AN ACT CONCERNING CH ILDREN'S MENUS. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. (NEW) (Effective July 1, 2020) (a) As used in this section: 1 
(1) "Authorized agent" means an individual certified by the 2 
Commissioner of Public Health to inspect food service establishments 3 
and enforce the regulations adopted pursuant to section 19a-36a of the 4 
general statutes, as amended by this act; 5 
(2) "Grouped children's meal" means one or more food items and a 6 
beverage sold together at a single price and intended primarily for 7 
consumption by a child; 8 
(3) "Children's menu" means a restaurant menu that contains only 9 
grouped children's meals, a section of a restaurant menu that contains 10 
only grouped children's meals or an advertisement for a grouped 11 
children's meal; 12 
(4) "Director of health" has the same meaning as provided in section 13 
19a-36g of the general statutes; 14

(5) "Nondairy milk alternative" means a fluid milk substitute that 15 
meets the standards established pursuant to the National School Lunch 16 
Program meal requirements for lunches and requirements for 17 
afterschool snacks, 7 CFR 210.10; and 18 
(6) "Restaurant" means any entity that is licensed, permitted, 19 
registered or inspected as a food service establishment by a local health 20 
department or district health department pursuant to regulations 21 
adopted under section 19a-36a of the general statutes, as amended by 22 
this act, other than a grocery store or a school, institution or entity that 23 
participates in a child nutrition program administered by the United 24 
States Department of Agriculture Food and Nutrition Service. 25 
(b) On and after January 1, 2021, any beverage included on a 26 
children's menu shall be water, sparkling water, flavored water that 27 
contains no added sugar or sweeteners, water flavored with fruit or 28 
vegetable juice that contains no added sugar or sweeteners and not more 29 
than one-half gram of sugar per ounce, unflavored milk or a nondairy 30 
milk alternative. 31 
(c) Nothing in this section shall prohibit a restaurant from selling a 32 
beverage that is not included on a children's menu as part of a grouped 33 
children's meal upon the request of a customer. 34 
(d) Any restaurant that offers grouped children's meals for sale shall, 35 
as part of a regularly scheduled food service establishment inspection 36 
conducted by an authorized agent, provide a copy of any children's 37 
menu used by such restaurant to such authorized agent. 38 
Sec. 2. Section 19a-36a of the general statutes is repealed and the 39 
following is substituted in lieu thereof (Effective July 1, 2020): 40 
(a) The Commissioner of Public Health shall adopt regulations, in 41 
accordance with the provisions of chapter 54, to assure that food service 42 
establishments employ as food operators persons who have a 43 
knowledge of safe food handling techniques and to set requirements for 44

the employment of food operators by such establishments. Such 45 
regulations shall include, but not be limited to, responsibilities of food 46 
service establishments and their employees, exemptions for certain 47 
classes of food establishments and responsibilities of local health 48 
departments in monitoring compliance of food establishments. 49 
(b) On or before January 1, 2021, the Commissioner of Public Health 50 
shall adopt regulations, in accordance with the provisions of chapter 54, 51 
to require regularly scheduled food service establishment inspections to 52 
include a review of all children's menus, as defined in section 1 of this 53 
act, for compliance with the provisions of section 1 of this act.  54 
This act shall take effect as follows and shall amend the following 
sections:
