2020 AN ACT CONCERNING TH E ALBERT J. SOLNIT CHILDREN'S

2222 Be it enacted by the Senate and House of Representatives in General
2323 Assembly convened:

2525 Section 1. Subsection (a) of section 19a-490 of the general statutes is 1
2626 repealed and the following is substituted in lieu thereof (Effective April 2
2727 1, 2022): 3
2828 (a) "Institution" means a hospital, short-term hospital special hospice, 4
2929 hospice inpatient facility, residential care home, nursing home facility, 5
3030 home health care agency, home health aide agency, behavioral health 6
3131 facility, assisted living services agency, substance abuse treatment 7
3232 facility, outpatient surgical facility, outpatient clinic, an infirmary 8
3333 operated by an educational institution for the care of students enrolled 9
3434 in, and faculty and employees of, such institution; a facility engaged in 10
3535 providing services for the prevention, diagnosis, treatment or care of 11
3636 human health conditions, including facilities operated and maintained 12
3737 by any state agency; and a residential facility for persons with 13
3838 intellectual disability licensed pursuant to section 17a-227 and certified 14
3939 to participate in the Title XIX Medicaid program as an intermediate care 15 Raised Bill No. 6109

4645 facility for individuals with intellectual disability. "Institution" does not 16
4746 include any facility for the care and treatment of persons with mental 17
4847 illness or substance use disorder operated or maintained by any state 18
4948 agency, except Whiting Forensic Hospital and the hospital and 19
5049 psychiatric residential treatment facility units of the Albert J. Solnit 20
5150 Children's Center; 21
5251 Sec. 2. Section 19a-490 of the general statutes is amended by adding 22
5352 subsection (q) as follows (Effective April 1, 2022): 23
5453 (NEW) (q) "Psychiatric residential treatment facility" means a 24
5554 nonhospital facility with a provider agreement with the Department of 25
5655 Social Services to provide inpatient services to Medicaid-eligible 26
5756 individuals under the age of twenty-one. 27
5857 Sec. 3. (NEW) (Effective from passage) (a) The Commissioner of Public 28
5958 Health shall adopt regulations, in accordance with the provisions of 29
6059 chapter 54 of the general statutes, concerning licensure by the 30
6160 Department of Public Health of the psychiatric residential treatment 31
6261 facilities, as defined in subsection (q) of section 19a-490 of the general 32
6362 statutes, as amended by this act, at the Albert J. Solnit Children's Center. 33
6463 (b) The commissioner may implement policies and procedures 34
6564 concerning the licensure of the psychiatric residential treatment 35
6665 facilities of the Albert J. Solnit Children's Center while in the process of 36
6766 adopting regulations pursuant to subsection (a) of this section, provided 37
6867 (1) notice of intent to adopt regulations is published on the eRegulations 38
6968 System not later than twenty days after the date of implementation of 39
7069 such policies and procedures, and (2) such policies and procedures are 40
7170 consistent with the proposed regulations. Any policies and procedures 41
7271 implemented under this subsection shall be valid until the time final 42
7372 regulations are adopted. 43
7473 This act shall take effect as follows and shall amend the following
