AN ACT CONCERNING OPEN SPACE PRESERVATION IN CLUSTER
DEVELOPMENTS.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
That title 8 of the general statutes be amended to prohibit the 1
developer of a cluster development from including existing wetland 2
and watercourse areas located in a proposed development in the 3
calculation of open space percentage allocation for the purpose of 4
determining eligibility for certain incentives. 5
Statement of Purpose:
To prohibit the developer of a cluster development from including
existing wetland and watercourse areas located in a proposed
development in the calculation of open space percentage allocation for
the purpose of determining eligibility for certain incentives.
