school days, or (B) has 24
5353 obtained a high school diploma or its equivalent if such person will be 25
5454 in the same assignment for ten or fewer school days, and (2) is on a list 26
5555 maintained by the local or regional board of education pursuant to 27
5656 subsection (f) of section 10-222c. 28
5757 Sec. 2. Subsection (c) of section 10-221a of the 2020 supplement to the 29
5858 general statutes is repealed and the following is substituted in lieu 30
5959 thereof (Effective July 1, 2020): 31
6060 (c) Commencing with classes graduating in 2023, and for each 32
6161 graduating class thereafter, no local or regional board of education shall 33
6262 permit any student to graduate from high school or grant a diploma to 34
6363 any student who has not satisfactorily completed a minimum of twenty-35
6464 five credits, including not fewer than: (1) Nine credits in the humanities, 36
6565 including civics and the arts; (2) nine credits in science, technology, 37
6666 engineering and mathematics; (3) one credit in physical education; [and 38
6767 wellness;] (4) one credit in health [and safety] education, as described in 39
6868 section 10-16b; (5) one credit in world languages, subject to the 40
6969 provisions of subsection (g) of this section; and (6) a one credit mastery-41
7070 based diploma assessment. 42
7171 Sec. 3. Subsection (a) of section 10-15c of the general statutes is 43
7272 repealed and the following is substituted in lieu thereof (Effective July 1, 44
7373 2020): 45
7474 (a) The public schools shall be open to all children five years of age 46

8181 school year, and each such child shall have, and shall be so advised by 48
8282 the appropriate school authorities, an equal opportunity to participate 49
8383 in the activities, programs and courses of study offered in such public 50
8484 schools, at such time as the child becomes eligible to participate in such 51
8585 activities, programs and courses of study, without discrimination on 52
8686 account of race, color, sex, gender identity or expression, religion, 53
8787 national origin, [or] sexual orientation or disability; provided boards of 54
8888 education may, by vote at a meeting duly called, admit to any school 55
8989 children under five years of age. 56
9090 Sec. 4. Subsection (f) of section 10-145d of the 2020 supplement to the 57
9191 general statutes is repealed and the following is substituted in lieu 58
9292 thereof (Effective July 1, 2020): 59
9393 (f) An endorsement issued prior to July 1, [2013] 2020, to teach 60
9494 elementary education grades one to six, inclusive, shall be valid for 61
9595 grades kindergarten to six, inclusive, and for such an endorsement 62
9696 issued on or after July 1, [2013] 2020, the endorsement shall be valid for 63
9797 grades [one] kindergarten to six, inclusive. [, except such an 64
9898 endorsement issued between July 1, 2013, and July 1, 2017, to any 65
9999 student who was admitted to and successfully completes a teacher 66
100100 preparation program, as defined in section 10-10a, in the certification 67
101101 endorsement area of elementary education on or before June 30, 2017, 68
102102 shall be valid for grades kindergarten to six, inclusive. The 69
103103 Commissioner of Education may permit, upon the request of a 70
104104 superintendent, any person who holds such endorsement issued on or 71
105105 after July 1, 2017, to teach kindergarten for one school year. The 72
106106 commissioner shall not permit any such person who so taught 73
107107 kindergarten under such endorsement for one school year to teach 74
108108 kindergarten again, except the commissioner may permit such person 75
109109 to so teach kindergarten for one additional school year if such person 76
110110 can demonstrate that he or she is enrolled in a program to meet the 77
111111 requirements for the appropriate endorsement to teach kindergarten.] 78
112112 An endorsement to teach comprehensive special education grades one 79
113113 to twelve, inclusive, shall be valid for grades kindergarten to twelve, 80

120120 employee applying for a comprehensive special education 82
121121 endorsement, or (2) applicant for an initial, provisional or professional 83
122122 educator certificate and a comprehensive special education 84
123123 endorsement shall achieve a satisfactory score on the reading instruction 85
124124 examination approved by the State Board of Education on April 1, 2009, 86
125125 or a comparable reading instruction examination with minimum 87
126126 standards that are equivalent to the examination approved by the State 88
127127 Board of Education on April 1, 2009. 89
128128 Sec. 5. Section 10-264q of the 2020 supplement to the general statutes 90
129129 is repealed and the following is substituted in lieu thereof (Effective July 91
130130 1, 2020): 92
131131 Notwithstanding subdivision (3) of subsection (b) of section 10-264l, 93
132132 an interdistrict magnet school program that (1) does not assist the state 94
133133 in meeting the goals of the 2008 stipulation and order for Milo Sheff, et 95
134134 al. v. William A. O'Neill, et al., as extended, or the goals of the 2013 96
135135 stipulation and order for Milo Sheff, et al. v. William A. O'Neill, et al., 97
136136 as extended, as determined by the Commissioner of Education, and (2) 98
137137 is not in compliance with the enrollment requirements for students of 99
138138 racial minorities, pursuant to section 10-264l, following the submission 100
139139 of student information data of such interdistrict magnet school program 101
140140 to the state-wide public school information system, pursuant to section 102
141141 10-10a, as amended by this act, on or before October 1, 2019, shall remain 103
142142 eligible for an interdistrict magnet school operating grant pursuant to 104
143143 section 10-264l for the fiscal years ending June 30, 2020, [and] to June 30, 105
144144 [2021] 2023, inclusive, if such interdistrict magnet school program 106
145145 submits a compliance plan to the Commissioner of Education and the 107
146146 commissioner approves such plan. 108
147147 Sec. 6. Section 10-155k of the general statutes is repealed and the 109
148148 following is substituted in lieu thereof (Effective July 1, 2020): 110
149149 On and after July 1, 2013, the Commissioner of Education shall 111
150150 establish a School Paraprofessional Advisory Council, which on and 112
151151 after July 1, 2020, shall be known as the School Paraeducator Advisory 113 Raised Bill No. 5439

157157 Council, consisting of (1) one school [paraprofessional] paraeducator 114
158158 from each state-wide bargaining representative organization that 115
159159 represents school [paraprofessionals] paraeducators with instructional 116
160160 responsibilities, (2) one representative from each of the exclusive 117
161161 bargaining units for certified employees, chosen pursuant to section 10-118
162162 153b, (3) the most recent recipient of the Connecticut [Paraprofessional] 119
163163 Paraeducator of the Year Award, (4) two representatives from the 120
164164 regional educational service centers, appointed by the Commissioner of 121
165165 Education, and (5) a school administrator, appointed by the Connecticut 122
166166 Federation of School Administrators. The council shall hold quarterly 123
167167 meetings and advise, at least quarterly, the Commissioner of Education, 124
168168 or the commissioner's designee, of the needs for (A) professional 125
169169 development and the training of [paraprofessionals] paraeducators and 126
170170 the effectiveness of the content and the delivery of existing training for 127
171171 such [paraprofessionals] paraeducators, (B) appropriate staffing 128
172172 strategies for [paraprofessionals] paraeducators, and (C) other relevant 129
173173 issues relating to [paraprofessionals] paraeducators. The council shall 130
174174 report, annually, in accordance with the provisions of section 11-4a, on 131
175175 the recommendations given to the commissioner, or the commissioner's 132
176176 designee, pursuant to the provisions of this section, to the joint standing 133
177177 committee of the General Assembly having cognizance of matters 134
178178 relating to education. 135
179179 Sec. 7. (Effective from passage) (a) Not later than January 1, 2021, the 136
180180 School Paraeducator Advisory Council, established pursuant to section 137
181181 10-155k of the general statutes, as amended by this act, shall conduct a 138
182182 study concerning the following: (1) Appropriate minimum employment 139
183183 standards, including pay rates, health care coverage, retirement benefits 140
184184 and professional development opportunities for paraeducators that 141
185185 focus on maximizing the success of paraeducators in the classroom; (2) 142
186186 safety issues relating to paraeducators who work with students who 143
187187 have behavioral issues, including the availability of appropriate safety 144
188188 equipment for paraeducators at each school; (3) issues relating to the 145
189189 assignment of substitute teaching duties to paraeducators, including 146
190190 emergency situations when a paraeducator is asked to serve as a 147 Raised Bill No. 5439

196196 substitute teacher; and (4) issues relating to the duties of paraeducators 148
197197 who work with students who have individualized education programs. 149
198198 (b) Not later than January 1, 2021, the council shall develop proposals 150
199199 for the creation of a pathway for continued career and professional 151
200200 development, including, but not limited to, (1) paraeducator certificate 152
201201 and apprenticeship programs that offer course credits that apply to 153
202202 transferrable associate degree programs; (2) associate degree programs 154
203203 that (A) build upon and do not duplicate the courses and competencies 155
204204 of paraeducator certificate programs, (B) incorporate field experiences, 156
205205 (C) are aligned with the standards and competencies for teachers, and 157
206206 (D) are transferrable to a bachelor's degree in education and teacher 158
207207 certification programs; and (3) bachelor's degree programs that lead to 159
208208 teacher certification that build upon and do not duplicate the courses 160
209209 and competencies of transferrable associate degrees. 161
210210 (c) The council shall submit the study described in subsection (a) of 162
211211 this section and the proposals described in subsection (b) of this section, 163
212212 and any recommendations for legislation to the joint standing 164
213213 committee of the General Assembly having cognizance of matters 165
214214 relating to education, in accordance with the provisions of section 11-4a 166
215215 of the general statutes. 167
216216 Sec. 8. Subsection (a) of section 10-220a of the 2020 supplement to the 168
217217 general statutes is repealed and the following is substituted in lieu 169
218218 thereof (Effective July 1, 2020): 170
219219 (a) Each local or regional board of education shall provide an in-171
220220 service training program for its teachers, administrators and pupil 172
221221 personnel who hold the initial educator, provisional educator or 173
222222 professional educator certificate. Such program shall provide such 174
223223 teachers, administrators and pupil personnel with information on (1) 175
224224 the nature and the relationship of alcohol and drugs, as defined in 176
225225 subdivision (17) of section 21a-240, to health and personality 177
226226 development, and procedures for discouraging their abuse, (2) health 178
227227 and mental health risk reduction education that includes, but need not 179 Raised Bill No. 5439

233233 be limited to, the prevention of risk-taking behavior by children and the 180
234234 relationship of such behavior to substance abuse, pregnancy, sexually 181
235235 transmitted diseases, including HIV-infection and AIDS, as defined in 182
236236 section 19a-581, violence, teen dating violence, domestic violence and 183
237237 child abuse, (3) school violence prevention, conflict resolution, the 184
238238 prevention of and response to youth suicide and the identification and 185
239239 prevention of and response to bullying, as defined in subsection (a) of 186
240240 section 10-222d, except that those boards of education that implement 187
241241 any evidence-based model approach that is approved by the 188
242242 Department of Education and is consistent with subsection (c) of section 189
243243 10-145a, sections 10-222d, 10-222g and 10-222h, subsection (g) of section 190
244244 10-233c and sections 1 and 3 of public act 08-160, shall not be required 191
245245 to provide in-service training on the identification and prevention of 192
246246 and response to bullying, (4) cardiopulmonary resuscitation and other 193
247247 emergency life saving procedures, (5) the requirements and obligations 194
248248 of a mandated reporter, (6) the detection and recognition of, and 195
249249 evidence-based structured literacy interventions for, students with 196
250250 dyslexia, as defined in section 10-3d, and (7) culturally responsive 197
251251 pedagogy and practice. Each local or regional board of education [may] 198
252252 shall allow any [paraprofessional] paraeducator or noncertified 199
253253 employee to participate, on a voluntary basis, in any in-service training 200
254254 program provided pursuant to this section. 201
255255 Sec. 9. Subsection (a) of section 10-214 of the general statutes is 202
256256 repealed and the following is substituted in lieu thereof (Effective July 1, 203
257257 2020): 204
258258 (a) Each local or regional board of education shall provide annually 205
259259 to each pupil in kindergarten and grades one and three to five, inclusive, 206
260260 a vision screening. [,] Such vision screening may be performed using a 207
261261 Snellen chart [, or equivalent screening device, such as] or an automated 208
262262 vision screening device. The superintendent of schools shall give 209
263263 written notice to the parent or guardian of each pupil (1) who is found 210
264264 to have any defect of vision or disease of the eyes, with a brief statement 211
265265 describing such defect or disease and a recommendation for the pupil 212
266266 to be examined by an optometrist licensed under chapter 380 or an 213 Raised Bill No. 5439

272272 ophthalmologist licensed under chapter 370, and (2) who did not receive 214
273273 such vision screening, with a brief statement explaining why such pupil 215
274274 did not receive such vision screening. 216
275275 Sec. 10. Subdivision (2) of subsection (d) of section 10-51 of the 217
276276 general statutes is repealed and the following is substituted in lieu 218
277277 thereof (Effective July 1, 2020): 219
278278 (2) On and after June 7, 2006, a regional board of education, by a 220
279279 majority vote of its members, may create a reserve fund for capital and 221
280280 nonrecurring expenditures. Such fund shall thereafter be termed 222
281281 "reserve fund for capital and nonrecurring expenditures". The aggregate 223
282282 amount of annual and supplemental appropriations by a district to such 224
283283 fund shall not exceed [one] two per cent of the annual district budget 225
284284 for such fiscal year. Annual appropriations to such fund shall be 226
285285 included in the share of net expenses to be paid by each member town. 227
286286 Supplemental appropriations to such fund may be made from estimated 228
287287 fiscal year end surplus in operating funds. Interest and investment 229
288288 earnings received with respect to amounts held in the fund shall be 230
289289 credited to such fund. The board shall annually submit a complete and 231
290290 detailed report of the condition of such fund to the member towns. 232
291291 Upon the recommendation and approval by the regional board of 233
292292 education, any part or the whole of such fund may be used for capital 234
293293 and nonrecurring expenditures, but such use shall be restricted to the 235
294294 funding of all or part of the planning, construction, reconstruction or 236
295295 acquisition of any specific capital improvement or the acquisition of any 237
296296 specific item of equipment. Upon the approval of any such expenditure 238
297297 an appropriation shall be set up, plainly designated for the project or 239
298298 acquisition for which it has been authorized, and such unexpended 240
299299 appropriation may be continued until such project or acquisition is 241
300300 completed. Any unexpended portion of such appropriation remaining 242
301301 after such completion shall revert to said fund. If any authorized 243
302302 appropriation is set up pursuant to the provisions of this subsection and 244
303303 through unforeseen circumstances the completion of the project or 245
304304 acquisition for which such appropriation has been designated is 246
305305 impossible to attain the board, by a majority vote of its members, may 247 Raised Bill No. 5439

311311 terminate such appropriation which then shall no longer be in effect. 248
312312 Such fund may be discontinued, after the recommendation and 249
313313 approval by the regional board of education, and any amounts held in 250
314314 the fund shall be transferred to the general fund of the district. 251
315315 Sec. 11. Section 10-15i of the general statutes is repealed and the 252
316316 following is substituted in lieu thereof (Effective July 1, 2020): 253
317317 (a) There is established the Connecticut Achievement and Resource 254
318318 Equity in Schools Commission to provide analysis and 255
319319 recommendations concerning state funding for education and resources 256
320320 needed to ensure that all public school students in the state have an 257
321321 opportunity to succeed. The commission shall develop a strategic plan 258
322322 that includes recommendations for implementing a system for 259
323323 distributing state public education funding, that (1) includes a funding 260
324324 formula that (A) makes use of an appropriate foundation level, (B) 261
325325 addresses the issue of unequal local tax burdens and reduces the 262
326326 reliance on unequal local property taxation to fund services, (C) 263
327327 increases equity and fairness, and (D) reduces segregation; (2) depends 264
328328 on a stable, fair, reliable and identifiable funding source; (3) addresses 265
329329 students' educational needs from preschool through grade twelve, and 266
330330 (4) provides predictability and sustainability in grant allocations to 267
331331 towns and school districts. 268
332332 (b) The commission shall consist of the following members who shall 269
333333 reflect the state's geographic, population, socio-economic, racial and 270
334334 ethnic diversity: 271
335335 (1) Two appointed by the speaker of the House of Representatives, 272
336336 one of whom is a representative of the Connecticut Association of 273
337337 Boards of Education and one of whom is a representative of the 274
338338 Connecticut Education Association; 275
339339 (2) Two appointed by the president pro tempore of the Senate, one of 276
340340 whom is a representative of the RESC Alliance and one of whom is an 277
341341 economist with expertise in measures of poverty; 278 Raised Bill No. 5439

347347 (3) Two appointed by the Senate Republican president pro tempore, 279
348348 one of whom is a representative of the Connecticut Federation of School 280
349349 Administrators and one of whom is a representative of a regional 281
350350 agricultural science and technology education center; 282
351351 (4) Two appointed by the majority leader of the House of 283
352352 Representatives, one of whom is a representative of the Connecticut 284
353353 Association of Public School Superintendents and one of whom is a 285
354354 representative of the American Federation of Teachers-Connecticut; 286
355355 (5) Two appointed by the majority leader of the Senate, one of whom 287
356356 is a representative of the Connecticut Conference of Municipalities and 288
357357 one of whom is a representative of the Connecticut Council of 289
358358 Administrators of Special Education; 290
359359 (6) Two appointed by the deputy Senate Republican president pro 291
360360 tempore, one of whom is an employee of the bureau of choice programs 292
361361 within the Department of Education and one of whom is a 293
362362 representative of the Connecticut PTA; 294
363363 (7) Two appointed by the minority leader of the House of 295
364364 Representatives, one of whom is a representative of the Connecticut 296
365365 Association of Schools and one of whom is a representative of the 297
366366 Connecticut Administrators of Programs for English Language 298
367367 Learners; 299
368368 (8) One appointed jointly by the speaker of the House of 300
369369 Representatives and the minority leader of the House of Representatives 301
370370 who shall be a representative of the Connecticut Association of School 302
371371 Business Officials; and 303
372372 (9) One appointed jointly by the president pro tempore of the Senate 304
373373 and the Senate Republican president pro tempore who shall be a 305
374374 representative of the State Education Resource Center. 306
375375 (c) All appointments to the commission shall be made not later than 307
376376 thirty days after October 31, [2017] 2020. Except as otherwise provided 308 Raised Bill No. 5439

382382 in subsection (d) of this section, any vacancy shall be filled by the 309
383383 appointing authority. 310
384384 (d) There shall be two chairpersons of the commission appointed as 311
385385 follows: (1) The speaker of the House of Representatives shall select a 312
386386 chairperson of the commission from among the members of the 313
387387 commission, and (2) the president pro tempore of the Senate and the 314
388388 Senate Republican president pro tempore shall jointly select the other 315
389389 chairperson of the commission from among the members of the 316
390390 commission. If the chairperson appointed pursuant to subdivision (2) of 317
391391 this subsection becomes vacant, the president pro tempore of the Senate 318
392392 and the Senate Republican president pro tempore, or the president pro 319
393393 tempore of the Senate, as the case may be, shall fill such vacancy. The 320
394394 chairpersons shall schedule the first meeting of the commission, which 321
395395 shall be held not later than sixty days after October 31, [2017] 2020. 322
396396 (e) Not later than April 1, [2018] 2021, the commission shall submit a 323
397397 report on its findings and recommendations to the Governor, the 324
398398 Secretary of the Office of Policy and Management and the joint standing 325
399399 committees of the General Assembly having cognizance of matters 326
400400 relating to education and appropriations and the budgets of state 327
401401 agencies, in accordance with the provisions of section 11-4a. 328
402402 Sec. 12. (Effective from passage) The Commissioner of Education shall 329
403403 establish a working group to study issues relating to the provision of 330
404404 world language instruction in public elementary schools. The working 331
405405 group shall examine the benefits associated with the early introduction 332
406406 of world language instruction to students and the feasibility of 333
407407 implementing a world languages requirement at the elementary school 334
408408 level. The commissioner shall select the members of the working group, 335
409409 provided such working group includes educators of world languages 336
410410 and members who represent boards of education, superintendents and 337
411411 parents of students. Not later than January 1, 2021, the commissioner 338
412412 shall submit a report on the working group's findings and any 339
413413 recommendations for legislation to the joint standing committee of the 340
414414 General Assembly having cognizance of matters relating to education, 341 Raised Bill No. 5439

420420 in accordance with the provisions of section 11-4a of the general statutes. 342
421421 Sec. 13. Subparagraph (C) of subdivision (1) of subsection (c) of 343
422422 section 10-10a of the general statutes is repealed and the following is 344
423423 substituted in lieu thereof (Effective July 1, 2020): 345
424424 (C) Data relating to schools and districts shall include, but not be 346
425425 limited to, (i) school population, (ii) annual student graduation rates, 347
426426 (iii) annual teacher retention rates, (iv) school disciplinary records, such 348
427427 as data relating to (I) suspensions, (II) expulsions, including the number 349
428428 of expulsion hearings conducted and the number of expulsions, and (III) 350
429429 other disciplinary actions, (v) the percentage of students whose primary 351
430430 language is not English, (vi) the number of and professional credentials 352
431431 of support personnel, (vii) information relating to instructional 353
432432 technology, such as access to computers, and (viii) disaggregated 354
433433 measures of school-based arrests pursuant to section 10-233n, as 355
434434 amended by this act. 356
435435 Sec. 14. Subsection (c) of section 10-220 of the 2020 supplement to the 357
436436 general statutes is repealed and the following is substituted in lieu 358
437437 thereof (Effective July 1, 2020): 359
438438 (c) Annually, each local and regional board of education shall submit 360
439439 to the Commissioner of Education a strategic school profile report for 361
440440 each school and school or program of alternative education, as defined 362
441441 in section 10-74j, under its jurisdiction and for the school district as a 363
442442 whole. The superintendent of each local and regional school district 364
443443 shall present the profile report at the next regularly scheduled public 365
444444 meeting of the board of education after each November first. The profile 366

450450 the number of expulsions, and the number of truants, as defined in 372
451451 section 10-198a, and chronically absent children, as defined in section 373 Raised Bill No. 5439

457457 10-198c, (4) the number of students enrolled in an adult high school 374
458458 credit diploma program, pursuant to section 10-69, operated by a local 375
459459 or regional board of education or a regional educational service center, 376
460460 (5) equitable allocation of resources among its schools, (6) reduction of 377
461461 racial, ethnic and economic isolation, (7) special education, and (8) 378
462462 school-based arrests, as defined in section 10-233n, as amended by this 379
463463 act. For purposes of this subsection, measures of special education 380
464464 include (A) special education identification rates by disability, (B) rates 381
465465 at which special education students are exempted from mastery testing 382
466466 pursuant to section 10-14q, (C) expenditures for special education, 383
467467 including such expenditures as a percentage of total expenditures, (D) 384
468468 achievement data for special education students, (E) rates at which 385
469469 students identified as requiring special education are no longer 386
470470 identified as requiring special education, (F) the availability of 387
471471 supplemental educational services for students lacking basic 388
472472 educational skills, (G) the amount of special education student 389
473473 instructional time with nondisabled peers, (H) the number of students 390
474474 placed out-of-district, and (I) the actions taken by the school district to 391
475475 improve special education programs, as indicated by analyses of the 392
476476 local data provided in subparagraphs (A) to (H), inclusive, of this 393
477477 subdivision. The superintendent shall include in the narrative portion 394
478478 of the report information about parental involvement and any measures 395
479479 the district has taken to improve parental involvement, including, but 396
480480 not limited to, employment of methods to engage parents in the 397
481481 planning and improvement of school programs and methods to increase 398
482482 support to parents working at home with their children on learning 399
483483 activities. For purposes of this subsection, measures of truancy include 400
484484 the type of data that is required to be collected by the Department of 401
485485 Education regarding attendance and unexcused absences in order for 402
486486 the department to comply with federal reporting requirements and the 403
487487 actions taken by the local or regional board of education to reduce 404
488488 truancy in the school district. Such truancy data shall be considered a 405
489489 public record, as defined in section 1-200. 406

496496 repealed and the following is substituted in lieu thereof (Effective July 1, 408
497497 2020): 409
498498 (b) The Department of Education shall annually examine data 410
499499 relating to in-school suspensions, out-of-school suspensions, 411
500500 expulsions, including the number of expulsion hearings conducted and 412
501501 the number of expulsions, and school-based arrests that has been 413
502502 submitted as part of the strategic school profile report pursuant to 414
503503 section 10-220, as amended by this act, and shall disaggregate such data 415
504504 by school, race, ethnicity, gender, age, students with disabilities, English 416
505505 language learners, as defined in section 10-76kk, students who are 417
506506 eligible for free or reduced priced lunch pursuant to federal law and 418
507507 regulations, and type of offense for which the school-based arrests were 419
508508 made and the number of arrests made annually at each school within 420
509509 the school district. The department shall annually submit a report to the 421
510510 State Board of Education regarding the examination and disaggregation 422
511511 of such data and make the report available on the department's Internet 423
512512 web site. 424
513513 Sec. 16. (NEW) (Effective July 1, 2020) (a) For the school year 425
514514 commencing July 1, 2020, and each school year thereafter, each local and 426
515515 regional board of education and supervisory agent of a nonpublic 427
516516 school, in consultation with local emergency medical services providers 428
517517 and allied health professionals, shall develop and implement an 429
518518 emergency action plan for responding to serious and life-threatening 430
519519 sports-related injuries that occur during interscholastic and intramural 431
520520 athletic events. 432
521521 (b) Such emergency action plan shall establish the procedures to be 433
522522 followed in the event that a student sustains a serious injury or illness 434
523523 while participating in an interscholastic or intramural athletic event, and 435
524524 shall include, but need not be limited to, the following components: 436
525525 (1) A list of the school employees, coaches or licensed athletic trainers 437
526526 in each school who will be responsible for implementing the emergency 438
527527 action plan and a description of each person's responsibilities under the 439 Raised Bill No. 5439

534534 (2) An identification of the location or venue where the interscholastic 441
535535 or intramural athletic event is taking place; 442
536536 (3) A description of the equipment and supplies that may be available 443
537537 at the site of the interscholastic or intramural athletic event that will 444
538538 assist in responding to an emergency, including the location of where 445
539539 such equipment and supplies may be found at such site; 446
540540 (4) A description of the procedures to be followed when a student 447
541541 sustains a serious sports-related injury, including, but not limited to, 448
542542 responding to the injured student, summoning emergency medical care, 449
543543 assisting local first responders in getting to the injured student and 450
544544 documenting the actions taken during the emergency; 451
545545 (5) A description of the protocols to be followed during cardiac or 452
546546 respiratory emergencies, including the operation of an automatic 453
547547 external defibrillator, use of cardiopulmonary resuscitation or the 454
548548 administration of medication, in accordance with the provisions of 455
549549 section 10-212a of the general statutes; 456
550550 (6) A description of the protocols to be followed when a student is 457
551551 observed to exhibit signs, symptoms or behaviors consistent with a 458
552552 concussion or is diagnosed with a concussion, in accordance with the 459
553553 provisions of section 10-149c of the general statutes; 460
554554 (7) A description of the protocols to be followed when a student 461
555555 suffers from a traumatic brain injury or spinal cord injury, provided 462
556556 such protocols are designed to include instructions that are based on the 463
557557 level of training of the person implementing the emergency action plan 464
558558 and are in accordance with best practices and state law; and 465
559559 (8) A description of the protocols to be followed in the event of heat 466
560560 or cold-related emergencies, provided such protocols are in accordance 467
561561 with current professional standards. 468

568568 annually by the school employees, coaches and licensed athletic trainers 470
569569 identified in the emergency action plan pursuant to subdivision (1) of 471
570570 subsection (b) of this section. Such plan shall be updated as necessary. 472
571571 (d) Any school employee, coach or licensed athletic trainer identified 473
572572 in the emergency action plan pursuant to subdivision (1) of subsection 474
573573 (b) of this section shall be certified in cardiopulmonary resuscitation and 475
574574 have completed a course in first aid offered by the American Red Cross, 476
575575 the American Heart Association, the Department of Public Health, any 477
576576 director of health or an organization using guidelines for first aid 478
577577 published by the American Heart Association and the American Red 479
578578 Cross. 480
579579 (e) Each local and regional board of education and supervisory agent 481
580580 of a nonpublic school shall (1) distribute the emergency action plan to 482
581581 all school employees, coaches and licensed athletic trainers identified in 483
582582 the emergency action plan pursuant to subdivision (1) of subsection (b) 484
583583 of this section, (2) post such emergency action plan in all athletic 485
584584 facilities and at all sites where interscholastic and intramural athletic 486
585585 events will take place, and (3) make such emergency action plan 487
586586 available on the Internet web site for the school district or school. 488
587587 (f) In developing and implementing the emergency action plan, a 489
588588 local or regional board of education or supervisory agent of a nonpublic 490
589589 school may utilize existing and appropriate public or private materials, 491
590590 models, personnel and other resources, and may accept gifts, grants and 492
591591 donations, including in-kind donations, designated for the development 493
592592 and implementation of the emergency action plan. 494
593593 This act shall take effect as follows and shall amend the following
