21 | 21 | AN ACT CONCERNING PROFESSIONAL MALPRACTICE COMMITTED | |
22 | 22 | BY A GUARDIAN AD LITEM IN A FAMILY RELATIONS PROCEEDING. | |
23 | 23 | Be it enacted by the Senate and House of Representatives in General | |
24 | 24 | Assembly convened: | |

26 | 26 | That chapter 815j of the general statutes be amended to provide that: 1 | |
27 | 27 | (1) Any person, aggrieved by the professional malpractice of a guardian 2 | |
28 | 28 | ad litem appointed in a family relations matter, may bring a civil action 3 | |
29 | 29 | seeking appropriate relief, including equitable relief, damages or both 4 | |
30 | 30 | in the superior court for the judicial district in which such guardian ad 5 | |
31 | 31 | litem was appointed, and (2) a guardian ad litem named as a defendant 6 | |
32 | 32 | in a professional malpractice action shall not be entitled to raise a 7 | |
33 | 33 | defense of qualified or absolute immunity in such action. 8 | |
34 | 34 | Statement of Purpose: | |
35 | 35 | To: (1) Ensure that parents, guardians and others aggrieved by the | |
36 | 36 | professional malpractice of a guardian ad litem appointed in a family | |
37 | 37 | relations matter have the ability to bring a civil malpractice action | |
38 | 38 | against such guardian ad litem, and (2) abolish qualified or absolute | |
39 | 39 | immunity as a defense that may be raised by a guardian ad litem in a | |
40 | 40 | professional malpractice action. |
