AN ACT CONCERNING WORKERS' COMPENSATION INSURANCE 
AND EXCLUDING FROM AN EMPLOYER’S TRADE OR BUSINESS 
CONTRACTED WORK THAT IS SPECIALIZED AND IS NOT 
REGULARLY AND ROUTINELY UNDERTAKEN BY THE EMPLOYER’S 
EMPLOYEES. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
That section 31-291 of the general statutes be amended to specify that 1 
when any principal employer procures any work to be done wholly or 2 
in part for him by a contractor, or through him by a subcontractor, and 3 
the work so procured to be done is a part or process in the trade or 4 
business of such principal employer, and is performed in, on or about 5 
premises under his control, such principal employer shall be liable to 6 
pay all compensation under this chapter to the same extent as if the 7 
work were done without the intervention of such contractor or 8 
subcontractor. Specifically excluded from the employer's trade or 9 
business is contracted work that is specialized and is not regularly and 10 
routinely undertaken by the employer's employees. The provisions of 11 
said section shall not extend immunity to any principal employer from 12 
a civil action brought by an injured employee or his dependent under 13  Proposed Bill No.  5943

the provisions of section 31-293 of the general statutes to recover 14 
damages resulting from personal injury or wrongful death occurring on 15 
or after May 28, 1988, unless such principal employer has paid 16 
compensation benefits under this chapter to such injured employee or 17 
his dependent for the injury or death which is the subject of the action.18 
Statement of Purpose:   
 To amend section 31-291 of the general statutes to specifically exclude 
from an employer's trade or business contracted work that is specialized 
and is not regularly and routinely undertaken by the employer's 
employees.
