AN ACT CONCERNING MA TERNAL CHOICE IN THE EVENT OF 
STILLBIRTH.  
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. (NEW) (Effective July 1, 2021) (a) As used in this section, 1 
"stillborn fetus" means a fetus that died after a gestation period of 2 
twenty weeks or more. 3 
(b) Any mother of a stillborn fetus shall have the right to arrange for 4 
burial or cremation of the fetus in accordance with this subsection. 5 
When practicable, upon admission to a hospital in which a mother is 6 
expected to deliver a stillborn fetus, the hospital shall notify the mother 7 
in writing of her right to arrange for such burial or cremation. If 8 
notification upon admission is not practicable, or the mother was not 9 
expected to deliver a stillborn fetus at the time of admission, such 10 
notification shall be made not later than twenty-four hours after 11 
admission. Any mother who wishes to arrange for burial or cremation 12 
of a fetus shall elect to arrange for such burial or cremation in writing. 13 
Such writing shall be delivered to the hospital not later than seventy-14 
two hours after the mother's discharge from the hospital. If a mother 15 
does not elect to arrange for such burial or cremation, the mother may 16 
elect to be notified by the hospital of the manner of the final disposition 17 
of the remains of the stillborn fetus. The Department of Public Health 18  Substitute Bill No. 6507

shall prescribe the forms to be used for notifications and elections under 19 
this subsection.20 
This act shall take effect as follows and shall amend the following 
sections:
