LCO No. 3216 1 of 2 General Assembly Raised Bill No. 435 February Session, 2022 LCO No. 3216 Referred to Committee on JUDICIARY Introduced by: (JUD) AN ACT CONCERNING THE PERMISSIBLE RECORDING OF A PRIVATE TELEPHONE CONVERSATION. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Subsection (a) of section 52-570d of the 2022 supplement to 1 the general statutes is repealed and the following is substituted in lieu 2 thereof (Effective from passage): 3 (a) No person shall use any instrument, device or equipment to 4 record an oral private telephonic communication unless the use of such 5 instrument, device or equipment (1) is preceded by consent of [all 6 parties] at least one party to the communication and such prior consent 7 either is obtained in writing or is part of, and obtained at the start of, the 8 recording, or (2) is preceded by verbal notification which is recorded at 9 the beginning and is part of the communication by the recording party, 10 or (3) is accompanied by an automatic tone warning device which 11 automatically produces a distinct signal that is repeated at intervals of 12 approximately fifteen seconds during the communication while such 13 instrument, device or equipment is in use. 14 LCO No. 3216 2 of 2 This act shall take effect as follows and shall amend the following sections: Section 1 from passage 52-570d(a) Statement of Purpose: To permit a person to record a private telephone conversation when at least one person, who is part of the conversation, consents to the recording of the start of the conversation.
