2020 AN ACT CONCERNING EN ERGY EFFICIENCY STAN DARDS.

2424 Section 1. Section 16a-48 of the general statutes is repealed and the 1
2525 following is substituted in lieu thereof (Effective July 1, 2021): 2
2626 (a) As used in this section: 3
2727 (1) "Department" means the Department of Energy and 4
2828 Environmental Protection; 5
2929 (2) "Fluorescent lamp ballast" or "ballast" means a device designed to 6
3030 operate fluorescent lamps by providing a starting voltage and current 7
3131 and limiting the current during normal operation, but does not include 8
3232 such devices that have a dimming capability or are intended for use in 9
3333 ambient temperatures of zero degrees Fahrenheit or less or have a 10
3434 power factor of less than sixty-one hundredths for a single F40T12 lamp; 11
3535 (3) "F40T12 lamp" means a tubular fluorescent lamp that is a nominal 12
3636 forty-watt lamp, with a forty-eight-inch tube length and one and one-13

4343 (4) "F96T12 lamp" means a tubular fluorescent lamp that is a nominal 15
4444 seventy-five-watt lamp with a ninety-six-inch tube length and one and 16
4545 one-half inches in diameter; 17
4646 (5) "Luminaire" means a complete lighting unit consisting of a 18
4747 fluorescent lamp, or lamps, together with parts designed to distribute 19
4848 the light, to position and protect such lamps, and to connect such lamps 20
4949 to the power supply; 21
5050 (6) "New product" means a product that is sold, offered for sale, or 22
5151 installed for the first time and specifically includes floor models and 23
5252 demonstration units; 24
5353 (7) "Commissioner" means the Commissioner of Energy and 25
5454 Environmental Protection; 26
5555 (8) "State Building Code" means the building code adopted pursuant 27
5656 to section 29-252; 28
5757 (9) "Torchiere lighting fixture" means a portable electric lighting 29
5858 fixture with a reflector bowl giving light directed upward so as to give 30
5959 indirect illumination; 31
6060 (10) "Unit heater" means a self-contained, vented fan-type 32
6161 commercial space heater that uses natural gas or propane and that is 33
6262 designed to be installed without ducts within the heated space. "Unit 34
6363 heater" does not include a product regulated by federal standards 35
6464 pursuant to 42 USC 6291, as amended from time to time, a product that 36
6565 is a direct vent, forced flue heater with a sealed combustion burner, or 37
6666 any oil fired heating system; 38
6767 (11) "Transformer" means a device consisting of two or more coils of 39
6868 insulated wire that transfers alternating current by electromagnetic 40
6969 induction from one coil to another in order to change the original 41
7070 voltage or current value; 42
7171 (12) "Low-voltage dry-type transformer" means a transformer that: 43
7272 (A) Has an input voltage of six hundred volts or less; (B) is between 44 Raised Bill No. 863

7878 fourteen kilovolt-amperes and two thousand five hundred one kilovolt-45
7979 amperes in size; (C) is air-cooled; and (D) does not use oil as a coolant. 46
8080 "Low-voltage dry-type transformer" does not include such transformers 47
8181 excluded from the low-voltage dry-type distribution transformer 48
8282 definition contained in the California Code of Regulations, Title 20: 49
8383 Division 2, Chapter 4, Article 4: Appliance Efficiency Regulations; 50
8484 (13) "Pass-through cabinet" means a refrigerator or freezer with 51
8585 hinged or sliding doors on both the front and rear of the refrigerator or 52
8686 freezer; 53
8787 (14) "Reach-in cabinet" means a refrigerator, freezer, or combination 54
8888 thereof, with hinged or sliding doors or lids; 55
8989 (15) "Roll-in" or "roll-through cabinet" means a refrigerator or freezer 56
9090 with hinged or sliding doors that allows wheeled racks of product to be 57
9191 rolled into or through the refrigerator or freezer; 58
9292 (16) "Commercial refrigerators and freezers" means reach-in cabinets, 59
9393 pass-through cabinets, roll-in cabinets and roll-through cabinets that 60
9494 have less than eighty-five feet of capacity, which are designed for the 61
9595 refrigerated or frozen storage of food and food products; 62
9696 (17) "Traffic signal module" means a standard eight-inch or twelve-63
9797 inch round traffic signal indicator consisting of a light source, lens and 64
9898 all parts necessary for operation and communication of movement 65
9999 messages to drivers through red, amber and green colors; 66
100100 (18) "Illuminated exit sign" means an internally illuminated sign that 67
101101 is designed to be permanently fixed in place and used to identify an exit 68
102102 by means of a light source that illuminates the sign or letters from within 69
103103 where the background of the exit sign is not transparent; 70
104104 (19) "Packaged air-conditioning equipment" means air-conditioning 71
105105 equipment that is built as a package and shipped as a whole to end-user 72

115115 (21) "Commercial clothes washer" means a soft mount front-loading 77
116116 or soft mount top-loading clothes washer that is designed for use in (A) 78
117117 applications where the occupants of more than one household will be 79
118118 using it, such as in multifamily housing common areas and coin 80
119119 laundries; or (B) other commercial applications, if the clothes container 81
120120 compartment is no greater than three and one-half cubic feet for 82
121121 horizontal-axis clothes washers or no greater than four cubic feet for 83
122122 vertical-axis clothes washers; 84
123123 (22) "Energy efficiency ratio" means a measure of the relative 85
124124 efficiency of a heating or cooling appliance that is equal to the unit's 86
125125 output in BTUs per hour divided by its consumption of energy, 87
126126 measured in watts; 88
127127 (23) "Electricity ratio" means the ratio of furnace electricity use to total 89
128128 furnace energy use; 90
129129 (24) "Boiler" means a space heater that is a self-contained appliance 91
130130 for supplying steam or hot water primarily intended for space-heating. 92
131131 "Boiler" does not include hot water supply boilers; 93
132132 (25) "Central furnace" means a self-contained space heater designed 94
133133 to supply heated air through ducts of more than ten inches in length; 95
134134 (26) "Residential furnace or boiler" means a product that utilizes only 96
135135 single-phase electric current or single-phase electric current or DC 97
136136 current in conjunction with natural gas, propane or home heating oil 98
137137 and that (A) is designed to be the principal heating source for the living 99
138138 space of a residence; (B) is not contained within the same cabinet as a 100
139139 central air conditioner with a rated cooling capacity of not less than 101
140140 sixty-five thousand BTUs per hour; (C) is an electric central furnace, 102
141141 electric boiler, forced-air central furnace, gravity central furnace or low 103
142142 pressure steam or hot water boiler; and (D) has a heat input rate of less 104
143143 than three hundred thousand BTUs per hour for an electric boiler and 105 Raised Bill No. 863

152152 (27) "Furnace air handler" means the section of the furnace that 109
153153 includes the fan, blower and housing, generally upstream of the burners 110
154154 and heat exchanger. The furnace air handler may include a filter and a 111

156156 (28) "High-intensity discharge lamp" means a lamp in which light is 113
157157 produced by the passage of an electric current through a vapor or gas, 114
158158 the light-producing arc is stabilized by bulb wall temperature and the 115
159159 arc tube has a bulb wall loading in excess of three watts per square 116

161161 (29) "Metal halide lamp" means a high intensity discharge lamp in 118
162162 which the major portion of the light is produced by radiation of metal 119
163163 halides and their products of dissociation, possibly in combination with 120

165165 (30) "Metal halide lamp fixture" means a light fixture designed to be 122
166166 operated with a metal halide lamp and a ballast for a metal halide lamp; 123
167167 (31) "Probe start metal halide ballast" means a ballast used to operate 124
168168 metal halide lamps that does not contain an ignitor and that instead 125
169169 starts lamps by using a third starting electrode probe in the arc tube; 126
170170 (32) "Single voltage external AC to DC power supply" means a device 127
171171 that (A) is designed to convert line voltage AC input into lower voltage 128
172172 DC output; (B) is able to convert to only one DC output voltage at a time; 129
173173 (C) is sold with, or intended to be used with, a separate end use product 130
174174 that constitutes the primary power load; (D) is contained within a 131
175175 separate physical enclosure from the end use product; (E) is connected 132
176176 to the end use product in a removable or hard-wired male and female 133
177177 electrical connection, cable, cord or other wiring; (F) does not have 134
178178 batteries or battery packs, including those that are removable or that 135

189189 (33) "State regulated incandescent reflector lamp" means a lamp that 141
190190 is not colored or designed for rough or vibration service applications, 142
191191 has an inner reflective coating on the outer bulb to direct the light, has 143
192192 an E26 medium screw base, a rated voltage or voltage range that lies at 144
193193 least partially within one hundred fifteen to one hundred thirty volts, 145
194194 and that falls into one of the following categories: (A) A bulged reflector 146
195195 or elliptical reflector or a blown PAR bulb shape and that has a diameter 147
196196 that equals or exceeds two and one-quarter inches, or (B) a reflector, 148
197197 parabolic aluminized reflector, bulged reflector or similar bulb shape 149
198198 and that has a diameter of two and one-quarter to two and three-150
199199 quarters inches. "State regulated incandescent reflector lamp" does not 151
200200 include ER30, BR30, BR40 and ER40 lamps of not more than fifty watts, 152
201201 BR30, BR40 and ER40 lamps of sixty-five watts and R20 lamps of not 153

203203 (34) "Bottle-type water dispenser" means a water dispenser that uses 155
204204 a bottle or reservoir as the source of potable water; 156
205205 (35) "Commercial hot food holding cabinet" means a heated, fully-157
206206 enclosed compartment with one or more solid or [partial glass] 158
207207 transparent doors that is designed to maintain the temperature of hot 159
208208 food that has been cooked [in] using a separate appliance. "Commercial 160
209209 hot food holding cabinet" does not include heated glass merchandizing 161
210210 cabinets, drawer warmers or cook-and-hold appliances; 162
211211 (36) "Pool heater" means an appliance designed for heating 163
212212 nonpotable water contained at atmospheric pressure for swimming 164
213213 pools, spas, hot tubs and similar applications, including natural gas, 165
214214 heat pump, oil and electric resistance pool heaters; 166
215215 (37) "Portable electric spa" means a factory-built electric spa or hot 167

224224 (38) "Residential pool pump" means a pump used to circulate and 171
225225 filter pool water to maintain clarity and sanitation; 172
226226 (39) "Walk-in refrigerator" means a space refrigerated to 173
227227 temperatures at or above thirty-two degrees Fahrenheit that has a total 174
228228 chilled storage area of less than three thousand square feet, can be 175
229229 walked into and is designed for the refrigerated storage of food and food 176
230230 products. "Walk-in refrigerator" does not include refrigerated 177
231231 warehouses and products designed and marketed exclusively for 178
232232 medical, scientific or research purposes; 179
233233 (40) "Walk-in freezer" means a space refrigerated to temperatures 180
234234 below thirty-two degrees Fahrenheit that has a total chilled storage area 181
235235 of less than three thousand square feet, can be walked into and is 182
236236 designed for the frozen storage of food and food products. "Walk-in 183
237237 freezer" does not include refrigerated warehouses and products 184
238238 designed and marketed exclusively for medical, scientific or research 185
239239 purposes; 186
240240 (41) "Central air conditioner" means a central air conditioning model 187
241241 that consists of one or more factory-made assemblies, which normally 188
242242 include an evaporator or cooling coil, compressor and condenser. 189
243243 Central air conditioning models may provide the function of air cooling, 190
244244 air cleaning, dehumidifying or humidifying; 191
245245 (42) "Combination television" means a system in which a television 192
246246 or television monitor and an additional device or devices, including, but 193
247247 not limited to, a digital versatile disc player or video cassette recorder, 194
248248 are combined into a single unit in which the additional devices are 195
249249 included in the television casing; 196
250250 [(43) "Compact audio player" means an integrated audio system 197
251251 encased in a single housing that includes an amplifier and radio tuner 198

268268 designed primarily for the display of computer generated signals and 210
269269 that is not marketed for use as a television; 211
270270 [(46)] (45) "Digital versatile disc" means a laser-encoded plastic 212
271271 medium capable of storing a large amount of digital audio, video and 213

273273 [(47)] (46) "Digital versatile disc player" means a commercially 215
274274 available electronic product encased in a single housing that includes an 216
275275 integral power supply and for which the sole purpose is the decoding 217

277277 [(48) "Digital versatile disc recorder" means a commercially available 219
278278 electronic product encased in a single housing that includes an integral 220
279279 power supply and for which the sole purpose is the production or 221
280280 recording of digitized audio, video and computer signals on a digital 222
281281 versatile disc. "Digital versatile disc recorder" does not include a model 223

283283 [(49)] (47) "Television" means an analog or digital device designed 225
284284 primarily for the display and reception of a terrestrial, satellite, cable, 226

305305 (51) "Industrial air purifier" means an indoor air cleaning device 242
306306 manufactured, advertised, marketed, labeled and used solely for 243
307307 industrial use that is marketed solely through industrial supply outlets 244
308308 or businesses and prominently labeled as "Solely for industrial use. 245
309309 Potential health hazard: emits ozone."; 246
310310 (52) "Cold temperature fluorescent lamp" means a fluorescent lamp 247
311311 that is not a compact fluorescent lamp that (A) is specifically designed 248
312312 to start at -20ËšF when used with a ballast conforming to the requirements 249
313313 of ANSI C78.81 and ANSI C78.901; and (B) is expressly designated as a 250
314314 cold temperature lamp both in markings on the lamp and in marketing 251
315315 materials, including, but not limited to, catalogs, sales literature and 252
316316 promotional material; 253
317317 (53) "Commercial dishwasher" means a machine designed to clean 254
318318 and sanitize plates, pots, pans, glasses, cups, bowls, utensils and trays 255
319319 by applying sprays of detergent solution, with or without blasting 256
320320 media granules, and a sanitizing rinse; 257
321321 (54) "Commercial steam cooker" or "compartment steamer" means a 258
322322 device with one or more food-steaming compartments in which the 259

332332 (55) "Compensation" means money or any other valuable thing, 264
333333 regardless of form, received or to be received by a person for services 265

335335 (56) "Electric vehicle supply equipment" means conductors, 267
336336 including ungrounded, grounded and equipment grounding 268
337337 conductors, electric vehicle connectors, attachment plugs and all other 269
338338 fittings, devices, power outlets or apparatuses installed specifically for 270
339339 the purpose of delivering energy from the premises wiring to the electric 271
340340 vehicle. "Electric vehicle supply equipment" includes charging cords 272

342342 supply equipment" does not include conductors, connectors and fittings 274

344344 (57) "General service lamp" means a lamp that: (A) Has an American 276
345345 National Standards Institute base; (B) is able to operate at a voltage of 277
346346 twelve volts or twenty-four volts, at or between one hundred to one 278
347347 hundred thirty volts, at or between two hundred twenty to two hundred 279
348348 forty volts, or of two hundred seventy-seven volts for integrated lamps, 280
349349 or is able to operate at any voltage for nonintegrated lamps; (C) has an 281
350350 initial lumen output of greater than or equal to three hundred ten 282
351351 lumens, or two hundred thirty-two lumens for modified spectrum 283
352352 general service incandescent lamps, and less than or equal to three 284
353353 thousand three hundred lumens; (D) is not a light fixture; (E) is not an 285
354354 LED downlight retrofit kit; and (F) is used in general lighting 286
355355 applications. "General service lamps" include, but are not limited to, 287
356356 general service incandescent lamps, compact fluorescent lamps, general 288
357357 service light-emitting diode lamps and general service organic light-289
358358 emitting diode lamps. "General service lamps" do not include: (i) 290
359359 Appliance lamps; (ii) black light lamps; (iii) bug lamps; (iv) colored 291
360360 lamps; (v) G shape lamps with a diameter of five inches or more as 292

382382 less than or equal to 12.5 and a diameter less than or equal to 1.5625 309

384384 (xxi) sign service lamps; (xxii) silver bowl lamps; (xxiii) showcase lamps; 311
385385 (xxiv) specialty MR lamps; (xxv) T shape lamps that have a first number 312
386386 symbol less than or equal to eight and a diameter less than or equal to 313
387387 one inch as defined in American National Standards Institute C79.1–314
388388 2002, have nominal overall length less than twelve inches and are not 315
389389 compact fluorescent lamps; and (xxvi) traffic signal lamps; 316
390390 (58) "High color rendering index fluorescent lamp" means a 317
391391 fluorescent lamp with a color rendering index of eighty-seven or greater 318
392392 that is not a compact fluorescent lamp; 319
393393 (59) "Impact-resistant fluorescent lamp" means a fluorescent lamp 320
394394 that is not a compact fluorescent lamp that (A) has a coating or 321
395395 equivalent technology that is in compliance with NSF/ANSI 51 and is 322
396396 designed to contain the glass if the glass envelope of the lamp is broken; 323
397397 and (B) is designated and marketed for the intended application, with 324
398398 the designation on the lamp packaging and marketing materials that 325
399399 identify the lamp as being impact-resistant, shatter-resistant, shatter-326

406406 (60) "Faucet" means a lavatory faucet, kitchen faucet, metering faucet, 328
407407 public lavatory faucet or replacement aerator for a lavatory, public 329

409409 (61) "Public lavatory faucet" means a fitting intended to be installed 331
410410 in nonresidential bathrooms that are exposed to walk-in traffic; 332
411411 (62) "Metering faucet" means a fitting that, when turned on, will 333
412412 gradually shut itself off over a period of several seconds; 334
413413 (63) "Replacement aerator" means an aerator sold as a replacement, 335
414414 separate from the faucet to which it is intended to be attached; 336
415415 (64) "Plumbing fixture" means an exchangeable device that connects 337
416416 to a plumbing system to deliver and drain away water and waste; 338
417417 (65) "Urinal" means a plumbing fixture that receives only liquid body 339
418418 waste and conveys the waste through a trap into a drainage system; 340
419419 (66) "Water closet" means a plumbing fixture having a water-341
420420 containing receptor that receives liquid and solid body waste through 342
421421 an exposed integral trap into a drainage system; 343
422422 (67) "Dual-flush effective flush volume" means the average flush 344
423423 volume of two reduced flushes and one full flush; 345
424424 (68) "Dual-flush water closet" means a water closet incorporating a 346
425425 feature that allows the user to flush the water closet with either a 347
426426 reduced or a full volume of water; 348
427427 (69) "Trough-type urinal" means a urinal designed for simultaneous 349
428428 use by two or more persons; 350
429429 (70) "Residential ventilating fan" means a ceiling, wall-mounted or 351
430430 remotely mounted in-line fan designed to be used in a bathroom or 352
431431 utility room, whose purpose is to move air from inside the building to 353

448448 energy to cool or heat potable water; 365
449449 (75) "Cold only unit water cooler" means a water cooler that dispenses 366

451451 (76) "Hot and cold unit water cooler" means a water cooler that 368
452452 dispenses both hot and cold water and may dispense room-temperature 369
453453 water; 370
454454 (77) "Cook and cold unit water cooler" means a water cooler that 371
455455 dispenses both cold and room-temperature water; 372
456456 (78) "Storage-type water cooler" means a water cooler where 373
457457 thermally conditioned water is stored in a tank in the water cooler and 374
458458 is available instantaneously, including, but not limited to, point-of-use, 375
459459 dry storage compartment and bottled water coolers; 376
460460 (79) "On demand water cooler" means a water cooler that heats water 377
461461 as it is requested and typically takes a few minutes to deliver. 378
462462 (b) The provisions of this subsection and subsections (c) to (h), 379
463463 inclusive, of this section apply to the testing, certification and 380
464464 enforcement of efficiency standards for the following types of new 381
465465 products sold, offered for sale or installed in the state: (1) [Commercial 382
466466 clothes washers; (2) commercial] Commercial refrigerators and freezers; 383

485485 (c) The provisions of subsections (b) to (h), inclusive, of this section 397
486486 do not apply to (1) new products manufactured in the state and sold 398
487487 outside the state, (2) new products manufactured outside the state and 399
488488 sold at wholesale inside the state for final retail sale and installation 400
489489 outside the state, (3) products installed in mobile manufactured homes 401
490490 at the time of construction, or (4) products designed expressly for 402
491491 installation and use in recreational vehicles. 403
492492 (d) (1) The Commissioner of Energy and Environmental Protection 404
493493 [shall] may adopt regulations, in accordance with the provisions of 405
494494 chapter 54, to implement the provisions of subsections (b) to (h), 406
495495 inclusive, of this section and to establish minimum energy efficiency 407
496496 standards for the types of new products set forth in subsection (b) of this 408
497497 section. [The regulations shall provide for] Upon the effective date of 409
498498 this section, the following minimum energy efficiency standards shall 410

500500 (A) Commercial clothes washers shall meet the requirements [shown 412

522522 (E) Large packaged air-conditioning equipment having not less than 429
523523 seven hundred sixty-one thousand BTUs per hour of capacity shall meet 430
524524 a minimum energy efficiency ratio of 9.7 for units using both electric 431
525525 heat and air conditioning or units solely using electric air conditioning, 432
526526 and 9.5 for units using both natural gas heat and electric air 433

528528 (F) Low voltage dry-type distribution transformers shall meet or 435
529529 exceed the energy efficiency values shown in Table 4-2 of the National 436
530530 Electrical Manufacturers Association Standard TP-1-2002; 437
531531 (G) Torchiere lighting fixtures shall not consume more than one 438
532532 hundred ninety watts and shall not be capable of operating with lamps 439
533533 that total more than one hundred ninety watts; 440
534534 (H) Traffic signal modules shall meet the product specification of the 441
535535 "Energy Star Program Requirements for Traffic Signals" developed by 442
536536 the United States Environmental Protection Agency that took effect in 443
537537 February, 2001, except where the department, in consultation with the 444
538538 Commissioner of Transportation, determines that such specification 445
539539 would compromise safe signal operation; 446

553553 fired hot water boilers, eighty-four per cent annual fuel utilization 455
554554 efficiency, (v) for gas and propane steam boilers, eighty-two per cent 456
555555 annual fuel utilization efficiency, (vi) for oil-fired steam boilers, eighty-457
556556 two per cent annual fuel utilization efficiency, and (vii) for furnaces with 458
557557 furnace air handlers, an electricity ratio of not more than 2.0, except air 459
558558 handlers for oil furnaces with a capacity of less than ninety-four 460
559559 thousand BTUs per hour shall have an electricity ratio of 2.3 or less; 461
560560 (K) On or after January 1, 2010, metal halide lamp fixtures designed 462
561561 to be operated with lamps rated greater than or equal to one hundred 463
562562 fifty watts but less than or equal to five hundred watts shall not contain 464
563563 a probe-start metal halide lamp ballast; 465
564564 (L) Single-voltage external AC to DC power supplies manufactured 466
565565 on or after January 1, 2008, shall meet the energy efficiency standards of 467
566566 table U-1 of section 1605.3 of the January 2006 California Code of 468
567567 Regulations, Title 20, Division 2, Chapter 4, Article 4: Appliance 469
568568 Efficiency Regulations. This standard applies to single voltage AC to DC 470
569569 power supplies that are sold individually and to those that are sold as a 471
570570 component of or in conjunction with another product. This standard 472
571571 shall not apply to single-voltage external AC to DC power supplies sold 473
572572 with products subject to certification by the United States Food and 474
573573 Drug Administration. A single-voltage external AC to DC power supply 475
574574 that is made available by a manufacturer directly to a consumer or to a 476
575575 service or repair facility after and separate from the original sale of the 477
576576 product requiring the power supply as a service part or spare part shall 478
577577 not be required to meet the standards in said table U-1 until five years 479

584584 (M) On or after January 1, 2009, state regulated incandescent reflector 481
585585 lamps shall be manufactured to meet the minimum average lamp 482

587587 lamps contained in 42 USC 6295(i)(1)(A). Each lamp shall indicate the 484
588588 date of manufacture; 485
589589 (N) On or after January 1, 2009, [bottle-type water dispensers,] 486
590590 commercial hot food holding cabinets, [portable electric spas,] walk-in 487
591591 refrigerators and walk-in freezers shall meet the efficiency requirements 488
592592 of section 1605.3 of the January 2006 California Code of Regulations, 489
593593 Title 20, Division 2, Chapter 4, Article 4: Appliance Efficiency 490
594594 Regulations. On or after January 1, 2010, residential pool pumps shall 491
595595 meet said efficiency requirements; 492
596596 (O) On or after July 19, 2022, residential pool pumps shall meet 493
597597 federal efficiency requirements specified in the dedicated pool pump 494
598598 rules published by the United States Department of Energy on January 495
599599 18, 2017, and effective on May 18, 2017; 496
600600 [(O)] (P) On or after January 1, [2009] 2022, pool heaters shall meet 497
601601 the efficiency requirements [of sections 1605.1 and 1605.3 of the January 498
602602 2006 California Code of Regulations, Title 20, Division 2, Chapter 4, 499
603603 Article 4: Appliance Efficiency Regulations] established in 10 CFR 430 500
604604 by the United States Department of Energy as of April 16, 2013, for gas-501
605605 fired and oil-fired pool heaters and the Air-conditioning, Heating, and 502
606606 Refrigeration Institute Certification Reference 1160 for electric heat 503
607607 pump pool heaters; 504
608608 [(P) By January 1, 2014, compact audio players, digital versatile disc 505
609609 players and digital versatile disc recorders shall meet the requirements 506
610610 shown in Table V-1 of Section 1605.3 of the November 2009 amendments 507
611611 to the California Code of Regulations, Title 20, Division 2, Chapter 4, 508
612612 Article 4, unless the commissioner, in accordance with subparagraph (B) 509
613613 of subdivision (3) of this subsection, determines that such standards are 510
614614 unwarranted and may accept, reject or modify according to 511

624624 Regulations, Title 20, Division 2, Chapter 4, Article 4, unless the 516
625625 commissioner [, in accordance with subparagraph (B) of subdivision (3) 517
626626 of this subsection,] determines that such standards are unwarranted and 518
627627 may accept, reject or modify according to [subparagraph (A) of] 519
628628 subdivision (3) of this subsection; and 520
629629 (R) In addition to the requirements of subparagraph (Q) of this 521
630630 subdivision, televisions manufactured on or after January 1, 2014, shall 522
631631 meet the efficiency requirements of Sections 1605.3(v)(3)(A), 523
632632 1605.3(v)(3)(B) and 1605.3(v)(3)(C) of the November 2009 amendments 524
633633 to the California Code of Regulations, Title 20, Division 2, Chapter 4, 525
634634 Article 4, unless the commissioner [, in accordance with subparagraph 526
635635 (B) of subdivision (3) of this subsection,] determines that such standards 527
636636 are unwarranted and may accept, reject or modify according to 528
637637 [subparagraph (A) of] subdivision (3) of this subsection. 529
638638 (2) Such efficiency standards, where in conflict with the State 530
639639 Building Code, shall take precedence over the standards contained in 531
640640 the Building Code. Not later than July 1, 2007, and biennially thereafter, 532
641641 the Commissioner of Energy and Environmental Protection [shall] may 533
642642 review and increase the level of such efficiency standards by adopting 534
643643 regulations in accordance with the provisions of chapter 54 upon a 535
644644 determination that increased efficiency standards would serve to 536
645645 promote energy conservation in the state and would be cost-effective for 537
646646 consumers who purchase and use such new products, provided no such 538
647647 increased efficiency standards shall become effective within one year 539
648648 following the adoption of any amended regulations providing for such 540
649649 increased efficiency standards. 541
650650 (3) [(A)] The Commissioner of Energy and Environmental Protection 542
651651 [shall] may adopt regulations, in accordance with the provisions of 543
652652 chapter 54, to designate additional products to be subject to the 544
653653 provisions of subsections (b) to (h), inclusive of this section and to 545 Raised Bill No. 863

659659 establish efficiency standards for such products upon a determination 546
660660 that such efficiency standards [(i)] (A) would serve to promote energy 547
661661 conservation in the state, [(ii)] (B) would be cost-effective for consumers 548
662662 who purchase and use such new products, and [(iii)] (C) would not 549
663663 impose an unreasonable burden on Connecticut businesses. 550
664664 [(B) The Commissioner of Energy and Environmental Protection, in 551
665665 consultation with the Multi-State Appliance Standards Collaborative, 552
666666 shall identify additional appliance and equipment efficiency standards. 553
667667 The commissioner shall review all California standards and may review 554
668668 standards from other states in such collaborative. The commissioner 555
669669 shall issue notice of such review in the Connecticut Law Journal, allow 556
670670 for public comment and may hold a public hearing within six months of 557
671671 adoption of an efficiency standard by a cooperative member state 558
672672 regarding a product for which no equivalent Connecticut or federal 559
673673 standard currently exists. The commissioner shall adopt regulations in 560
674674 accordance with the provisions of chapter 54 adopting such efficiency 561
675675 standard unless the commissioner makes a specific finding that such 562
676676 standard does not meet the criteria in subparagraph (A) of this 563
677677 subdivision.] 564
678678 (e) On or after July 1, 2006, except for [commercial clothes washers, 565
679679 for which the date shall be July 1, 2007,] commercial refrigerators and 566
680680 freezers, for which the date shall be July 1, 2008, and large packaged air-567
681681 conditioning equipment, for which the date shall be July 1, 2009, no new 568
682682 product of a type set forth in subsection (b) of this section or designated 569
683683 by the Commissioner of Energy and Environmental Protection may be 570
684684 sold, offered for sale, or installed in the state unless the energy efficiency 571
685685 of the new product meets or exceeds the efficiency standards set forth 572
686686 in such regulations adopted pursuant to subsection (d) of this section. 573
687687 (f) The Commissioner of Energy and Environmental Protection shall 574
688688 adopt procedures for testing the energy efficiency of the new products 575
689689 set forth in subsection (b) of this section or designated by the 576
690690 commissioner if such procedures are not provided for in the State 577
691691 Building Code. The commissioner shall use United States Department 578 Raised Bill No. 863

697697 of Energy approved test methods, or in the absence of such test 579
698698 methods, other appropriate nationally recognized test methods. The 580
699699 manufacturers of such products shall cause samples of such products to 581
700700 be tested in accordance with the test procedures adopted pursuant to 582
701701 this subsection or those specified in the State Building Code. 583
702702 (g) Manufacturers of any new products set forth in [subsection (b)] 584
703703 subsections (b) and (i) of this section for which (1) no efficiency 585
704704 standards exist in California, and (2) the [Commissioner of Energy and 586
705705 Environmental Protection] state of Connecticut adopts efficiency 587
706706 standards, shall certify to the [commissioner] Commissioner of Energy 588
707707 and Environmental Protection that such products are in compliance 589
708708 with the provisions of this section, except that certification is not 590
709709 required for single voltage external AC to DC power supplies and walk-591
710710 in refrigerators and walk-in freezers. All single voltage external AC to 592
711711 DC power supplies shall be labeled as described in the January 2006 593
712712 California Code of Regulations, Title 20, Section 1607(9). The 594
713713 commissioner [shall promulgate] may adopt regulations governing the 595
714714 certification of such products. The commissioner shall publish an 596
715715 annual list of any products set forth in [subsection (b)] subsections (b) 597
716716 and (i) of this section on the department's Internet web site that 598
717717 designates which such products are certified in California and which 599
718718 such products not certified in California have demonstrated compliance 600
719719 with efficiency standards adopted [by the commissioner pursuant to 601
720720 subparagraph (B) of subdivision (3) of subsection (d) of this section] in 602
721721 the state of Connecticut. 603
722722 (h) The Attorney General may institute proceedings to enforce the 604
723723 provisions of subsections (b) to (n), inclusive, of this section. Any person 605
724724 who violates any provision of subsections (b) to (n), inclusive, of this 606
725725 section shall be subject to a civil penalty of not more than two hundred 607
726726 fifty dollars. Each violation of subsections (b) to (n), inclusive, of this 608
727727 section shall constitute a separate offense, and each day that such 609
728728 violation continues shall constitute a separate offense. 610
729729 (i) Notwithstanding subsection (d) of this section, the provisions of 611 Raised Bill No. 863

740740 computers and computer monitors; (6) electrical vehicle supply 617
741741 equipment; (7) faucets; (8) general service lamps; (9) high color 618
742742 rendering index fluorescent lamps; (10) impact-resistant fluorescent 619
743743 lamps; (11) portable electric spas; (12) residential ventilating fans; (13) 620
744744 showerheads; (14) spray sprinkler bodies; (15) urinals; (16) water closets; 621
745745 and (17) water coolers. 622
746746 (j) The provisions of subsections (i) to (n), inclusive, of this section, do 623
747747 not apply to (1) new products manufactured in the state and sold 624
748748 outside the state, (2) new products manufactured outside the state and 625
749749 sold at wholesale inside the state for final retail sale and installation 626
750750 outside the state, (3) products installed in mobile manufactured homes 627
751751 at the time of construction, or (4) products designed expressly for 628
752752 installation and use in recreational vehicles. 629
753753 (k) Notwithstanding subsection (d) of this section, the following 630
754754 minimum energy efficiency standards are established for the types of 631
755755 products set forth in subsection (i) of this section: 632
756756 (1) Air purifiers, except industrial air purifiers, shall meet the 633
757757 following requirements as measured in accordance with the "Energy 634
758758 Star Program Requirements Product Specification for Room Air 635
759759 Cleaners, Version 2.0": (A) Clean air delivery rate (CADR) for smoke 636
760760 shall be 30 or greater; (B) models with a CADR for smoke less than 100, 637
761761 CADR/Watt for smoke shall be greater than or equal to 1.7; (C) models 638
762762 with a CADR for smoke greater than or equal to 100 and less than 150, 639
763763 CADR/Watt for smoke shall be greater than or equal to 1.9; (D) models 640
764764 with a CADR for smoke greater than or equal to 150, CADR/Watt for 641
765765 smoke shall be greater than or equal to 2.0; (E) for ozone-emitting 642
766766 models, measured ozone shall be less than or equal to 50 parts per billion 643

781781 (3) Commercial steam cookers shall meet the requirements of the 653
782782 version 1.2 product specification of the "Energy Star Program 654
783783 Requirements Product Specification for Commercial Steam Cookers" 655
784784 developed by the United States Environmental Protection Agency; 656
785785 (4) Computers and computer monitors shall meet the requirements 657
786786 of subsection (v) of section 1605.3 of the California Code of Regulations, 658
787787 Title 20, Division 2, Chapter 4, Article 4, and compliance with such 659
788788 requirements shall be as measured in accordance with test methods 660
789789 prescribed in subsection (v) of section 1604 of said California regulation. 661
790790 Any regulations adopted by the commissioner pursuant to this 662
791791 subsection shall define "computer" and "computer monitor" to have the 663
792792 same meaning as set forth in subsection (v) of section 1602 of the 664
793793 California Code of Regulations, Title 20, Division 2, Chapter 4, Article 4, 665
794794 provided the commissioner may amend such regulations so that the 666
795795 definitions of "computer" and "computer monitor" and the minimum 667
796796 efficiency standards for computers and computer monitors conform to 668
797797 subsequently adopted versions of the referenced sections of the 669
798798 California Code of Regulations; 670
799799 (5) Electric vehicle supply equipment included in the scope of the 671
800800 version 1.0 "Energy Star Program Requirements Product Specification 672
801801 for Electric Vehicle Supply Equipment" (Rev. Apr-2017), shall meet the 673
802802 qualification criteria of that specification; 674
803803 (6) Faucets, except for metering faucets, shall meet the standards in 675

829829 Rendering Index (CRI), and Correlated Color Temperature (CCT) of 696

890890 to federal preemption. Not more than one hundred eighty days after the 747
891891 effective date of this section, no general service lamp that is not subject 748
892892 to federal preemption may be sold or offered for sale in the state unless 749
893893 the efficiency of the new product meets or exceeds the efficiency 750
894894 standards set forth in subsection (k) of this section. 751
895895 (2) Not later than January 1, 2022, no new portable electric spa or 752
896896 bottle-type water dispenser may be sold or offered for sale, lease or rent 753
897897 in the state unless the efficiency of the new product meets or exceeds 754
898898 any efficiency standards set forth in the regulations of state agencies. 755
899899 (3) On and after January 1, 2022, no new air purifier, cold temperature 756
900900 fluorescent lamp, commercial dishwasher, commercial fryer, 757
901901 commercial hot-food holding cabinet, commercial steam cooker, 758
902902 computer or computer monitor, electric vehicle supply equipment, 759
903903 faucet, impact-resistant fluorescent lamp, portable electric spa, 760
904904 residential ventilating fan, showerhead, spray sprinkler body, urinal, 761
905905 water closet or water cooler may be sold or offered for sale, lease or rent 762
906906 in the state unless the efficiency of the new product meets or exceeds the 763
907907 efficiency standards set forth in subsection (k) of this section. 764
908908 (4) On and after January 1, 2023, no new high color rendering index 765
909909 fluorescent lamp may be sold or offered for sale, lease or rent in the state 766
910910 unless the efficiency of the new product meets or exceeds the efficiency 767
911911 standards set forth in subsection (k) of this section, provided, if, on or 768
912912 after January 1, 2022, the state of California adopts a standards for such 769
913913 new product, the commissioner may adopt regulations, in accordance 770
914914 with the provisions of chapter 54, to implement the efficiency standards 771
915915 set forth in subsection (k) of this section for such new product before 772

922922 (5) One year after the date upon which the sale or offering for sale of 774
923923 certain products becomes subject to the requirements of subdivision (1), 775
924924 (2), (3), (4) or (5) of this subsection, no such products may be installed 776
925925 for compensation in the state unless the efficiency of the new product 777
926926 meets or exceeds the efficiency standards provided in subsection (k) of 778
927927 this section. 779
928928 (m) If any energy or water conservation standards issued or 780
929929 approved for publication on or before January 1, 2018, pursuant to the 781
930930 Energy Policy and Conservation Act 10 CFR 430 to 10 CFR 431 by the 782
931931 Office of the United States Secretary of Energy are withdrawn, repealed 783
932932 or otherwise voided, the minimum energy or water efficiency level 784
933933 permitted for products previously subject to such energy or water 785
934934 conservation standards shall be such previously applicable federal 786
935935 energy or water conservation standards as such standards existed on 787
936936 January 1, 2018, and no new product may be sold or offered for sale, 788
937937 lease or rent in the state unless it meets or exceeds such standards. This 789
938938 subsection shall not apply to any federal energy or water conservation 790
939939 standard set aside by a court upon the petition of a person who will be 791
940940 adversely affected, as provided in 42 USC 6306(b). 792
941941 (n) (1) The commissioner may test products set forth in subsection (i) 793
942942 of this section. If any product tested is found not to be in compliance 794
943943 with the minimum efficiency standards established in subsection (k) of 795
944944 this section, the commissioner shall (A) charge the manufacturer of such 796
945945 product for the cost of the purchase and testing of the product, and (B) 797
946946 make information available to the Attorney General and the public 798
947947 concerning such product. 799
948948 (2) The commissioner may, after giving prior notice and at reasonable 800
949949 and convenient hours, as determined by the commissioner, periodically 801
950950 inspect or cause inspections to be made of distributors and retailers of 802
951951 new products set forth in subsection (i) of this section to determine 803
952952 compliance with the provisions of this subsection and subsections (i) to 804
953953 (m), inclusive, of this section. The commissioner shall coordinate with 805
954954 the State Building Inspector to conduct or cause to be conducted 806 Raised Bill No. 863
