24 | 24 | | Section 1. Subsection (a) of section 10-145 of the general statutes is 1 |

34 | 34 | | nothing in this subsection shall be construed to prevent the board of 11 |
---|
35 | 35 | | education from prescribing qualifications additional to those prescribed 12 |
---|
36 | 36 | | by the regulations of the State Board of Education and provided nothing 13 |
---|
37 | 37 | | in this subsection shall be construed to prevent any local or regional 14 |
---|

46 | 46 | | instructors licensed by the Department of Motor Vehicles. No person 18 |
---|
47 | 47 | | shall be employed in any of the schools of any local or regional board of 19 |
---|
48 | 48 | | education as a substitute teacher unless such person (1) [holds a 20 |
---|
49 | 49 | | bachelor's degree, provided the Commissioner of Education may waive 21 |
---|
50 | 50 | | such requirement for good cause upon the request of a superintendent 22 |
---|
51 | 51 | | of schools] (A) holds at least an associate degree if such person will be 23 |
---|
52 | 52 | | in the same assignment for more than ten school days, or (B) has 24 |
---|
53 | 53 | | obtained a high school diploma or its equivalent if such person will be 25 |
---|
54 | 54 | | in the same assignment for ten or fewer school days, and (2) is on a list 26 |
---|
55 | 55 | | maintained by the local or regional board of education pursuant to 27 |
---|
56 | 56 | | subsection (f) of section 10-222c. 28 |
---|
57 | 57 | | Sec. 2. Subsection (c) of section 10-221a of the 2020 supplement to the 29 |
---|
58 | 58 | | general statutes is repealed and the following is substituted in lieu 30 |
---|
59 | 59 | | thereof (Effective July 1, 2020): 31 |
---|
60 | 60 | | (c) Commencing with classes graduating in 2023, and for each 32 |
---|
61 | 61 | | graduating class thereafter, no local or regional board of education shall 33 |
---|
62 | 62 | | permit any student to graduate from high school or grant a diploma to 34 |
---|
63 | 63 | | any student who has not satisfactorily completed a minimum of twenty-35 |
---|
64 | 64 | | five credits, including not fewer than: (1) Nine credits in the humanities, 36 |
---|
65 | 65 | | including civics and the arts; (2) nine credits in science, technology, 37 |
---|
66 | 66 | | engineering and mathematics; (3) one credit in physical education; [and 38 |
---|
67 | 67 | | wellness;] (4) one credit in health [and safety] education, as described in 39 |
---|
68 | 68 | | section 10-16b; (5) one credit in world languages, subject to the 40 |
---|
69 | 69 | | provisions of subsection (g) of this section; and (6) a one credit mastery-41 |
---|
70 | 70 | | based diploma assessment. 42 |
---|
71 | 71 | | Sec. 3. Subsection (a) of section 10-15c of the general statutes is 43 |
---|
72 | 72 | | repealed and the following is substituted in lieu thereof (Effective July 1, 44 |

84 | 84 | | schools, at such time as the child becomes eligible to participate in such 51 |
---|
85 | 85 | | activities, programs and courses of study, without discrimination on 52 |
---|
86 | 86 | | account of race, color, sex, gender identity or expression, religion, 53 |
---|
87 | 87 | | national origin, [or] sexual orientation or disability; provided boards of 54 |
---|
88 | 88 | | education may, by vote at a meeting duly called, admit to any school 55 |
---|
89 | 89 | | children under five years of age. 56 |
---|
90 | 90 | | Sec. 4. Subsection (f) of section 10-145d of the 2020 supplement to the 57 |
---|
91 | 91 | | general statutes is repealed and the following is substituted in lieu 58 |
---|
92 | 92 | | thereof (Effective July 1, 2020): 59 |
---|
93 | 93 | | (f) An endorsement issued prior to July 1, [2013] 2020, to teach 60 |
---|
94 | 94 | | elementary education grades one to six, inclusive, shall be valid for 61 |
---|
95 | 95 | | grades kindergarten to six, inclusive, and for such an endorsement 62 |
---|
96 | 96 | | issued on or after July 1, [2013] 2020, the endorsement shall be valid for 63 |
---|
97 | 97 | | grades [one] kindergarten to six, inclusive. [, except such an 64 |
---|
98 | 98 | | endorsement issued between July 1, 2013, and July 1, 2017, to any 65 |
---|
99 | 99 | | student who was admitted to and successfully completes a teacher 66 |

100 | 100 | | preparation program, as defined in section 10-10a, in the certification 67 |

101 | 101 | | endorsement area of elementary education on or before June 30, 2017, 68 |

102 | 102 | | shall be valid for grades kindergarten to six, inclusive. The 69 |

103 | 103 | | Commissioner of Education may permit, upon the request of a 70 |

128 | 128 | | Sec. 5. Section 10-264q of the 2020 supplement to the general statutes 90 |
---|

147 | 147 | | Sec. 6. Section 10-155k of the general statutes is repealed and the 109 |

160 | 160 | | responsibilities, (2) one representative from each of the exclusive 117 |
---|
161 | 161 | | bargaining units for certified employees, chosen pursuant to section 10-118 |
---|
162 | 162 | | 153b, (3) the most recent recipient of the Connecticut [Paraprofessional] 119 |
---|
163 | 163 | | Paraeducator of the Year Award, (4) two representatives from the 120 |
---|
164 | 164 | | regional educational service centers, appointed by the Commissioner of 121 |
---|
165 | 165 | | Education, and (5) a school administrator, appointed by the Connecticut 122 |
---|
166 | 166 | | Federation of School Administrators. The council shall hold quarterly 123 |
---|
167 | 167 | | meetings and advise, at least quarterly, the Commissioner of Education, 124 |
---|
168 | 168 | | or the commissioner's designee, of the needs for (A) professional 125 |
---|
169 | 169 | | development and the training of [paraprofessionals] paraeducators and 126 |
---|
170 | 170 | | the effectiveness of the content and the delivery of existing training for 127 |
---|
171 | 171 | | such [paraprofessionals] paraeducators, (B) appropriate staffing 128 |
---|
172 | 172 | | strategies for [paraprofessionals] paraeducators, and (C) other relevant 129 |
---|
173 | 173 | | issues relating to [paraprofessionals] paraeducators. The council shall 130 |
---|
174 | 174 | | report, annually, in accordance with the provisions of section 11-4a, on 131 |
---|
175 | 175 | | the recommendations given to the commissioner, or the commissioner's 132 |
---|
176 | 176 | | designee, pursuant to the provisions of this section, to the joint standing 133 |
---|
177 | 177 | | committee of the General Assembly having cognizance of matters 134 |
---|
178 | 178 | | relating to education. 135 |
---|
179 | 179 | | Sec. 7. (Effective from passage) (a) Not later than January 1, 2021, the 136 |
---|
180 | 180 | | School Paraeducator Advisory Council, established pursuant to section 137 |
---|
181 | 181 | | 10-155k of the general statutes, as amended by this act, shall conduct a 138 |
---|
182 | 182 | | study concerning the following: (1) Appropriate minimum employment 139 |
---|
183 | 183 | | standards, including pay rates, health care coverage, retirement benefits 140 |
---|
184 | 184 | | and professional development opportunities for paraeducators that 141 |
---|
185 | 185 | | focus on maximizing the success of paraeducators in the classroom; (2) 142 |
---|
186 | 186 | | safety issues relating to paraeducators who work with students who 143 |
---|
187 | 187 | | have behavioral issues, including the availability of appropriate safety 144 |
---|
188 | 188 | | equipment for paraeducators at each school; (3) issues relating to the 145 |
---|
189 | 189 | | assignment of substitute teaching duties to paraeducators, including 146 |
---|
190 | 190 | | emergency situations when a paraeducator is asked to serve as a 147 Raised Bill No. 5439 |
---|
191 | 191 | | |
---|
192 | 192 | | |
---|

196 | 196 | | substitute teacher; and (4) issues relating to the duties of paraeducators 148 |
---|
197 | 197 | | who work with students who have individualized education programs. 149 |
---|
198 | 198 | | (b) Not later than January 1, 2021, the council shall develop proposals 150 |
---|
199 | 199 | | for the creation of a pathway for continued career and professional 151 |
---|
200 | 200 | | development, including, but not limited to, (1) paraeducator certificate 152 |
---|
201 | 201 | | and apprenticeship programs that offer course credits that apply to 153 |
---|
202 | 202 | | transferrable associate degree programs; (2) associate degree programs 154 |
---|
203 | 203 | | that (A) build upon and do not duplicate the courses and competencies 155 |
---|
204 | 204 | | of paraeducator certificate programs, (B) incorporate field experiences, 156 |
---|
205 | 205 | | (C) are aligned with the standards and competencies for teachers, and 157 |
---|
206 | 206 | | (D) are transferrable to a bachelor's degree in education and teacher 158 |
---|
207 | 207 | | certification programs; and (3) bachelor's degree programs that lead to 159 |
---|
208 | 208 | | teacher certification that build upon and do not duplicate the courses 160 |
---|
209 | 209 | | and competencies of transferrable associate degrees. 161 |
---|
210 | 210 | | (c) The council shall submit the study described in subsection (a) of 162 |
---|
211 | 211 | | this section and the proposals described in subsection (b) of this section, 163 |
---|
212 | 212 | | and any recommendations for legislation to the joint standing 164 |
---|
213 | 213 | | committee of the General Assembly having cognizance of matters 165 |
---|
214 | 214 | | relating to education, in accordance with the provisions of section 11-4a 166 |
---|
215 | 215 | | of the general statutes. 167 |
---|
216 | 216 | | Sec. 8. Subsection (a) of section 10-220a of the 2020 supplement to the 168 |
---|
217 | 217 | | general statutes is repealed and the following is substituted in lieu 169 |
---|

226 | 226 | | development, and procedures for discouraging their abuse, (2) health 178 |
---|
227 | 227 | | and mental health risk reduction education that includes, but need not 179 Raised Bill No. 5439 |

236 | 236 | | section 19a-581, violence, teen dating violence, domestic violence and 183 |
---|
237 | 237 | | child abuse, (3) school violence prevention, conflict resolution, the 184 |
---|
238 | 238 | | prevention of and response to youth suicide and the identification and 185 |
---|
239 | 239 | | prevention of and response to bullying, as defined in subsection (a) of 186 |
---|
240 | 240 | | section 10-222d, except that those boards of education that implement 187 |
---|
241 | 241 | | any evidence-based model approach that is approved by the 188 |
---|
242 | 242 | | Department of Education and is consistent with subsection (c) of section 189 |
---|
243 | 243 | | 10-145a, sections 10-222d, 10-222g and 10-222h, subsection (g) of section 190 |
---|
244 | 244 | | 10-233c and sections 1 and 3 of public act 08-160, shall not be required 191 |
---|
245 | 245 | | to provide in-service training on the identification and prevention of 192 |
---|
246 | 246 | | and response to bullying, (4) cardiopulmonary resuscitation and other 193 |
---|
247 | 247 | | emergency life saving procedures, (5) the requirements and obligations 194 |
---|
248 | 248 | | of a mandated reporter, (6) the detection and recognition of, and 195 |
---|
249 | 249 | | evidence-based structured literacy interventions for, students with 196 |
---|
250 | 250 | | dyslexia, as defined in section 10-3d, and (7) culturally responsive 197 |
---|
251 | 251 | | pedagogy and practice. Each local or regional board of education [may] 198 |
---|
252 | 252 | | shall allow any [paraprofessional] paraeducator or noncertified 199 |
---|
253 | 253 | | employee to participate, on a voluntary basis, in any in-service training 200 |
---|
254 | 254 | | program provided pursuant to this section. 201 |
---|
255 | 255 | | Sec. 9. Subsection (a) of section 10-214 of the general statutes is 202 |
---|
256 | 256 | | repealed and the following is substituted in lieu thereof (Effective July 1, 203 |
---|
257 | 257 | | 2020): 204 |
---|
258 | 258 | | (a) Each local or regional board of education shall provide annually 205 |
---|
259 | 259 | | to each pupil in kindergarten and grades one and three to five, inclusive, 206 |
---|
260 | 260 | | a vision screening. [,] Such vision screening may be performed using a 207 |
---|
261 | 261 | | Snellen chart [, or equivalent screening device, such as] or an automated 208 |
---|
262 | 262 | | vision screening device. The superintendent of schools shall give 209 |
---|
263 | 263 | | written notice to the parent or guardian of each pupil (1) who is found 210 |
---|
264 | 264 | | to have any defect of vision or disease of the eyes, with a brief statement 211 |
---|
265 | 265 | | describing such defect or disease and a recommendation for the pupil 212 |
---|
266 | 266 | | to be examined by an optometrist licensed under chapter 380 or an 213 Raised Bill No. 5439 |
---|

275 | 275 | | Sec. 10. Subdivision (2) of subsection (d) of section 10-51 of the 217 |
---|
276 | 276 | | general statutes is repealed and the following is substituted in lieu 218 |
---|
277 | 277 | | thereof (Effective July 1, 2020): 219 |
---|
278 | 278 | | (2) On and after June 7, 2006, a regional board of education, by a 220 |
---|
279 | 279 | | majority vote of its members, may create a reserve fund for capital and 221 |
---|
280 | 280 | | nonrecurring expenditures. Such fund shall thereafter be termed 222 |
---|
281 | 281 | | "reserve fund for capital and nonrecurring expenditures". The aggregate 223 |
---|
282 | 282 | | amount of annual and supplemental appropriations by a district to such 224 |
---|
283 | 283 | | fund shall not exceed [one] two per cent of the annual district budget 225 |
---|
284 | 284 | | for such fiscal year. Annual appropriations to such fund shall be 226 |
---|
285 | 285 | | included in the share of net expenses to be paid by each member town. 227 |
---|
286 | 286 | | Supplemental appropriations to such fund may be made from estimated 228 |
---|
287 | 287 | | fiscal year end surplus in operating funds. Interest and investment 229 |
---|
288 | 288 | | earnings received with respect to amounts held in the fund shall be 230 |
---|
289 | 289 | | credited to such fund. The board shall annually submit a complete and 231 |
---|
290 | 290 | | detailed report of the condition of such fund to the member towns. 232 |
---|
291 | 291 | | Upon the recommendation and approval by the regional board of 233 |
---|
292 | 292 | | education, any part or the whole of such fund may be used for capital 234 |
---|
293 | 293 | | and nonrecurring expenditures, but such use shall be restricted to the 235 |
---|
294 | 294 | | funding of all or part of the planning, construction, reconstruction or 236 |
---|
295 | 295 | | acquisition of any specific capital improvement or the acquisition of any 237 |
---|
296 | 296 | | specific item of equipment. Upon the approval of any such expenditure 238 |
---|
297 | 297 | | an appropriation shall be set up, plainly designated for the project or 239 |
---|
298 | 298 | | acquisition for which it has been authorized, and such unexpended 240 |
---|
299 | 299 | | appropriation may be continued until such project or acquisition is 241 |
---|
300 | 300 | | completed. Any unexpended portion of such appropriation remaining 242 |
---|
301 | 301 | | after such completion shall revert to said fund. If any authorized 243 |
---|
302 | 302 | | appropriation is set up pursuant to the provisions of this subsection and 244 |
---|
303 | 303 | | through unforeseen circumstances the completion of the project or 245 |
---|
304 | 304 | | acquisition for which such appropriation has been designated is 246 |
---|

467 | 467 | | including such expenditures as a percentage of total expenditures, (D) 384 |

468 | 468 | | achievement data for special education students, (E) rates at which 385 |
---|
469 | 469 | | students identified as requiring special education are no longer 386 |
---|
470 | 470 | | identified as requiring special education, (F) the availability of 387 |
---|
471 | 471 | | supplemental educational services for students lacking basic 388 |
---|
472 | 472 | | educational skills, (G) the amount of special education student 389 |
---|
473 | 473 | | instructional time with nondisabled peers, (H) the number of students 390 |
---|
474 | 474 | | placed out-of-district, and (I) the actions taken by the school district to 391 |

475 | 475 | | improve special education programs, as indicated by analyses of the 392 |

478 | 478 | | of the report information about parental involvement and any measures 395 |

480 | 480 | | not limited to, employment of methods to engage parents in the 397 |
---|

---|
482 | 482 | | support to parents working at home with their children on learning 399 |
---|
483 | 483 | | activities. For purposes of this subsection, measures of truancy include 400 |
---|
484 | 484 | | the type of data that is required to be collected by the Department of 401 |

485 | 485 | | Education regarding attendance and unexcused absences in order for 402 |
---|
486 | 486 | | the department to comply with federal reporting requirements and the 403 |
---|
487 | 487 | | actions taken by the local or regional board of education to reduce 404 |

488 | 488 | | truancy in the school district. Such truancy data shall be considered a 405 |
