1919 AN ACT CONCERNING TH E REASSESSMENT OF RE SIDENTIAL
2020 BUILDINGS WITH DEFEC TIVE CONCRETE FOUNDATIONS AND
2121 QUARRY GEOLOGICAL SO URCE REPORTING.
2222 Be it enacted by the Senate and House of Representatives in General

2525 Section 1. Section 29-265d of the general statutes is repealed and the 1
2626 following is substituted in lieu thereof (Effective from passage): 2
2727 (a) Any owner of a residential building who has obtained a written 3
2828 evaluation from a professional engineer licensed pursuant to chapter 4
2929 391 indicating that the foundation of such residential building was made 5
3030 with defective concrete may provide a copy of such evaluation to the 6
3131 assessor and request a reassessment of the residential building by the 7
3232 assessor. Not later than ninety days after receipt of a copy of such 8
3333 evaluation, or prior to the commencement of the assessment year next 9
3434 following, whichever is earlier, the assessor, member of the assessor's 10
3535 staff or person designated by the assessor shall inspect the residential 11
3636 building and adjust its assessment to reflect its current value. Such 12
3737 reassessment may be appealed pursuant to section 12-111. Any 13

4444 until the assessor, member of the assessor's staff or person designated 15
4545 by the assessor adjusts the assessment of the residential building 16
4646 pursuant to subsection (b) of this section, notwithstanding the 17
4747 provisions of section 12-62. 18
4848 (b) An owner of a residential building that has obtained a 19
4949 reassessment pursuant to this section shall notify the assessor if the 20
5050 concrete foundation is repaired or replaced. [during the five assessment 21
5151 years for which the reassessment is effective.] Such notification shall be 22
5252 made in writing within thirty days of the repair or replacement of the 23
5353 concrete foundation. Not later than ninety days after receipt of such 24
5454 notification, or prior to the commencement of the assessment year next 25
5555 following, whichever is earlier, the assessor, member of the assessor's 26
5656 staff or person designated by the assessor shall inspect the residential 27
5757 building and adjust its assessment to reflect its current value. 28
5858 Sec. 2. (NEW) (Effective July 1, 2020) (a) For the purposes of this 29
5959 section, "qualified geologist" means a geologist certified by the 30
6060 American Institute of Professional Geologists, licensed by the National 31
6161 Association of State Boards of Geology or certified or licensed by 32
6262 another organization deemed suitable by the State Geologist. 33
6363 (b) Not later than January 1, 2021, and annually thereafter, the 34
6464 operator of each quarry in this state that produces aggregate for use in 35
6565 concrete shall prepare a geological source report and provide such 36
6666 report to the State Geologist. Such report shall be prepared in a form and 37
6767 manner prescribed by the State Geologist, and shall include, but need 38
6868 not be limited to (1) the operations plan and mining, processing, storage 39
6969 and quality control methods utilized by such operator, (2) a description 40
7070 of the characteristics of the aggregate to be excavated at such quarry, 41
7171 which shall be prepared by a qualified geologist, (3) a description of the 42
7272 products to be produced by such quarry, (4) a copy of the results of an 43
7373 inspection of face material and geologic log analysis completed in the 44
7474 previous year by a qualified geologist, and (5) analysis of core samples, 45
7575 completed in the previous year by a qualified geologist, unless such 46
7676 quarry has a satisfactory performance history as determined by the State 47 Raised Bill No. 468

8989 Statement of Purpose:
9090 To (1) permit any owner of a residential building with a foundation
9191 made with defective concrete to obtain a reassessment of such building
9292 which shall remain valid until such foundation is repaired or replaced,
9393 and (2) require quarries that produce aggregate for use in concrete to
9494 annually prepare a geological source report.
