2020 AN ACT CONCERNING THE DISPOSAL OF HOME -GENERATED

2222 Be it enacted by the Senate and House of Representatives in General

2525 Section 1. Section 20-576a of the general statutes is repealed and the 1
2626 following is substituted in lieu thereof (Effective October 1, 2022): 2
2727 [Not later than July 1, 2018, the] The Commissioner of Consumer 3
2828 Protection, with the advice and assistance of the Commission of 4
2929 Pharmacy, shall adopt regulations, in accordance with the provisions of 5
3030 chapter 54, to allow not more than fifty retail locations during the first 6
3131 year and not more than an additional fifty retail locations in each year 7
3232 thereafter, at pharmacies licensed pursuant to chapter 400j, to (1) accept 8
3333 and dispose of unused prescription drugs, and (2) on and after January 9
3434 1, 2024, accept and dispose of home-generated sharps. Such regulations 10
3535 shall: [(1)] (A) Comply with federal law regarding the acceptance and 11
3636 disposal of unused prescription drugs and home-generated sharps at 12
3737 pharmacies, [(2)] (B) establish a tracking and monitoring system and 13
3838 security requirements for such drugs and sharps, and [(3)] (C) specify 14

4545 accepted and stored. The commissioner, after consulting with the 16
4646 Commissioner of Energy and Environmental Protection, shall establish 17
4747 a process in such regulations to ensure the secure removal and 18
4848 destruction of such unused prescription drugs and home-generated 19
4949 sharps, including, but not limited to, allowing for optional prescription 20
5050 drug disposal agreements with law enforcement authorities. As used in 21
5151 this section, "home-generated sharps" means hypodermic needles, pen 22
5252 needles, intravenous needles, lancets and other devices used by 23
5353 individuals in the home to penetrate the skin for the delivery of 24
5454 medications. 25
5555 Sec. 2. (Effective from passage) (a) As used in this section, "home-26
5656 generated sharps" means hypodermic needles, pen needles, intravenous 27
5757 needles, lancets and other devices used by individuals in the home to 28
5858 penetrate the skin for the delivery of medications. 29
5959 (b) The Commissioner of Consumer Protection, in consultation with 30
6060 the Commissioner of Energy and Environmental Protection, shall 31
6161 develop a plan for the establishment of a mail-back program through 32
6262 which residents of the state may safely dispose of home-generated 33
6363 sharps. Not later than January 1, 2023, the Commissioner of Consumer 34
6464 Protection shall report, in accordance with the provisions of section 11-35
6565 4a of the general statutes, regarding such plan and any 36
6666 recommendations for legislative changes necessary to implement such 37
6767 plan to the joint standing committees of the general assembly having 38
6868 cognizance of matters relating to consumer protection and the 39
6969 environment. 40
