20	20		AN ACT CONCERNING TH E ALBERT J. SOLNIT CHILDREN'S
21	21		CENTER.
22	22		Be it enacted by the Senate and House of Representatives in General
23	23		Assembly convened:

25	25		Section 1. Subsection (a) of section 19a-490 of the general statutes is 1
26	26		repealed and the following is substituted in lieu thereof (Effective April 2
27	27		1, 2022): 3
28	28		(a) "Institution" means a hospital, short-term hospital special hospice, 4
29	29		hospice inpatient facility, residential care home, nursing home facility, 5
30	30		home health care agency, home health aide agency, behavioral health 6
31	31		facility, assisted living services agency, substance abuse treatment 7
32	32		facility, outpatient surgical facility, outpatient clinic, an infirmary 8
33	33		operated by an educational institution for the care of students enrolled 9
34	34		in, and faculty and employees of, such institution; a facility engaged in 10
35	35		providing services for the prevention, diagnosis, treatment or care of 11
36	36		human health conditions, including facilities operated and maintained 12
37	37		by any state agency; and a residential facility for persons with 13
38	38		intellectual disability licensed pursuant to section 17a-227 and certified 14
39	39		to participate in the Title XIX Medicaid program as an intermediate care 15 Raised Bill No. 6109

46	45		facility for individuals with intellectual disability. "Institution" does not 16
47	46		include any facility for the care and treatment of persons with mental 17
48	47		illness or substance use disorder operated or maintained by any state 18
49	48		agency, except Whiting Forensic Hospital and the hospital and 19
50	49		psychiatric residential treatment facility units of the Albert J. Solnit 20
51	50		Children's Center; 21
52	51		Sec. 2. Section 19a-490 of the general statutes is amended by adding 22
53	52		subsection (q) as follows (Effective April 1, 2022): 23
54	53		(NEW) (q) "Psychiatric residential treatment facility" means a 24
55	54		nonhospital facility with a provider agreement with the Department of 25
56	55		Social Services to provide inpatient services to Medicaid-eligible 26
57	56		individuals under the age of twenty-one. 27
58	57		Sec. 3. (NEW) (Effective from passage) (a) The Commissioner of Public 28
59	58		Health shall adopt regulations, in accordance with the provisions of 29
60	59		chapter 54 of the general statutes, concerning licensure by the 30
61	60		Department of Public Health of the psychiatric residential treatment 31
62	61		facilities, as defined in subsection (q) of section 19a-490 of the general 32
63	62		statutes, as amended by this act, at the Albert J. Solnit Children's Center. 33
64	63		(b) The commissioner may implement policies and procedures 34
65	64		concerning the licensure of the psychiatric residential treatment 35
66	65		facilities of the Albert J. Solnit Children's Center while in the process of 36
67	66		adopting regulations pursuant to subsection (a) of this section, provided 37
68	67		(1) notice of intent to adopt regulations is published on the eRegulations 38
69	68		System not later than twenty days after the date of implementation of 39
70	69		such policies and procedures, and (2) such policies and procedures are 40
71	70		consistent with the proposed regulations. Any policies and procedures 41
72	71		implemented under this subsection shall be valid until the time final 42
73	72		regulations are adopted. 43
74	73		This act shall take effect as follows and shall amend the following
