LCO No. 3479 1 of 2 General Assembly Raised Bill No. 458 February Session, 2022 LCO No. 3479 Referred to Committee on JUDICIARY Introduced by: (JUD) AN ACT CONCERNING THE PROVISION OF SUBSTANCE USE DISORDER SERVICES AND MENTAL HEALTH SERVICES TO INDIVIDUALS WHO ARE INCARCERATED. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 18-81p of the general statutes is repealed and the 1 following is substituted in lieu thereof (Effective from passage): 2 The Commissioner of Correction, in consultation with the 3 Department of Mental Health and Addiction Services, the Secretary of 4 the Office of Policy and Management and the Judicial Department, shall 5 annually review, evaluate and make recommendations concerning 6 [substance abuse detoxification and treatment programs for drug-7 dependent pretrial and sentenced inmates of correctional facilities and] 8 (1) substance use disorder screening, diagnostic and treatment services 9 that are available to individuals who are incarcerated during the 10 entirety of any period of incarceration; (2) mental health screening, 11 diagnostic and treatment services that are available to individuals who 12 are incarcerated during the entirety of any period of incarceration; and 13 (3) the reintegration of such [inmates] individuals into the community. 14 Raised Bill No. 458 LCO No. 3479 2 of 2 [The commissioner shall examine various options for the detoxification 15 and treatment of drug-dependent inmates including, but not limited to, 16 methadone maintenance treatment and other therapies or treatments, 17 and the reintegration of drug-dependent inmates into the community 18 upon their release from incarceration, including the transfer of inmates 19 to community-based methadone or other therapy or treatment 20 programs. The commissioner shall report his findings and 21 recommendations and submit a proposal for detoxification, treatment 22 and reintegration programs including, if appropriate, the establishment 23 of one or more pilot programs for methadone maintenance or other 24 therapy or treatment for drug-dependent inmates to the General 25 Assembly not later than February 1, 1998.] On or before January 1, 2023, 26 and annually thereafter, the Commissioner of Correction shall report on 27 such review, in accordance with the provisions of section 11-4a, to the 28 joint standing committees of the General Assembly having cognizance 29 of matters relating to the judiciary, public health and appropriations and 30 the budgets of state agencies. 31 This act shall take effect as follows and shall amend the following sections: Section 1 from passage 18-81p Statement of Purpose: To require the Commissioner of Correction to review, evaluate, and make recommendations on the provision of substance use disorder treatment services and mental health services to individuals who are incarcerated.
