AN ACT PROTECTING A MORTGAGOR FROM AN UNREASONABLE INVASION OF HIS OR HER PRIVACY BY A MORTGAGE HOLDER. Be it enacted by the Senate and House of Representatives in General Assembly convened: That the general statutes be amended to prohibit: (1) An owner or 1 servicer of a debt secured by a first mortgage on a one-to-four-family 2 residential dwelling from entering the secured property without 3 permission or a court order; and (2) a mortgagee from requiring, as a 4 condition for obtaining a residential real property loan, a mortgagor to 5 give it or its assignee the right to enter the property without permission 6 or a court order. 7 Statement of Purpose: To ensure that a mortgagee does not enter upon the residential real property that is the subject of the mortgage without the permission of the owner, occupant or mortgagor or an order of a court.
