AN ACT CONCERNING MUNICIPAL BINDING ARBITRATION. Be it enacted by the Senate and House of Representatives in General Assembly convened: That chapter 113 of the general statutes be amended to provide that 1 (1) if the parties to an arbitration cannot agree on a neutral arbitrator, 2 either side may petition the Superior Court to appoint a state referee as 3 the neutral arbitrator; (2) all arbitration hearings shall be open to the 4 public and documents submitted during such arbitration shall be public 5 records; (3) a municipality's ability to pay employee compensation from 6 ongoing revenues without reducing municipal services shall be the 7 primary factor for consideration by an arbitration board; and (4) an 8 arbitration board shall not approve an award that would (A) increase 9 the projected cost of employee compensation at a rate that is greater than 10 the five-year average increase of sales and property taxes, (B) 11 retroactively increase or decrease employee compensation other than 12 base wages for service already rendered, (C) create a new unfunded 13 liability for the municipality, or (D) interfere with the discretion of 14 municipal police or fire chiefs to make operational or staffing decisions. 15 Proposed Bill No. 6281 LCO No. 1931 2 of 2 Statement of Purpose: To reform the process of municipal binding arbitration.
