1818 AN ACT CONCERNING HEALTH COVERAGE FOR OUTPATIENT
1919 PSYCHOTROPIC DRUGS.
2020 Be it enacted by the Senate and House of Representatives in General
2121 Assembly convened:

2323 That title 38a of the general statutes be amended to provide that no 1
2424 health insurance policy providing coverage for outpatient prescription 2
2525 drugs, or mental health care benefits provided under state law, with 3
2626 state funds or to state employees, shall: (1) Require a prescribing health 4
2727 care provider to prescribe an outpatient psychotropic drug in a quantity 5
2828 that the provider deems clinically inappropriate; or (2) if a prescribing 6
2929 health care provider deems a ninety-day supply of a covered outpatient 7
3030 psychotropic drug to be clinically inappropriate, impose a coinsurance, 8
3131 copayment, deductible or other out-of-pocket expense for the prescribed 9
3232 supply of such drug in an amount that exceeds the amount of the 10
3333 coinsurance, copayment, deductible or other out-of-pocket expense for 11
3434 a ninety-day supply of such drug reduced pro rata according to the 12

4040 Statement of Purpose:
4141 To prohibit health insurance policies providing coverage for outpatient
4242 prescription drugs, and mental health care benefits provided under
4343 state law, with state funds or to state employees, from: (1) Requiring a
4444 prescribing health care provider to prescribe an outpatient psychotropic
4545 drug in a quantity that the provider deems clinically inappropriate; or
4646 (2) imposing increased cost-sharing for less than a ninety-day supply of
4747 a covered outpatient psychotropic drug if a prescribing health care
4848 provider deems a ninety-day supply of such drug to be clinically
4949 inappropriate.
