2020 AN ACT CONCERNING NO NEMERGENCY MEDICAL
2121 TRANSPORTATION FOR M EDICAID BENEFICIARIES.
2222 Be it enacted by the Senate and House of Representatives in General

2525 Section 1. (NEW) (Effective from passage) (a) The Commissioner of 1
2626 Social Services shall ensure that the state's medical assistance program 2
2727 provides medically necessary and medically appropriate 3
2828 nonemergency medical transportation upon the request of a program 4
2929 beneficiary. In negotiating any contract with a transportation brokerage 5
3030 vendor to provide nonemergency medical transportation, the 6
3131 commissioner shall consider recommendations made in a 2020 audit of 7
3232 the state's nonemergency medical transportation program by the state 8
3333 Auditors of Public Accounts, including, but not limited to, requiring 9
3434 that the contractor: (1) Immediately remove any driver deemed to pose 10
3535 a risk to medical assistance beneficiaries, (2) have an adequate number 11
3636 of wheelchair-accessible vehicles to meet demand, (3) accurately report 12
3737 statistics regarding the percentage of nonemergency medical 13
3838 transportation provided on time, and (4) promptly investigate and 14

4545 (b) The Commissioner of Social Services shall evaluate the 16
4646 administrative burdens placed on beneficiaries of the medical assistance 17
4747 program and the health care providers of such beneficiaries. To the 18
4848 extent permissible under federal law, the commissioner shall reduce the 19
4949 number of medical necessity forms needed by such beneficiaries in 20
5050 order to receive nonemergency medical transportation. 21
