20+AN ACT ESTABLISHING A COUNCIL ON MENTAL AND BEHAVIORAL
21+HEALTH PROGRAM OVERSIGHT.
1622 Be it enacted by the Senate and House of Representatives in General
1723 Assembly convened:

1925 Section 1. (NEW) (Effective from passage) (a) There is established a 1
20-Behavioral and Mental Health Policy and Oversight Committee. The 2
21-committee shall evaluate the availability and efficacy of prevention, 3
22-early intervention, and mental health treatment services and options for 4
23-children from birth to age eighteen and make recommendations to the 5
24-General Assembly and executive agencies regarding the governance 6
25-and administration of the mental health care system for children. 7
26-(b) The committee shall consist of the following members: 8
27-(1) The chairpersons and ranking members of the joint standing 9
28-committees of the General Assembly having cognizance of matters 10
29-relating to public health, human services, children and appropriations 11
30-and the budgets of state agencies, or their designees; 12
31-(2) Three appointed by the speaker of the House of Representatives, 13
32-one of whom shall be a member of the General Assembly and two of 14
33-whom shall be providers of mental, emotional or behavioral health 15
34-services for children in the state; 16 Substitute Bill No. 5433
26+Council on Mental and Behavioral Health Program Oversight which 2
27+shall advise the Commissioner of Mental Health and Addiction Services 3
28+on the planning and implementation of the delivery system for mental 4
29+and behavioral health programs and services, including services for the 5
30+treatment of substance use disorder. The council shall monitor planning 6
31+and implementation of matters related to mental and behavioral health 7
32+program initiatives including, but not limited to, (1) eligibility 8
33+standards, (2) benefits, (3) access, (4) quality assurance, and (5) outcome 9
34+measures. 10
35+(b) The council shall be composed of the following members: 11
36+(1) The chairpersons and ranking members of the joint standing 12
37+committees of the General Assembly having cognizance of matters 13
38+relating to public health, human services, children and appropriations 14

41-(3) Three appointed by the president pro tempore of the Senate, one 17
42-of whom shall be a member of the General Assembly and two of whom 18
43-shall be representatives of private advocacy groups that provide 19
44-services for children and families in the state; 20
45-(4) Two appointed by the majority leader of the House of 21
46-Representatives, who shall be representatives of children's hospitals; 22
47-(5) One appointed by the majority leader of the Senate, who shall be 23
48-a representative of public school superintendents in the state; 24
49-(6) Two appointed by the minority leader of the House of 25
50-Representatives, who shall be representatives of families with children 26
51-who have been diagnosed with mental, emotional or behavioral health 27
52-disorders; 28
53-(7) Two appointed by the minority leader of the Senate, who shall be 29
54-providers of mental or behavioral health services; 30
55-(8) The Commissioners of Children and Fam ilies, Correction, 31
56-Developmental Services, Early Childhood, Education, Insurance, 32
57-Mental Health and Addiction Services, Public Health and Social 33
58-Services, or their designees; 34
59-(9) The executive director of the Office of Health Strategy, or the 35
60-executive director's designee; 36
61-(10) The Child Advocate, or the Child Advocate's designee; 37
62-(11) The Healthcare Advocate, or the Healthcare Advocate's 38
63-designee; 39
64-(12) The executive director of the Court Support Services Division of 40
65-the Judicial Branch, or the executive director's designee; 41
66-(13) The executive director of the Commission on Women, Children, 42
67-Seniors, Equity and Opportunity, or the executive director's designee; 43 Substitute Bill No. 5433

45+(2) Five appointed by the speaker of the House of Representatives, 16
46+one of whom shall be a member of the General Assembly, one of whom 17
47+shall be a community provider of adult mental or behavioral health 18
48+services, one of whom shall be a consumer of adult mental or behavioral 19
49+health services or an advocate for such consumers, one of whom shall 20
50+be a representative of a federally qualified health center that provides 21
51+psychiatric services and one of whom shall be a member of the 22
52+Connecticut Hospital Association; 23
53+(3) Five appointed by the president pro tempore of the Senate, one of 24
54+whom shall be a member of the General Assembly, one of whom shall 25
55+be a representative of a nonprofit agency that provides mental and 26
56+behavioral health services, one of whom shall be a representative of a 27
57+for-profit agency that provides mental or behavioral health services, one 28
58+of whom shall be a licensed health care provider of mental or behavioral 29
59+health services and one of whom shall be a licensed alcohol and drug 30
60+counselor; 31
61+(4) Three appointed by the majority leader of the House of 32
62+Representatives, one of whom shall be an advocate for persons with 33
63+substance use disorder, one of whom shall be a family member of a 34
64+person with substance use disorder and one of whom shall be a 35
65+representative of a facility that provides in-patient substance use 36
66+disorder services; 37
67+(5) Three appointed by the majority leader of the Senate, one of whom 38
68+shall be a community provider of mental or behavioral health services 39
69+for children and young adults, one of whom shall be the family member 40
70+of a child or young adult who is a consumer of mental or behavioral 41
71+health services, and one of whom is an advocate for such consumers; 42
72+(6) Three appointed by the minority leader of the House of 43
73+Representatives; 44
74+(7) Three appointed by the minority leader of the Senate; 45
75+(8) The Commissioners of Public Health, Social Services, Children 46 Raised Bill No. 5433

74-(14) The Secretary of the Office of Policy and Management, or the 44
75-secretary's designee; and 45
76-(15) One representative from each administrative services 46
77-organization under contract with the Department of Social Services to 47
78-provide such services for recipients of assistance under the HUSKY 48
79-Health program, who shall be ex-officio nonvoting members. 49
80-(c) Any member of the task force appointed under subdivisions (1) to 50
81-(7), inclusive, of subsection (b) of this section may be a member of the 51
82-General Assembly. 52
83-(d) Any vacancy shall be filled by the appointing authority. 53
84-(e) The Secretary of the Office of Policy and Management, or the 54
85-secretary's designee, and a member of the General Assembly selected 55
86-jointly by the speaker of the House of Representatives and the president 56
87-pro tempore of the Senate from among the members serving pursuant 57
88-to subdivision (1), (2) or (3) of subsection (b) of this section shall be co-58
89-chairpersons of the committee. Such co-chairpersons shall schedule the 59
90-first meeting of the committee, which shall be held not later than sixty 60
91-days after May 4, 2022. 61
92-(f) Members of the committee shall serve without compensation, 62
93-except for necessary expenses incurred in the performance of their 63
94-duties. 64
95-(g) Not later than January 1, 2023 the committee shall report, in 65
96-accordance with section 11-4a of the general statutes, to the joint 66
97-standing committees of the General Assembly having cognizance of 67
98-matters relating to appropriations and the budgets of state agencies, 68
99-public health, human services and children, and the Secretary of the 69
100-Office of Policy and Management, regarding the following: 70
101-(1) Any statutory and budgetary changes needed concerning the 71
102-mental health system of prevention, development and treatment that 72
103-the committee recommends to (A) improve developmental, mental 73 Substitute Bill No. 5433

81+and Families, and Mental Health and Addiction Services, or their 47
82+designees, who shall be ex-officio nonvoting members; 48
83+(9) The Comptroller, or the Comptroller's designee, who shall be an 49
84+ex-officio nonvoting member; and 50
85+(10) The Secretary of the Office of Policy and Management, or the 51
86+secretary's designee, who shall be an ex-officio nonvoting member. 52
87+(c) The council shall choose a chairperson from among its members. 53
88+The Joint Committee on Legislative Management shall provide 54
89+administrative support to such chairperson. 55
90+(d) The council shall monitor and make recommendations 56
91+concerning: (1) Access to quality mental and behavioral health services 57
92+and effective outreach; (2) the sufficiency of providers of mental and 58
93+behavioral health services for adults and children throughout the state; 59
94+(3) the sufficiency of provider rates to maintain service access; (4) 60
95+funding and agency personnel resources to ensure timely access to 61
96+services and effective management of mental and behavioral health 62
97+programs; (5) the linguistic and cultural competency of providers; (6) 63
98+program quality, including outcome measures and continuous quality 64
99+improvement initiatives; (7) timely, accessible and effective consumer 65
100+grievance procedures; and (8) the need for program quality studies 66
101+within the areas identified in this section and the Department of Mental 67
102+Health and Addiction Services' application for available grant funds for 68
103+such studies. 69
104+(e) The Commissioner of Mental Health and Addiction Services shall 70
105+provide monthly reports to the council on the matters described in 71
106+subsection (d) of this section, including, but not limited to, policy 72
107+changes and proposed regulations that affect mental and behavioral 73
108+health services. The commissioner shall also provide the council with 74
109+quarterly financial reports for department expenditures on mental and 75
110+behavioral health services. 76
111+(f) The council shall biannually report on its activities and progress to 77 Raised Bill No. 5433

110-health and behavioral health outcomes for children; (B) improve 74
111-transparency and accountability with respect to state-funded services 75
112-for children and youth with an emphasis on goals identified by the 76
113-committee for community-based programs and facility-based 77
114-interventions; and (C) promote the efficient sharing of information by 78
115-state and state-funded agencies to ensure the regular collection and 79
116-reporting of data regarding children and families' access to, utilization 80
117-of and benefit from services necessary to promote public health and 81
118-mental and behavioral health outcomes for children and youth and their 82
119-families. 83
120-(2) The gaps in services identified by the committee with respect to 84
121-children and families involved in the mental health system, and 85
122-recommendations to address such gaps in services; and 86
123-(3) Strengths and barriers identified by the committee that support or 87
124-impede the mental health needs of children and youth with specific 88
125-recommendations for reforms. 89
126-(4) An examination of the way state agencies can work collaboratively 90
127-through school-based efforts and other processes to improve mental 91
128-health and developmental outcomes for children; 92
129-(5) An examination of disproportionate access and outcomes across 93
130-the mental health care system for children of color; 94
131-(6) An examination of disproportionate access and outcomes across 95
132-the mental health care system for children with developmental 96
133-disabilities; 97
134-(7) A plan to ensure a quality assurance framework for facilities and 98
135-programs that are part of the mental health care system and are operated 99
136-privately or by the state that includes data regarding efficacy and 100
137-outcomes; 101
138-(8) A governance structure for the children's mental health system 102
139-that will best facilitate the public policy and healthcare goals of the state 103 Substitute Bill No. 5433

146-to ensure that all children and families can access high-quality mental 104
147-health care. 105
148-(h) The committee shall complete its duties under this section after 106
149-consultation with one or more organizations that focus on the quality of 107
150-services for children or research related to the well-being of children, 108
151-including, but not limited to, The Child Health and Development 109
152-Institute or Connecticut Voices for Children. The committee may accept 110
153-administrative support and technical and research assistance from any 111
154-such organization. The committee shall work in collaboration with any 112
155-results-first initiative implemented pursuant to any section of the 113
156-general statutes or any public or special act. The committee shall have 114
157-allocated funds to provide staffing support for its work. 115
158-(i) The committee shall be given access to data collected by the state 116
159-on matters related to children's behavioral health from the relevant state 117
160-agencies or directly from contracted administrative service 118
161-organizations, as applicable. 119
162-(j) The committee shall include two or more subcommittees chaired 120
163-by a member of the committee to inform its recommendations. The 121
164-subcommittees may focus on: Workforce-related issues, school-based 122
165-health, prevention, and intermediate or acute care. All subcommittees 123
166-shall examine gaps, reimbursement rates, parity in the outcomes of 124
167-services and the efficacy of services. 125
168-(k) The committee shall establish a time frame for reviewing and 126
169-making follow-up reports on the status or progress of the committee's 127
170-recommendations and activities. Each report submitted by the 128
171-committee pursuant to this subsection shall include specific 129
172-recommendations to improve outcomes related to children's mental, 130
173-emotional or behavioral health and a timeline indicating dates by which 131
174-specific tasks or outcomes should be achieved. 132
175-(l) The committee shall develop a strategic plan that integrates the 133
176-recommendations identified pursuant to subsection (g) of this section. 134 Substitute Bill No. 5433

183-The plan may include short-term, medium-term and long-term goals. In 135
184-developing the plan, the committee shall collaborate with any state 136
185-agency with responsibilities relating to the mental health system. 137
186-(m) Not later than August 1, 2023, the committee shall report, in 138
187-accordance with section 11-4a of the general statutes, such plan together 139
188-with an account of progress made toward the full implementation of 140
189-such plan and any recommendations concerning the implementation of 141
190-identified goals in the plan to the joint standing committees of the 142
191-General Assembly having cognizance of matters relating to 143
192-appropriations and the budgets of state agencies, public health, human 144
193-services and children, and the Secretary of the Office of Policy and 145
194-Management. 146

118+(g) (1) There is established, within the Council on Mental and 79
119+Behavioral Health Program Oversight, a standing subcommittee to 80
120+study and make recommendations to the council on substance use 81
121+disorder programs and services. The subcommittee shall consist of 82
122+council members appointed by the chairpersons of the council and other 83
123+individuals who shall serve for terms prescribed by the cochairpersons 84
124+to advise the council on specific needs of children and adults with 85
125+substance use disorder. For the purposes of completing the report 86
126+required pursuant to this subsection, such individuals shall include, but 87
127+need not be limited to: (A) The Child Advocate, or the Child Advocate's 88
128+designee; (B) a family or child advocate; (C) the executive director of the 89
129+Connecticut Association of Public School Superintendents, or the 90
130+executive director's designee; (D) an expert in the diagnosis, evaluation, 91
131+education and treatment of children and young adults with substance 92
132+use disorder; (E) an expert in the diagnosis, evaluation, education and 93
133+treatment of adults with substance use disorder; and (F) the Healthcare 94
134+Advocate, or the Healthcare Advocate's designee. 95
135+(2) Not later than July 1, 2023, the subcommittee shall submit a report, 96
136+in accordance with section 11-4a of the general statutes to the council, 97
137+the Governor and the joint standing committees of the General 98
138+Assembly having cognizance of matters relating to children, human 99
139+services, public health and appropriations and the budgets of state 100
140+agencies regarding the sufficiency of treatment and services for children 101
141+and adults with substance use disorder. Such report shall include, but 102
142+need not be limited to: (A) Metrics for evaluating the quality of available 103
143+services; (B) statutory changes needed to promote effective service 104
144+delivery; and (C) any other changes needed to address gaps in services 105
145+identified by the subcommittee or council. 106
