9-AN ACT CONCERNING THE REGULATION OF LIVESTOCK.
14+AN ACT CONCERNING THE REGULATION OF LIVESTOCK AND
15+CERTAIN RABBIT PROCESSING FACILITIES.
1016 Be it enacted by the Senate and House of Representatives in General

13-Section 1. Section 22-278 of the general statutes is repealed and the
14-following is substituted in lieu thereof (Effective from passage):
15-[For the purposes of this chapter "livestock" is defined as any camelid
16-or hooved animal raised for domestic or commercial use. The
17-Commissioner of Agriculture is authorized, subject to sections 4-168 to
18-4-174, inclusive, to make orders and regulations concerning the
19-importation, transportation, trailing, riding, driving, exhibiting,
20-examining, testing, identification, quarantining or disposing of livestock
21-to prevent the spread of contagious and infectious diseases among
22-livestock and to protect the public from such diseases as may be
23-transmissible to human beings, either directly or through the products
24-of such animals, and orders and regulations for the conservation of
25-livestock the products from which are used for food or clothing. The
26-commissioner shall give notice of any such order to any person named
27-therein by leaving a copy of such order with, or at the last-known place
28-of abode of, such person, if a resident of the state; if not a resident of the
29-state, by leaving a copy with, or at the last-known place of abode of, an
30-agent of such person, or the person having custody of the animals
31-described in such order, if within the state, or by forwarding a copy of Substitute House Bill No. 6726

28+livestock and to protect the public from such diseases as may be 10

30+of such animals, and orders and regulations for the conservation of 12
31+livestock the products from which are used for food or clothing. The 13
32+commissioner shall give notice of any such order to any person named 14
33+therein by leaving a copy of such order with, or at the last-known place 15
34+of abode of, such person, if a resident of the state; if not a resident of the 16
35+state, by leaving a copy with, or at the last-known place of abode of, an 17

36-address of the person named therein. The commissioner, in case of
37-emergency, may give notice of any regulation limiting or prohibiting the
38-importation, transportation, trailing, riding, driving, exhibiting or
39-disposing of livestock on any highway by publishing a copy of such
40-regulation in a newspaper published or having a substantial circulation
41-in the town in which the highway affected by such regulation may be
42-located. The commissioner shall give notice of any such order or
43-regulation to any common carrier named therein or affected thereby by
44-leaving a copy of such order or regulation with the president, secretary
45-or treasurer of the company acting as common carrier, or by leaving a
46-copy with any person or firm acting as a common carrier, or at the last-
47-known residence of any such person or a member of such firm in charge
48-of any office of such carrier. The commissioner is authorized to employ
49-assistants needed to enforce any such order or regulation. Any person
50-or any officer or agent of any corporation who violates any provision of
51-any such order or regulation, or who obstructs or attempts to obstruct
52-the commissioner or any assistant engaged in the discharge of any duty
53-hereunder, may be fined not more than one hundred dollars or may be
54-assessed an administrative civil penalty in accordance with section 22-
55-7.] For the purposes of this chapter and sections 15 to 20, inclusive, of
56-this act:
57-(1) "Accredited veterinarian" means a veterinarian who is approved
58-under Category II of the National Veterinary Accreditation Program by
59-the United States Department of Agriculture and by the state animal
60-health official of the state in which such veterinarian is licensed to
61-practice;
62-(2) "Commissioner" means the Commissioner of Agriculture or the
63-commissioner's designated agent including the State Veterinarian;
64-(3) "Certificate of veterinary inspection" or "health certificate" means

70-Agriculture that is used for verification of veterinary inspection and is
71-issued by a licensed and accredited veterinarian at the point of origin
72-for a shipment of livestock;
73-(4) "Department" means the Department of Agriculture;
74-(5) "Livestock" means any camelid or hooved animal raised for
75-domestic or commercial use, generally used to produce food or fiber and
76-considered to be farm animals;
77-(6) "Notifiable disease" means a disease of livestock or poultry
78-published in the United States Department of Agriculture's National
79-List of Reportable Animal Diseases;
80-(7) "Official identification" means a numbering system approved by
81-the United States Department of Agriculture and the State Veterinarian
82-for the official identification of individual animals that provides a
83-nationally unique identification number for each animal and prescribes
84-the animal identification methods and devices approved for use in each
85-species of livestock and that is affixed to each animal by tag or other
86-United States Department of Agriculture approved method;
87-(8) "Owner-shipper statement" means a document that meets the
88-requirements of 9 CFR 86.1, and that is signed by the owner or shipper
89-of the livestock and contains a statement certifying that the animals are
90-being transported for purposes stipulated on such form in accordance
91-with Title 9 of the Code of Federal Regulations;
92-(9) "Poultry" has the same meaning as provided in section 22-324; and
93-(10) "USDA" means the United States Department of Agriculture.
94-Sec. 2. Section 22-279 of the general statutes is repealed and the
95-following is substituted in lieu thereof (Effective from passage): Substitute House Bill No. 6726

99-(a) The [Commissioner of Agriculture or his deputy or authorized
100-agents] commissioner may quarantine all animals that [they have] the
101-commissioner has reasonable grounds to believe (1) are infected with a
102-communicable disease, (2) do not meet import, export or disease testing
103-requirements of the department, or (3) are kept under unsanitary
104-conditions [which] that, in the opinion of the commissioner, [or his
105-deputy or authorized agents,] endanger the public health or the health
106-of such animals. The quarantine may (A) prohibit or regulate the sale or
107-movement of such quarantined animals, including any mortalities, and
108-all the products of such quarantined animals, and (B) require that such
109-animals, including any mortalities, and the products of such animals be
110-confined in a place designated by the commissioner [or his deputy or
111-authorized agents,] for such time as the commissioner judges necessary.
112-[(b) Any person who violates any provision of any quarantine
113-imposed under this section shall be fined five hundred dollars for each
114-day during which such violation continues, up to a maximum fine of
115-twenty-five thousand dollars.]
116-(b) (1) The commissioner may adopt regulations, in accordance with
117-the provisions of chapter 54, and make orders concerning the
118-importation, transportation, trailing, riding, driving, exhibiting,
119-examining, testing, identification, quarantining or disposing of livestock
120-to prevent the spread of contagious and infectious diseases among
121-livestock and to protect the public from such diseases as may be
122-transmissible to human beings, either directly or through the products
123-of such animals. Such orders and regulations may provide for the
124-conservation of livestock that is produced for use as food or clothing.
125-(2) The commissioner shall give notice of any such order to any
126-person named therein by leaving a copy of such order with, or at the
127-last-known place of abode of, such person, if a resident of the state. If
128-such person is not a resident of the state, such notice shall be provided
129-by leaving a copy of such order with, or at the last-known place of abode Substitute House Bill No. 6726

101+certifying that the animals are being transported for purposes stipulated 71
102+on such form in accordance with Title 9 of the Code of Federal 72
103+Regulations, and that is signed by the owner or shipper of the livestock; 73
104+(9) "Poultry" has the same meaning as provided in section 22-324; and 74
105+(10) "USDA" means the United States Department of Agriculture. 75
106+Sec. 2. Section 22-279 of the general statutes is repealed and the 76
107+following is substituted in lieu thereof (Effective from passage): 77
108+(a) The [Commissioner of Agriculture or his deputy or authorized 78

136-the state, the commissioner shall cause a copy of such order to be sent
137-by registered or certified mail to the last-known address of the person
138-named in such order or, alternatively, by electronic notice if previously
139-consented to by the person named in such order.
140-(3) The commissioner, in the instance of an emergency, as determined
141-by the commissioner, may give notice of any order limiting or
142-prohibiting the importation, transportation, trailing, riding, driving,
143-exhibiting or disposing of livestock on any highway by publishing a
144-copy of such order in a newspaper that is published or that has a
145-substantial circulation in the town in which the highway affected by
146-such order is located.
147-(4) The commissioner shall give notice of any such order or regulation
148-to any common carrier named in such order or affected by such order
149-or regulation by leaving a copy of such order or regulation: (A) With the
150-president, secretary or treasurer of the company that acts as such
151-common carrier, (B) any person or firm acting as a common carrier, (C)
152-at the last-known residence of any such person or a member of such firm
153-in charge of any office of such carrier, or (D) at the electronic mail
154-address of the common carrier if previously consented to by the
155-common carrier.
156-(5) The commissioner may employ assistants needed to enforce any
157-such orders or regulations.
158-(6) Any person including, but not limited to, any officer or agent of
159-any corporation, who violates the provisions of: (A) This section, or (B)
160-any order or regulation authorized by this section, or who obstructs or
161-attempts to obstruct the commissioner, or any assistant of the
162-commissioner, while engaged in the discharge of any duty undertaken Substitute House Bill No. 6726

145+of, an agent of such person, or the person that has custody of the animals 109
146+described in such order, if such person or agent is located in the state. If 110
147+such agent or person that has custody of such animals is not located in 111
148+the state, the commissioner shall cause a copy of such order to be sent 112 Substitute Bill No. 6726

166-pursuant to this section may be fined not more than five hundred
167-dollars, per day per animal, for each day during which such violation
168-continues, up to a maximum fine of twenty-five thousand dollars.
169-Sec. 3. Section 22-279a of the general statutes is repealed and the
170-following is substituted in lieu thereof (Effective from passage):
171-Any livestock animal or poultry [being] that is tested for any disease
172-in accordance with the Uniform Methods and Rules of the United States
173-Department of Agriculture or for any biological or chemical residue
174-known to be in this state shall be quarantined on the premises where the
175-test is made until the test results are available and the test chart is signed
176-by a licensed accredited veterinarian or an employee of the Department
177-of Agriculture administering the test, provided the commissioner may
178-release such livestock animal or poultry from quarantine at any time.
179-Any blood, tissue or milk sample taken from any livestock animal or
180-poultry pursuant to this section shall be submitted for analysis to a
181-laboratory approved by the Commissioner of Agriculture. The
182-laboratory shall report the results of the test to the commissioner who
183-shall notify the person administering the test of such results.
184-Sec. 4. Section 22-287 of the general statutes is repealed and the
185-following is substituted in lieu thereof (Effective from passage):
186-[(a) The Commissioner of Agriculture may cause all neat cattle and
187-all goats in the state to be tuberculin tested by a licensed accredited
188-veterinarian at the expense of the state or by a veterinarian employed by
189-the United States Department of Agriculture or by a veterinarian
190-employed by the Department of Agriculture. The owner of any such
191-herd to be so tested shall provide assistance and proper restraint for
192-confining the animals for and during the application of said tests. When
193-said commissioner has determined the condition of such animals by
194-physical examination and tuberculin test performed by said
195-veterinarians, each animal reacting to such test shall be immediately Substitute House Bill No. 6726

199-segregated from the animals not reacting to such test by the owner
200-thereof and each animal reacting to such test shall be appraised as
201-provided in section 22-288 and shall be disposed of and the premises
202-upon which such animal has been kept shall be cleaned and disinfected
203-within fifteen days thereafter, subject to the approval of the
204-commissioner or his deputy or any authorized agent of the
205-commissioner. No animals shall be added to the herd until such
206-premises have been so cleaned and disinfected and inspected and
207-approved by the commissioner or his deputy or any authorized agent of
208-the commissioner. Any animal reacting to such test which has been
209-disposed of as provided by this section shall be paid for by the
210-Comptroller, provided funds shall be available for such purposes and
211-provided the animal reacting to such test and disposed of shall have
212-been approved by said commissioner as a proper addition to the herd.
213-(b) Surveillance tests may be performed by a technician trained by
214-and under the supervision of the State Veterinarian and employed by
215-the Department of Agriculture, provided no condemnation shall be
216-made on the basis of such surveillance tests. The owner of any herd to
217-be so tested shall provide assistance and proper restraint for confining
218-the animals for and during the application of such tests.]
219-(a) At the expense of the state, the commissioner may require and
220-provide for the testing and the control of tuberculosis in livestock in this
221-state. Any condemnation of livestock infected with tuberculosis shall
222-comply with the provisions of section 22-288, as amended by this act.
223-The procedures for testing for tuberculosis and the control and
224-disposition of livestock classified as reactors shall conform to one of the
225-following: (1) For goats, cattle, bison and captive cervids, the
226-procedures, methods, testing and the disposition of reactors shall
227-conform to the USDA Uniform Methods and Rules for Bovine
228-Tuberculosis Eradication; (2) for species of livestock other than goats,
229-cattle, bison or captive cervids, the procedures, methods, testing and the Substitute House Bill No. 6726
155+by registered or certified mail to the last-known address of the person 113
156+named in such order or, alternatively, by electronic notice if previously 114
157+consented to by the person named in such order. 115

179+attempts to obstruct the commissioner, or any assistant of the 137
180+commissioner, while engaged in the discharge of any duty undertaken 138
181+pursuant to this section may be fined not more than five hundred 139
182+dollars, per day per animal, for each day during which such violation 140
183+continues, up to a maximum fine of twenty-five thousand dollars. 141
184+Sec. 3. Section 22-279a of the general statutes is repealed and the 142

233-disposition of reactors shall be determined by the State Veterinarian; or
234-(3) the most recent USDA approved and published procedures for
235-testing for tuberculosis and the control and disposition of tuberculosis
236-positive livestock.
237-(b) The state shall not be liable for any damage incurred or alleged to
238-have been incurred by any such test performed pursuant to this section.
239-(c) Official testing for tuberculosis shall be restricted to the State
240-Veterinarian, veterinarians employed by the federal government and
241-accredited veterinarians licensed to practice in this state. Surveillance
242-tests may be performed by an employee of the department trained by
243-and under the supervision of the State Veterinarian, provided no
244-condemnation shall be made on the basis of such surveillance tests. The
245-owner of any herd to be so tested shall provide assistance and proper
246-restraint for confining the animals for such testing and during the
247-application of such tests.
248-Sec. 5. Section 22-288 of the general statutes is repealed and the
249-following is substituted in lieu thereof (Effective from passage):
250-(a) The [Commissioner of Agriculture] commissioner may cause any
251-[domestic animal which has given a positive reaction to the tuberculin
252-test to be killed,] livestock infected with an infectious or contagious
253-disease, including, but not limited to, tuberculosis, anthrax or foot and
254-mouth disease to be euthanized to protect the public health or prevent
255-the spread of such disease but no such [bovine animal] livestock shall
256-be [killed] euthanized until its value has been determined by the [owner
257-and the] commissioner. [If they are unable to agree upon the value of
258-such animal, each shall choose an arbitrator and the two so chosen shall
259-choose a third and the three so chosen, or a majority of the three so
260-chosen, shall determine the value of such animal, and the value so
261-determined shall be approved by the commissioner.] In determining the
262-value of condemned livestock, the commissioner shall consider the age, Substitute House Bill No. 6726

192+Any livestock animal or poultry [being] that is tested for any disease 144
193+in accordance with the Uniform Methods and Rules of the United States 145
194+Department of Agriculture or for any biological or chemical residue 146
195+known to be in this state shall be quarantined on the premises where the 147

214+said commissioner has determined the condition of such animals by 166
215+physical examination and tuberculin test performed by sa id 167
216+veterinarians, each animal reacting to such test shall be immediately 168
217+segregated from the animals not reacting to such test by the owner 169
218+thereof and each animal reacting to such test shall be appraised as 170
219+provided in section 22-288 and shall be disposed of and the premises 171
220+upon which such animal has been kept shall be cleaned and disinfected 172
221+within fifteen days thereafter, subject to the approval of the 173
222+commissioner or his deputy or any authorized agent of the 174
223+commissioner. No animals shall be added to the herd until such 175
224+premises have been so cleaned and disinfected and inspected and 176 Substitute Bill No. 6726

266-sex, grade and purpose for which such animal was kept. The
267-commissioner may consult with livestock dealers, commission sales
268-stables or other sources familiar with the value of livestock in
269-determining the value of condemned animals. When a certificate has
270-been filed with the commissioner that such animal has been [killed]
271-euthanized and the premises disinfected according to the order of the
272-commissioner, within a period of [fifteen days] time specified by the
273-commissioner, following the issuance of such order, the amount
274-determined under [subsection (b) of] this section shall be paid to the
275-owner by the state. [If a majority of the three arbitrators do not agree,
276-they shall so find and report and the commissioner shall then determine
277-the value of such animal or animals, which shall be final; but no] No
278-animal, the physical condition of which is such that it is of no real value,
279-and no animal which has been in the state for a period of less than three
280-months next preceding its quarantine shall be paid for by the state [;
281-provided such award may be paid in the case of cattle from any herd
282-which has been officially accredited, or from an officially declared
283-modified accredited area, or from any herd the entire number of which
284-has passed two negative tests and such cattle have not, since passing
285-such tests, been exposed to infection from tuberculosis. The provisions
286-of this section shall not apply to animals condemned to prevent the
287-spread of foot and mouth disease or anthrax] unless such animal was a
288-natural addition to the herd that was born in this state or was imported
289-into this state in compliance with this chapter.
290-(b) [The state shall appraise any condemned registered purebred
291-bovine animal for a sum not exceeding two thousand dollars and any
292-grade bovine animal for a sum not exceeding eleven hundred dollars.]
293-The amount paid by the state for any [bovine animal which] livestock
294-that is condemned pursuant to this section and sold for slaughter, shall
295-be deposited by the commissioner [in] into the General Fund. The
296-amount paid by the state to the owner of any such animal shall be

302-any indemnity or payment for such animal received by the owner from
303-the federal government. No compensation shall be paid to the owner of
304-any such [domestic animal] livestock by the state unless such animal has
305-been destroyed to prevent the spread of an infectious or contagious
306-disease or to protect the public health. Any animal [which has reacted
307-to the tuberculin test] that is condemned shall be [tagged in the left ear
308-by the person making such test with a numbered metal ear tag, which
309-tag shall have stamped or impressed thereon the following: "Ct.
310-Reacted, Number (....)", including the number of such tag. Such tags
311-shall be furnished by said commissioner and shall be numbered
312-consecutively beginning with the number one, and such animal shall
313-also be branded at the time of the test with the letter "T" on the left jaw]
314-identified with a tag, brand device or marking approved by the
315-commissioner. No such animal shall be [killed] moved, euthanized, sold
316-or used for food, except under the direction of [said] the commissioner.
317-(c) Any person aggrieved by an order of the commissioner to
318-condemn livestock pursuant to this section may appeal such order to the
319-superior court for the judicial district of Hartford not later than seven
320-days after issuance of such order.
321-Sec. 6. Section 22-288a of the general statutes is repealed and the
322-following is substituted in lieu thereof (Effective from passage):
323-If the [Commissioner of Agriculture] commissioner finds the
324-presence of tuberculosis or brucellosis recurring in one herd of livestock
325-within any two-year period, or if [he] the commissioner finds any herd
326-of [cattle] livestock substantially infected with tuberculosis, [or]
327-brucellosis or other infectious or contagious disease, [he] the
328-commissioner may order the condemnation of such herd to prevent the
329-spread of such disease or to protect the public health and compensation
330-therefor shall be paid in accordance with section 22-288, as amended by
331-this act. [Said] Such compensation shall not be paid, nor shall the herd Substitute House Bill No. 6726
231+approved by the commissioner or his deputy or any authorized agent of 177
232+the commissioner. Any animal reacting to such test which has been 178
233+disposed of as provided by this section shall be paid for by the 179
234+Comptroller, provided funds shall be available for such purposes and 180
235+provided the animal reacting to such test and disposed of shall have 181
236+been approved by said commissioner as a proper addition to the herd. 182
237+(b) Surveillance tests may be performed by a technician trained by 183
238+and under the supervision of the State Veterinarian and employed by 184
239+the Department of Agriculture, provided no condemnation shall be 185
240+made on the basis of such surveillance tests. The owner of any herd to 186
241+be so tested shall provide assistance and proper restraint for confining 187
242+the animals for and during the application of such tests.] 188
243+(a) At the expense of the state, the commissioner may require and 189
244+provide for the testing and the control of tuberculosis in livestock in this 190
245+state. Any condemnation of livestock infected with tuberculosis shall 191
246+comply with the provisions of section 22-288, as amended by this act. 192
247+The procedures for testing for tuberculosis and the control and 193
248+disposition of livestock classified as reactors shall conform to one of the 194
249+following: (1) For goats, cattle, bison and captive cervids, the 195
250+procedures, methods, testing and the disposition of reactors shall 196
251+conform to the USDA Uniform Methods and Rules for Bovine 197
252+Tuberculosis Eradication; (2) for species of livestock other than goats, 198
253+cattle, bison or captive cervids, the procedures, methods, testing and the 199
254+disposition of reactors shall be determined by the State Veterinarian; or 200
255+(3) the most recent USDA approved and published procedures for 201
256+testing for tuberculosis and the control and disposition of Brucellosis 202
257+positive livestock. 203
258+(b) The state shall not be liable for any damage incurred or alleged to 204
259+have been incurred by any such test performed pursuant to this section. 205
260+(c) Official testing for tuberculosis shall be restricted to the State 206
261+Veterinarian, veterinarians employed by the federal government and 207
262+accredited veterinarians licensed to practice in this state. Surveillance 208 Substitute Bill No. 6726

336-been cleaned and disinfected, and such premises have been inspected
337-and approved by the commissioner. [or his deputy or any authorized

339-commissioner to so condemn a herd may, [within] not later than seven
340-days after such order, appeal therefrom in accordance with the
341-provisions of section 4-183.
342-Sec. 7. Section 22-294 of the general statutes is repealed and the
343-following is substituted in lieu thereof (Effective from passage):
344-The owner of any herd of livestock shall house, feed and care for such
345-herd under such sanitary conditions as shall promote the health and
346-welfare of such herd. No calf shall be fed milk or any other dairy product
347-except such milk or other product [as has been] that is produced by a
348-herd that [has been tuberculin tested] is negative for tuberculosis, or
349-such milk or other dairy product [as has been] that is pasteurized by
350-being maintained at a heat of one hundred forty-two degrees Fahrenheit
351-for a period of thirty minutes.
352-Sec. 8. Section 22-295 of the general statutes is repealed and the
353-following is substituted in lieu thereof (Effective from passage):
354-The owner of any herd of livestock shall keep a record [which shall
355-include a description] of each [registered or graded] animal in such herd
356-[and] including the final disposition of such animal that is made by such
357-owner. [which such owner makes of any animal of such herd.] Each such
358-animal shall be marked [by a tag or other marking approved by the
359-Commissioner of Agriculture] with official identification when such
360-animal leaves the premises and such official identification shall be made
361-part of such record. Such record shall be kept for the life of the animal
362-plus one additional year.
363-Sec. 9. Section 22-296 of the general statutes is repealed and the Substitute House Bill No. 6726

278+[domestic animal which has given a positive reaction to the tuberculin 218
279+test to be killed,] livestock infected with an infectious or contagious 219
280+disease, including, but not limited to, tuberculosis, anthrax or foot and 220
281+mouth disease to be euthanized to protect the public health or prevent 221
282+the spread of such disease but no such [bovine animal] livestock shall 222
283+be [killed] euthanized until its value has been determined by the [owner 223
284+and the] commissioner. [If they are unable to agree upon the value of 224
285+such animal, each shall choose an arbitrator and the two so chosen shall 225
286+choose a third and the three so chosen, or a majority of the three so 226
287+chosen, shall determine the value of such animal, and the value so 227
288+determined shall be approved by the commissioner.] In determining the 228
289+value of condemned livestock, the commissioner shall consider the age, 229
290+sex, grade and purpose for which such animal was kept. The 230
291+commissioner may consult with livestock dealers, commission sales 231
292+stables or other sources familiar with the value of livestock in 232
293+determining the value of condemned animals. When a certificate has 233
294+been filed with the commissioner that such animal has been [killed] 234
295+euthanized and the premises disinfected according to the order of the 235
296+commissioner, within a period of [fifteen days] time specified by the 236
297+commissioner, following the issuance of such order, the amount 237
298+determined under [subsection (b) of] this section shall be paid to the 238
299+owner by the state. [If a majority of the three arbitrators do not agree, 239

368-When infection [of tuberculosis] with any disease listed as reportable
369-or notifiable by the department or the USDA is found in any herd of
370-[cattle or goats] livestock, the [remaining] animals in such herd shall be
371-quarantined. [until such herd has passed three successive negative tests,
372-at least sixty days to elapse between each two tests.] Such quarantine
373-shall remain in effect until such time as the State Veterinarian
374-determines the quarantine should be removed. No animals shall be
375-removed from such herd while under quarantine, except under a
376-written permit issued to the owner of the herd by the [Commissioner of
377-Agriculture or his agents] commissioner to move directly from the
378-quarantined premises to [immediate slaughter] another premises for the
379-purpose and under the conditions specified in such permit. Such permit
380-shall accompany such animals from the quarantined premises. [to the
381-point where slaughter is to be effected.] The owner shall deliver such
382-permit to any person [purchasing] receiving such animals, and such
383-person shall exercise all reasonable diligence in determining that such
384-permit is [received by him and is valid, and that such permit shall
385-accompany such animals to slaughter] valid.
386-Sec. 10. Section 22-298 of the general statutes is repealed and the
387-following is substituted in lieu thereof (Effective from passage):
388-[(a) The Commissioner of Agriculture may require and provide for
389-the drawing and collecting of blood samples for the control of
390-brucellosis from goats over three months of age and herds of bovine
391-animals, including male bovine animals, six months of age or over, but
392-not including steers, and may at his discretion decide not to test heifers
393-which have been officially calfhood vaccinated, until they have calved
394-or are eighteen months of age. All blood samples shall be submitted to
395-a laboratory approved by the Commissioner of Agriculture and all milk
396-samples shall be submitted to a laboratory approved by said
397-commissioner for examination and the results of such tests shall be Substitute House Bill No. 6726

402-by him. Upon receipt of the laboratory reports on any such tests, the
403-commissioner shall inform the owner or agent and the veterinarian of
404-the result thereof. When the commissioner has determined the condition
405-of such herd by such tests, all animals reacting positively to any test for
406-brucellosis shall be identified by branding with a hot iron on the left jaw
407-and a metal number reactor tag in the left ear as approved by the
408-commissioner. All such reactors shall be appraised, branded, tagged
409-and slaughtered within fifteen days and the premises cleaned,
410-disinfected and approved within thirty days after slaughter in order to
411-qualify for indemnity under section 22-307. If the reaction of any animal
412-to a test for brucellosis is suspicious, it may be identified and
413-quarantined and shall not be disposed of without first obtaining written
414-permission from the commissioner.
415-(b) The state shall not be liable for any damage incurred or alleged to
416-have been incurred by any such test.
417-(c) No swine or goats used for breeding purposes shall be kept on the
418-same premises as cattle unless such swine or goats are certified free from
419-brucellosis. Any positive reactors shall be immediately slaughtered and
420-the premises cleaned and disinfected.
421-(d) The drawing of blood samples for brucellosis tests shall be
422-restricted to the State Veterinarian, veterinarians employed by the
423-Department of Agriculture, veterinarians employed by the federal
424-government and veterinarians licensed to practice in this state and
425-assigned by the commissioner for that purpose.]
426-(a) The commissioner may require and provide for the drawing and

443-and bison; (2) for swine, the procedures, methods, testing and
444-disposition of shall conform to the USDA uniform methods and rules
445-for brucellosis eradication in swine; (3) for cervidae, the procedures,
446-methods, testing and disposition of shall conform to the USDA uniform
447-methods and rules for brucellosis eradication in cervidae; (4) for species
448-other than cattle, bison, swine or cervidae, the procedures, methods,
449-testing and disposition for brucellosis shall be determined by the State
450-Veterinarian; or (5) the most recent USDA approved and published
451-brucellosis procedures for testing and the control and disposition of
452-brucellosis positive livestock.
453-(b) The state shall not be liable for any damage incurred or alleged to
454-have been incurred by any such test performed pursuant to this section.
455-(c) No swine or goats used for breeding purposes shall be kept on the

467-No milk may be offered for sale in Connecticut unless produced from
468-herds complying with sections 22-287, as amended by this act, and 22-
469-298, as amended by this act. [22-299a, 22-303, 22-304, 22-306 and 22-307
470-and this section. Before a permit may be issued by the Commissioner of
471-Agriculture for the sale of milk, information must be available from the
472-state Department of Agriculture or from the livestock official of the state
473-where milk is produced that such herd producing milk for sale has
474-reacted negatively to tests which meet Connecticut specifications for the
475-control of tuberculosis and brucellosis.] For each new milk producer
476-registered pursuant to section 22-172 or 22-173a, if such herd or any
477-animals in such herd does not have a current tuberculosis and
478-brucellosis negative test result, such herd shall be tested and found
479-negative to a tuberculosis and brucellosis test prior to the issuance of the
480-registration to produce milk. Such tuberculosis and brucellosis test may
481-be conducted by employees of the department. Thereafter, each
482-registered milk producing herd shall be surveillance tested for
483-tuberculosis and brucellosis by the department at a frequency to be
484-determined by the state veterinarian.
485-Sec. 12. Section 22-303 of the general statutes is repealed and the
486-following is substituted in lieu thereof (Effective from passage):
487-(a) Each owner of bovine animals in this state may have all of [his]
488-such owner's female calves vaccinated for the control of brucellosis at
489-ages [the commissioner shall establish by regulation] established
490-pursuant to the uniform methods and rules for brucellosis eradication
491-of the United States Department of Agriculture. [Animal and Plant
492-Health Inspection Service.] Calves may be vaccinated at the owner's
493-expense by [an approved] a licensed accredited veterinarian. [, an
494-approved federal or state full-time employed veterinarian assigned
495-directly and authorized by the Commissioner of Agriculture or by a
496-livestock inspector employed and authorized by the commissioner.]

502-(c) No person, firm or corporation, and no agent or employee of any
503-corporation, shall [have in his possession] possess any brucellosis
504-vaccine or any product containing any Brucella organisms unless
505-written permission has been obtained from the commissioner.
506-(d) No female bovine animal over the maximum vaccination age, as
507-established by the commissioner in accordance with the uniform
508-methods and rules for brucellosis eradication of the United States
509-Department of Agriculture, [Animal and Plant Health Inspection
510-Service,] shall be vaccinated with Brucella Abortus vaccine. Brucellosis
511-vaccine or any product containing any Brucella organisms shall not be
512-shipped into the state except upon written permission of the
513-commissioner.
514-Sec. 13. Section 22-308 of the general statutes is repealed and the
515-following is substituted in lieu thereof (Effective from passage):
516-[All neat cattle and goats brought into this state shall be accompanied
517-by a permit obtained from the Commissioner of Agriculture. Such
518-permit shall accompany all waybills or, if the animals are driven over
519-the highways, shall be in the possession of the person in charge of the
520-same. The commissioner may refuse to grant a permit to any person, or
521-any officer or agent of any corporation, who violates any statute or
522-regulation governing the importation of livestock or poultry. Neat cattle
523-and goats brought into this state for the purpose of immediate slaughter
524-upon premises where federal inspection is maintained need not be
525-accompanied by such permit, provided all such cattle or goats
526-transported into this state shall be accompanied by a bill of sale or
527-certificate of assignment, made out by the consignor and showing the
528-name of the consignee and the destination. The owner of each
529-establishment where federal inspection is maintained shall report
530-weekly to the commissioner, upon forms furnished by him, the number Substitute House Bill No. 6726
385+such milk or other dairy product [as has been] that is pasteurized by 307

397+part of such record. Such record shall be kept for the life of the animal 319

399+Sec. 9. Section 22-296 of the general statutes is repealed and the 321
400+following is substituted in lieu thereof (Effective from passage): 322
401+When infection [of tuberculosis] with any disease listed as reportable 323
402+or notifiable by the department or the USDA is found in any herd of 324
403+[cattle or goats] livestock, the [remaining] animals in such herd shall be 325
404+quarantined. [until such herd has passed three successive negative tests, 326
405+at least sixty days to elapse between each two tests.] Such quarantine 327
406+shall remain in effect until such time as the State Veterinarian 328
407+determines the quarantine should be removed. No animals shall be 329
408+removed from such herd while under quarantine, except under a 330
409+written permit issued to the owner of the herd by the [Commissioner of 331
410+Agriculture or his agents] commissioner to move directly from the 332
411+quarantined premises to [immediate slaughter] another premises for the 333
412+purpose and under the conditions specified in such permit. Such permit 334
413+shall accompany such animals from the quarantined premises. [to the 335
414+point where slaughter is to be effected.] The owner shall deliver such 336
415+permit to any person [purchasing] receiving such animals, and such 337

534-of head so imported. Such owner shall also report to said commissioner
535-the ear tag or identification number and the name of the previous owner
536-of all animals purchased within the state and delivered to such
537-establishments.]
538-(a) All livestock brought into this state shall be accompanied by a
539-livestock importation permit obtained from the commissioner and a
540-certificate of veterinary inspection. Such certificate of veterinary
541-inspection shall include the following: (1) Date of examination, (2)
542-physical location of origin of such livestock, (3) name and mailing
543-address of the consignor, (4) physical location of the destination in this
544-state, (5) name and mailing address of the consignee, (6) official
545-identification of each animal's age, sex, breed and species for each
546-animal represented on the certificate of veterinary inspection, and (7)
547-results of all tests required by this chapter. At the time of examination,
548-the issuing veterinarian shall verify that each animal represented on the
549-certificate of veterinary inspection bears identification tags or other
550-identification to officially identify the livestock. Such certificate of
551-veterinary inspection shall also include a statement verifying that the
552-livestock identified on the document have been inspected and that they
553-are free from clinical signs of any contagious, infectious or
554-communicable diseases and that the livestock do not originate from an
555-area of quarantine, infestation or infection. A certificate of veterinary
556-inspection shall be valid for thirty days after the date of issuance and
557-shall be signed by an accredited veterinarian. Any livestock import
558-permit issued pursuant to this section shall expire fifteen days after the
559-date of issuance.
560-(b) Not later than forty-eight hours after imported livestock arrives at
561-the destination for such livestock in this state, the owner of such
562-livestock shall complete and return the import permit to the
563-commissioner and report the number of each species imported and
564-include a copy of the certificate of veterinary inspection that Substitute House Bill No. 6726

425+Sec. 10. Section 22-298 of the general statutes is repealed and the 341
426+following is substituted in lieu thereof (Effective from passage): 342
427+[(a) The Commissioner of Agriculture may require and provide for 343
428+the drawing and collecting of blood samples for the control of 344
429+brucellosis from goats over three months of age and herds of bovine 345
430+animals, including male bovine animals, six months of age or over, but 346
431+not including steers, and may at his discretion decide not to test heifers 347
432+which have been officially calfhood vaccinated, until they have calved 348
433+or are eighteen months of age. All blood samples shall be submitted to 349
434+a laboratory approved by the Commissioner of Agriculture and all milk 350
435+samples shall be submitted to a laboratory approved by said 351
436+commissioner for examination and the results of such tests shall be 352
437+reported by the laboratories to the commissioner in a manner prescribed 353
438+by him. Upon receipt of the laboratory reports on any such tests, the 354
439+commissioner shall inform the owner or agent and the veterinarian of 355
440+the result thereof. When the commissioner has determined the condition 356
441+of such herd by such tests, all animals reacting positively to any test for 357
442+brucellosis shall be identified by branding with a hot iron on the left jaw 358
443+and a metal number reactor tag in the left ear as approved by the 359
444+commissioner. All such reactors shall be appraised, branded, tagged 360
445+and slaughtered within fifteen days and the premises cleaned, 361
446+disinfected and approved within thirty days after slaughter in order to 362
447+qualify for indemnity under section 22-307. If the reaction of any animal 363
448+to a test for brucellosis is suspicious, it may be identified and 364
449+quarantined and shall not be disposed of without first obtaining written 365
450+permission from the commissioner. 366
451+(b) The state shall not be liable for any damage incurred or alleged to 367
452+have been incurred by any such test. 368
453+(c) No swine or goats used for breeding purposes shall be kept on the 369
454+same premises as cattle unless such swine or goats are certified free from 370 Substitute Bill No. 6726

569-(c) The commissioner may refuse to grant a livestock import permit
570-to any person, or any officer or agent of any corporation, who violates
571-any statute or regulation governing the importation of livestock.
572-Whenever an import permit is refused or revoked, the commissioner
573-shall notify such person importing the livestock of the violations and
574-corrections necessary and, after making corrections, such person may
575-reapply for a livestock import permit.
576-(d) Livestock brought into this state: (1) For the purpose of immediate
577-slaughter upon premises where federal inspection is maintained, (2) to
578-a slaughter facility approved by the commissioner, or (3) to a licensed
579-livestock commission sales stable authorized to handle out-of-state
580-livestock by the USDA and the State Veterinarian, shall be exempt from
581-the provisions of subsection (a) of this section, provided all such
582-livestock transported into this state are accompanied with an owner-
583-shipper statement that shall include the following: (A) The name and
584-address of the consignor and the consignee; (B) the point of origin of
585-such livestock and identification of the premises that is the destination
586-for such livestock; (C) the date of entry into the state and a statement
587-that all livestock are consigned for immediate slaughter; (D) a listing of
588-official identification of each animal, as required in subsection (a) of this
589-section; and (E) the signature of the shipper certifying that the animals
590-are imported for slaughter only.
591-(e) Any person who transports livestock or equines into this state for
592-exhibition or competition purposes may obtain an exhibition permit
593-from the commissioner prior to entering the state. Livestock or equines
594-listed in the exhibition permit and on the certificate of veterinary
595-inspection shall be exempt from the requirement for a new certificate of
596-veterinary inspection every thirty days for the duration of the exhibition
597-permit. All tests required pursuant to this chapter and chapter 438a, as
598-applicable, to qualify for importation shall be listed on the certificate of Substitute House Bill No. 6726

603-exhibition permit. Exhibition permits shall expire six months after the
604-date of issuance.
605-Sec. 14. Section 22-309 of the general statutes is repealed and the
606-following is substituted in lieu thereof (Effective from passage):
607-The commissioner may refuse to grant permits to import animals
608-from any and all sections or areas [which in his opinion] that the
609-commissioner determines are infected with a contagious disease, and
610-[he] the commissioner may, at any time, revoke any permit previously
611-issued and then outstanding, for the importation into this state of
612-animals [which] that in [his] the commissioner's opinion are infected,
613-and all damages caused or claimed to have been caused by such
614-revocation shall be borne by the owner. All [neat cattle and goats]
615-livestock entering the state shall be identified by [ear tags, registration
616-name or number, tattoo or other markings appro ved by the
617-commissioner] official identification.
618-Sec. 15. (NEW) (Effective from passage) (a) No person shall import, or
619-cause to be imported, into this state any livestock that is under any state
620-or federal quarantine due to the presence of, or the suspected presence
621-of, an infectious or contagious disease.
622-(b) No person shall import, or cause to be imported, into this state
623-any livestock that is infected with, or has been exposed to, any infectious
624-or contagious disease including, but not limited to, tuberculosis,
625-brucellosis, anaplasmosis, psoroptic scabies, chronic wasting disease,
626-bovine spongiform encephalopathy, hog cholera, pseudorabies, rabies
627-or scrapie.
628-(c) No person shall import, or cause to be imported, into this state any
629-livestock unless an import permit issued pursuant to section 22-308 of
630-the general statutes, as amended by this act, is obtained and each animal Substitute House Bill No. 6726
461+brucellosis. Any positive reactors shall be immediately slaughtered and 371
462+the premises cleaned and disinfected. 372
463+(d) The drawing of blood samples for brucellosis tests shall be 373
464+restricted to the State Veterinarian, veterinarians employed by the 374
465+Department of Agriculture, veterinarians employed by the federal 375
466+government and veterinarians licensed to practice in this state and 376
467+assigned by the commissioner for that purpose.] 377
468+(a) The commissioner may require and provide for the drawing and 378
469+collecting of samples for testing and the control of brucellosis in 379
470+livestock in this state. All blood and milk samples shall be submitted to 380
471+a laboratory approved by the commissioner and the results of such tests 381
472+shall be reported by the laboratories to the commissioner in a manner 382
473+prescribed by the commissioner. Upon receipt of the laboratory reports 383
474+on any such tests, the commissioner shall inform the owner or agent of 384
475+any corporation and the applicable veterinarian of the results. Any 385
476+condemnation of livestock infected with brucellosis shall comply with 386
477+section 22-288, as amended by this act. The procedures for testing for 387
478+brucellosis and the control and disposition of livestock infected with 388
479+brucellosis shall conform to one of the following: (1) For cattle and bison, 389
480+the procedures, methods, testing and disposition shall conform to the 390
481+USDA uniform methods and rules for brucellosis eradication in cattle 391
482+and bison; (2) for swine, the procedures, methods, testing and 392
483+disposition of shall conform to the USDA uniform methods and rules 393
484+for brucellosis eradication in swine; (3) for cervidae, the procedures, 394
485+methods, testing and disposition of shall conform to the USDA uniform 395
486+methods and rules for brucellosis eradication in cervidae; (4) for species 396
487+other than cattle, bison, swine or cervidae, the procedures, methods, 397
488+testing and disposition for brucellosis shall be determined by the State 398
489+Veterinarian; or (5) the most recent USDA approved and published 399
490+brucellosis procedures for testing and the control and disposition of 400
491+brucellosis positive livestock. 401
492+(b) The state shall not be liable for any damage incurred or alleged to 402
493+have been incurred by any such test performed pursuant to this section. 403 Substitute Bill No. 6726

634-is accompanied by a certificate of veterinary inspection issued by an
635-accredited veterinarian certifying that each animal has been inspected,
636-is not showing signs of infectious or contagious diseases, and has been
637-tested in accordance with the requirements of chapter 433 of the general
638-statutes.
639-(d) Livestock imported into this state for movement directly to
640-slaughter at a facility under a grant of inspection from the United States
641-Department of Agriculture, or approved by the commissioner, are
642-exempt from subsection (c) of this section provided such livestock are
643-accompanied by the owner-shipper statement required pursuant to
644-subsection (d) of section 22-308 of the general statutes, as amended by
645-this act. No such livestock shall be sold or transferred live to any person,
646-firm or corporation.
647-Sec. 16. (NEW) (Effective from passage) All cattle or bison imported into
648-this state shall be accompanied by an import permit required pursuant
649-to section 22-308 of the general statutes, as amended by this act, and a
650-certificate of veterinary inspection issued by an accredited veterinarian
651-thirty days or less prior to entry to the state that includes the dates and
652-results of any tests required by this section, the official identification of
653-each animal and certification that such cattle or bison meet the following
654-requirements: (1) They originated from a herd that was negative to a
655-whole herd tuberculin test performed not more than twelve months
656-prior to such entry into this state and each imported animal was
657-included in such whole herd test or tested negative to a tuberculosis test
658-performed not more than sixty days prior to entry into this state, and (2)
659-for bulls and non-brucellosis vaccinated female cattle six months of age
660-and older and for official calfhood vaccinates eighteen months of age
661-and older, that they are negative to an official test for brucellosis that
662-was performed not more than thirty days prior to entry into this state.
663-Spayed heifers and steers imported as feeder cattle are exempt from
664-such brucellosis testing. Cattle and bison vaccinated as adults for Substitute House Bill No. 6726

504+the State Veterinarian, veterinarians and trained employees of the 408
505+department, veterinarians employed by the federal government and 409
506+accredited veterinarians licensed to practice in this state. 410
507+Sec. 11. Section 22-301 of the general statutes is repealed and the 411
508+following is substituted in lieu thereof (Effective from passage): 412
509+No milk may be offered for sale in Connecticut unless produced from 413
510+herds complying with sections 22-287 and 22-298, as amended by this 414
511+act. [22-299a, 22-303, 22-304, 22-306 and 22-307 and this section. Before a 415
512+permit may be issued by the Commissioner of Agriculture for the sale 416
513+of milk, information must be available from the state Department of 417
514+Agriculture or from the livestock official of the state where milk is 418
515+produced that such herd producing milk for sale has reacted negatively 419
516+to tests which meet Connecticut specifications for the control of 420
517+tuberculosis and brucellosis.] For each new milk producer registered 421
518+pursuant to section 22-172 or 22-173a, if such herd or any animals in 422
519+such herd does not have a current tuberculosis and brucellosis negative 423
520+test result, such herd shall be tested and found negative to a tuberculosis 424
521+and brucellosis test prior to the issuance of the registration to produce 425
522+milk. Such tuberculosis and brucellosis test may be conducted by 426
523+employees of the department. Every two years thereafter, each 427
524+registered milk producing herd shall be surveillance tested for 428
525+tuberculosis and brucellosis by the department. 429
526+Sec. 12. Section 22-303 of the general statutes is repealed and the 430
527+following is substituted in lieu thereof (Effective from passage): 431
528+(a) Each owner of bovine animals in this state may have all of [his] 432
529+such owner's female calves vaccinated for the control of brucellosis at 433
530+ages [the commissioner shall establish by regulation] established 434 Substitute Bill No. 6726

668-brucellosis are not eligible for entry into the state. Cattle and bison that
669-were vaccinated when they were more than three hundred fifty-nine
670-days of age with diluted brucella abortus vaccine are not eligible for

673-state shall be accompanied by an import permit required pursuant to
674-section 22-308 of the general statutes, as amended by this act, and a
675-certificate of veterinary inspection issued by an accredited veterinarian
676-not more than thirty days prior to entry into this state that includes the
677-dates and results of any required tests, the official identification of each
678-animal and certification that the sheep listed on the certificate of
679-veterinary inspection have not been exposed to scrapie.
680-Sec. 18. (NEW) (Effective from passage) Any goat imported into this
681-state shall be accompanied by an import permit required pursuant to
682-section 22-308 of the general statutes, as amended by this act, and a
683-certificate of veterinary inspection issued by an accredited veterinarian
684-not more than thirty days prior to entry into this state that includes: (1)
685-The dates and results of any tests required by this section, (2) the official
686-identification of each animal, and (3) certification that any goat listed on
687-the certificate of veterinary inspection has not been exposed to scrapie.
688-Additionally, any such goat shall meet the following requirements: (A)
689-They shall originate from a herd where they were included in a whole
690-herd with negative tuberculosis tests administered not more than
691-twelve months prior to such entry, (B) any such goat over three months
692-of age shall have tested negative to a tuberculin test not more than sixty
693-days prior to such entry, and (C) any goat over three months of age shall
694-have tested negative for brucellosis not more than thirty days prior to
695-such entry. Any kid goat under three months of age may be imported
696-on the dam's test chart if the dam was brucellosis tested and found
697-negative not more than twelve months prior to such entry and a copy of

703-Sec. 19. (NEW) (Effective from passage) Any camelid imported into this
704-state shall be accompanied by an import permit required pursuant to
705-section 22-308 of the general statutes, as amended by this act, and a
706-certificate of veterinary inspection issued by an accredited veterinarian
707-not more than thirty days prior to entry into this state. Such certificate
708-shall include the dates and results of any tests required by this section
709-and the official identification of each animal. Additionally, any such
710-camelid shall: (1) Have tested negative for tuberculosis using an axillary
711-tuberculin test not more than sixty days prior to such entry, and (2) if
712-six months of age or older, test negative for brucellosis not more than
713-thirty days prior to such entry.
714-Sec. 20. (NEW) (Effective from passage) All cervidae imported into this
715-state shall be accompanied by an import or exhibition permit required
716-pursuant to section 22-308 of the general statutes, as amended by this
717-act, and a certificate of veterinary inspection that verifies compliance
718-with the provisions of section 26-57a of the general statutes and any
719-regulations adopted pursuant to said section.
720-Sec. 21. Section 22-316 of the general statutes is repealed and the
721-following is substituted in lieu thereof (Effective from passage):
722-[All cattle or goats found to be affected with a communicable disease
723-shall be killed and the carcasses disposed of and premises disinfected in
724-accordance with the order of the Commissioner of Agriculture and at
725-the expense of the owner.] All carcasses of diseased livestock
726-condemned pursuant to this chapter shall be disposed of in a manner
727-acceptable to the commissioner. The premises shall be disinfected in a
728-manner acceptable to the commissioner before livestock are
729-reintroduced to such premises.
730-Sec. 22. Section 22-318a of the general statutes is repealed and the Substitute House Bill No. 6726
537+pursuant to the uniform methods and rules for brucellosis eradication 435
538+of the United States Department of Agriculture. [Animal and Plant 436
539+Health Inspection Service.] Calves may be vaccinated at the owner's 437
540+expense by [an approved] a licensed accredited veterinarian. [, an 438
541+approved federal or state full-time employed veterinarian assigned 439
542+directly and authorized by the Commissioner of Agriculture or by a 440
543+livestock inspector employed and authorized by the commissioner.] 441
544+(b) The state shall not be liable for any damages incurred or alleged 442
545+to have been incurred by the use of any vaccine. 443
546+(c) No person, firm or corporation, and no agent or employee of any 444
547+corporation, shall [have in his possession] possess any brucellosis 445
548+vaccine or any product containing any Brucella organisms unless 446
549+written permission has been obtained from the commissioner. 447
550+(d) No female bovine animal over the maximum vaccination age, as 448
551+established by the commissioner in accordance with the uniform 449
552+methods and rules for brucellosis eradication of the United States 450
553+Department of Agriculture, [Animal and Plant Health Inspection 451
554+Service,] shall be vaccinated with Brucella Abortus vaccine. Brucellosis 452
555+vaccine or any product containing any Brucella organisms shall not be 453
556+shipped into the state except upon written permission of the 454
557+commissioner. 455
558+Sec. 13. Section 22-308 of the general statutes is repealed and the 456
559+following is substituted in lieu thereof (Effective from passage): 457
560+[All neat cattle and goats brought into this state shall be accompanied 458
561+by a permit obtained from the Commissioner of Agriculture. Such 459
562+permit shall accompany all waybills or, if the animals are driven over 460
563+the highways, shall be in the possession of the person in charge of the 461
564+same. The commissioner may refuse to grant a permit to any person, or 462
565+any officer or agent of any corporation, who violates any statute or 463
566+regulation governing the importation of livestock or poultry. Neat cattle 464
567+and goats brought into this state for the purpose of immediate slaughter 465 Substitute Bill No. 6726

734-following is substituted in lieu thereof (Effective from passage):
735-Any herd owner, auctioneer, [cattle] livestock dealer or sales
736-manager, who contemplates a complete dispersal sale of a herd or a sale
737-in which more than ten head is to be sold in a group shall furnish a list
738-of animals to be sold to the [Commissioner of Agriculture]
739-commissioner not later than fourteen days prior to the sale. [, unless the
740-commissioner, in his sole discretion, shall find that this requirement,
741-under existing conditions, would impose undue hardship on the seller,
742-in which case he may waive it.] No owner, auctioneer, [cattle] livestock
743-dealer or sales manager shall conduct a dispersal sale without the
744-approval of the commissioner. The [commissioner may, in his
745-discretion,] State Veterinarian may require such herd to be [tuberculin
746-or brucellosis tested, or both,] tested for diseases, as the State
747-Veterinarian determines are necessary, before such sale. If such herd has
748-been tested or is tested in accordance with the provisions of this section
749-[and is found negative to both tests, or a permit has been issued by the
750-commissioner in accordance with the provisions of section 22-303] and
751-is found negative, permission shall be granted for said sale. [These tests
752-shall be applied as private tests if not a routine test assignment. Any
753-person who violates any provision of this section shall be fined not more
754-than one hundred dollars.] Any test required pursuant to this section
755-shall be performed at the owner's expense.
756-Sec. 23. Section 22-319b of the general statutes is repealed and the
757-following is substituted in lieu thereof (Effective from passage):
758-(a) Any person, firm or corporation engaged in the growing of swine
759-that are to be used or disposed of elsewhere than on the premises where
760-such swine are grown shall register with the [Commissioner of
761-Agriculture] commissioner on forms furnished by the commissioner.
762-The commissioner may make orders and adopt regulations, in
763-accordance with the provisions of chapter 54, concerning examination,
764-quarantine, disinfection, preventive treatment, disposition, Substitute House Bill No. 6726

583+of all animals purchased within the state and delivered to such 475

770-at once, cause an investigation of all cases of such diseases coming to the
771-commissioner's knowledge and shall use all proper means to
772-exterminate and prevent spread of the same. Instructions shall be
773-issued, in writing, by the commissioner or the commissioner's agent that
774-shall contain directions for quarantine and disinfection of the premises
775-where such disease exists. [No swine shall be brought into Connecticut
776-by any individual, corporation or common carrier, unless the same
777-originate from a herd that is validated as brucellosis-free and qualified
778-pseudorabies-negative, and are accompanied by a permit issued by the
779-commissioner and an official health certificate showing such animals to
780-be free from any contagious or infectious disease, except that swine
781-brought into this state for the purpose of immediate slaughter upon
782-premises where federal inspection is maintained need not be
783-accompanied by an official health certificate and the owner of each
784-establishment where federal inspection is maintained shall report
785-weekly to the commissioner, upon forms furnished by the
786-commissioner, the number of such swine imported. Such permit shall
787-accompany all waybills or, if animals are driven or carted over
788-highways, shall be in the possession of the person in charge of swine. In
789-addition to any other requirements of this section, all swine imported
790-for other than immediate slaughter that are over three months of age,
791-other than barrows, shall be negative as to a blood test for brucellosis
792-and pseudorabies within thirty days of importation. With approval of
793-the State Veterinarian, a thirty-day blood test may not be required for
794-swine originating from, and residing for at least thirty days prior to
795-importation in, a state that is validated as brucellosis-free and stage V
796-pseudorabies-free, or for swine originating from any herd which the
797-State Veterinarian determines to be pathogen-free. With such approval,
798-swine may be imported pursuant to an import permit and a current
799-official health certificate. All swine brought into the state for immediate
800-slaughter shall be killed in an approved slaughterhouse under Substitute House Bill No. 6726

805-(b) Any person, firm or corporation engaged in breeding swine in this
806-state shall have all breeding swine tested for brucellosis and
807-pseudorabies. Such testing shall be performed by an accredited
808-veterinarian, a veterinarian employed by the USDA, or the department
809-or an employee employed by the department, under supervision of the
810-State Veterinarian. The owner of any herd or animal to be so tested shall
811-provide assistance and proper restraint for confining the animals for and
812-during the application and diagnosis of said test. The state shall not be
813-liable for any damages incurred or alleged to have been incurred from
814-such test. Testing for brucellosis shall comply with section 22-298, as
815-amended by this act. The procedures for testing for pseudorabies and
816-the control and disposition of pseudorabies positive swine shall
817-conform to the USDA, pseudorabies eradication program standards.
818-(c) All swine imported into this state shall be accompanied by an
819-import permit required pursuant to section 22-308, as amended by this
820-act, and a certificate of veterinary inspection issued by an accredited
821-veterinarian not more than thirty days prior to entry into this state and
822-that includes the dates and results of any tests required by this section,
823-the official identification of each swine and certification that each swine
824-originated from a: (1) Brucellosis validated free herd, provided the herd
825-number, the date of the last whole herd negative brucellosis test that
826-includes the swine being imported shall be recorded on the certificate of
827-veterinary inspection, or, in the alternative, each swine over three
828-months of age shall have been tested and found negative for brucellosis
829-not more than thirty days prior to such entry; and (2) pseudorabies
830-qualified free herd, provided the number and date of the last whole herd
831-negative test that includes the swine being imported shall be recorded
832-on the certificate of veterinary inspection, or, in the alternative, each
833-swine shall have been tested and found negative for pseudorabies not
834-more than thirty days prior to such entry. Barrows shall be exempt from Substitute House Bill No. 6726
613+(b) Not later than forty-eight hours after imported livestock arrives at 499
614+the destination for such livestock in this state, the owner of such 500
615+livestock shall complete and return the import permit to the 501
616+commissioner and report the number of each species imported and 502
617+include a copy of the certificate of veterinary inspection that 503
618+accompanied the livestock into this state. 504
619+(c) The commissioner may refuse to grant a livestock import permit 505
620+to any person, or any officer or agent of any corporation, who violates 506
621+any statute or regulation governing the importation of livestock. 507
622+Whenever an import permit is refused or revoked, the commissioner 508
623+shall notify such person importing the livestock of the violations and 509
624+corrections necessary and, after making corrections, such person may 510
625+reapply for a livestock import permit. 511
626+(d) Livestock brought into this state: (1) For the purpose of immediate 512
627+slaughter upon premises where federal inspection is maintained, (2) to 513
628+a slaughter facility approved by the commissioner, or (3) to a licensed 514
629+livestock commission sales stable authorized to handle out-of-state 515
630+livestock by the USDA and the State Veterinarian, shall be exempt from 516
631+the provisions of subsection (a) of this section, provided all such 517
632+livestock transported into this state are accompanied with an owner-518
633+shipper statement that shall include the following: (A) The name and 519
634+address of the consignor and the consignee; (B) the point of origin of 520
635+such livestock and identification of the premises that is the destination 521
636+for such livestock; (C) the date of entry into the state and a statement 522
637+that all livestock are consigned for immediate slaughter; (D) a listing of 523
638+official identification of each animal, as required in subsection (a) of this 524
639+section; and (E) the signature of the shipper certifying that the animals 525
640+are imported for slaughter only. 526
641+(e) Any person who transports livestock or equines into this state for 527
642+exhibition or competition purposes may obtain an exhibition permit 528
643+from the commissioner prior to entering the state. Livestock or equines 529
644+listed in the exhibition permit and on the certificate of veterinary 530
645+inspection shall be exempt from the requirement for a new certificate of 531 Substitute Bill No. 6726

839-Sec. 24. Section 22-320a of the general statutes is repealed and the
840-following is substituted in lieu thereof (Effective from passage):
841-As used in [sections 22-320a] this section and sections 22-320b to 22-
842-320h, inclusive:
843-[(a) "Department" means the Department of Agriculture;
844-(b) "Commissioner" means the Commissioner of Agriculture;
845-(c) "Person" means the state or any political subdivision thereof, or
846-any institution, public or private, any corporation, any limited liability
847-company, any individual or any partnership;
848-(d)] (1) "Garbage" means any material containing meat resulting from
849-the handling, preparation, cooking and consumption of foods including
850-animal carcasses or parts thereof. [, but the term "garbage" shall]
851-"Garbage" does not [apply to] include waste materials from
852-slaughterhouses [which] that go directly to rendering plants for
853-processing; and
854-[(e)] (2) "Garbage-feeding swine farm" includes all premises on which
855-one or more swine are maintained and are fed garbage.
856-Sec. 25. Section 22-321 of the general statutes is repealed and the
857-following is substituted in lieu thereof (Effective from passage):
858-(a) Any person, or any officer or agent of any corporation, who
859-violates any provision of this chapter for which no other penalty is
860-provided, [or] who obstructs or attempts to obstruct the [Commissioner
861-of Agriculture or his deputy or any of his assistants] commissioner, an
862-authorized agent of the commissioner or an employee of the department
863-in the performance of [his duty] a duty established in this chapter, or
864-who violates any regulation established by said commissioner, shall be Substitute House Bill No. 6726

653+permit. All tests required pursuant to this chapter and chapter 438a, as 533
654+applicable, to qualify for importation shall be listed on the certificate of 534
655+veterinary inspection and shall be kept current for the duration of the 535
656+exhibition permit. Exhibition permits shall expire six months after the 536
657+date of issuance. 537
658+Sec. 14. Section 22-309 of the general statutes is repealed and the 538
659+following is substituted in lieu thereof (Effective from passage): 539
660+The commissioner may refuse to grant permits to import animals 540
661+from any and all sections or areas [which in his opinion] that the 541
662+commissioner determines are infected with a contagious disease, and 542
663+[he] the commissioner may, at any time, revoke any permit previously 543
664+issued and then outstanding, for the importation into this state of 544
665+animals [which] that in [his] the commissioner's opinion are infected, 545
666+and all damages caused or claimed to have been caused by such 546
667+revocation shall be borne by the owner. All [neat cattle and goats] 547
668+livestock entering the state shall be identified by [ear tags, registration 548
669+name or number, tattoo or other markings approved by the 549
670+commissioner] official identification. 550
671+Sec. 15. (NEW) (Effective from passage) (a) No person shall import, or 551
672+cause to be imported, into this state any livestock that is under any state 552
673+or federal quarantine due to the presence of, or the suspected presence 553
674+of, an infectious or contagious disease. 554
675+(b) No person shall import, or cause to be imported, into this state 555
676+any livestock that is infected with, or has been exposed to, any infectious 556
677+or contagious disease including, but not limited to, tuberculosis, 557
678+brucellosis, anaplasmosis, psoroptic scabies, chronic wasting disease, 558
679+bovine spongiform encephalopathy, hog cholera, pseudorabies, rabies 559
680+or scrapie. 560
681+(c) No person shall import, or cause to be imported, into this state any 561
682+livestock unless an import permit issued pursuant to section 22-308 of 562 Substitute Bill No. 6726

868-fined two hundred fifty dollars for a first such violation or obstruction
869-and for any such second violation or obstruction shall be guilty of a class
870-D misdemeanor.
871-(b) Any person who misleads or attempts to mislead the
872-commissioner by removing or altering the official identification of any
873-livestock or by falsifying a certificate of veterinary inspection shall be
874-fined two hundred fifty dollars for a first such violation and shall be
875-guilty of a class D misdemeanor for any second or subsequent such
876-violation.
877-Sec. 26. (NEW) (Effective from passage) Any laboratory or veterinarian
878-that conducts testing of livestock or poultry in this state shall notify the
879-State Veterinarian, on forms or in a manner prescribed by the
880-Commissioner of Agriculture, of any positive test results for any
881-notifiable or reportable disease pursuant to section 22-26f of the general
882-statutes. Such notification shall be made not later than twenty-four
883-hours after receipt of any such results. Any person who violates this
884-section for a first violation shall be subject to an administrative civil
885-penalty, issued pursuant to section 22-7 of the general statutes, of not
886-more than five hundred dollars, and for any such second or subsequent
887-violation, not more than one thousand dollars.
888-Sec. 27. Subsection (a) of section 22-277 of the general statutes is
889-repealed and the following is substituted in lieu thereof (Effective from
890-passage):
891-(a) As used in this section, "livestock animal" means any camelid or
892-hooved animal raised for domestic or commercial use. The
893-Commissioner of Agriculture shall supervise commission sales stables
894-where livestock animals are sold at public auctions. Any person, firm or
895-corporation engaged in the business of selling livestock animals at such
896-auctions or sales shall annually apply to said commissioner for a license
897-upon a form to be prescribed by the commissioner. The fee for each such Substitute House Bill No. 6726

901-license shall be one hundred ninety dollars, payable to said
902-commissioner. Each such license shall be issued for the period of one
903-year from July first and may be revoked for cause. If, in the judgment of
904-the commissioner, any provision of this section has been violated, the
905-commissioner shall send notice by registered or certified mail to the
906-licensee, who shall be given a hearing, and, if violation is proven, the
907-license shall be revoked. If a license to deal in livestock, issued to any
908-person, firm or corporation by another state, has been suspended or
909-revoked by such state within five years next preceding the date of
910-issuance or renewal of a license to such person, firm or corporation
911-under the provisions of this section, such suspension or revocation shall
912-constitute just cause for revocation under this section. All dairy animals
913-to be sold at such auction shall be segregated from beef animals prior to
914-such sales. The sale of dairy animals shall precede the sale of those
915-assigned for slaughter. All bovines more than three hundred pounds in
916-weight, except dairy and breeding animals, that are delivered to a sale
917-shall be branded with the letter "S" in a conspicuous place or identified
918-in a manner acceptable to the commissioner or the commissioner's
919-designee by the operator of the sale or the operator's representative. All
920-dairy and breeding animals from within the state arriving at a sale shall
921-be from a herd that: (1) Is under state supervision for the control of
922-brucellosis and tuberculosis and that has been tested for brucellosis and
923-tuberculosis less than fourteen months before the sale, (2) has been
924-tested for tuberculosis less than fourteen months before the sale and is
925-regularly tested under the brucellosis ring test program of the
926-Department of Agriculture, or (3) is certified to be brucellosis-free under
927-the program established pursuant to section 22-299a. All dairy and
928-breeding animals which are not cosigned for immediate slaughter,
929-arriving at a sale from outside the state shall comply with [section 22-
930-304] chapter 433 and be accompanied by a health certificate issued by
931-the livestock official of the state of their origin and by an import permit
932-from the commissioner or, alternatively, such dairy or breeding animals
933-shall be examined by a licensed accredited veterinarian who shall issue Substitute House Bill No. 6726
689+the general statutes, as amended by this act, is obtained and each animal 563
690+is accompanied by a certificate of veterinary inspection issued by an 564
691+accredited veterinarian certifying that each animal has been inspected, 565
692+is not showing signs of infectious or contagious diseases, and has been 566
693+tested in accordance with the requirements of chapter 433 of the general 567
694+statutes. 568
695+(d) Livestock imported into this state for movement directly to 569
696+slaughter at a facility under a grant of inspection from the United States 570
697+Department of Agriculture, or approved by the commissioner, are 571
698+exempt from subsection (c) of this section provided such livestock are 572
699+accompanied by the owner-shipper statement required pursuant to 573
700+subsection (d) of section 22-308 of the general statutes, as amended by 574
701+this act. No such livestock shall be sold or transferred live to any person, 575
702+firm or corporation. 576
703+Sec. 16. (NEW) (Effective from passage) All cattle or bison imported into 577
704+this state shall be accompanied by an import permit required pursuant 578
705+to section 22-308 of the general statutes, as amended by this act, and a 579
706+certificate of veterinary inspection issued by an accredited veterinarian 580
707+thirty days or less prior to entry to the state that includes the dates and 581
708+results of any tests required by this section, the official identification of 582
709+each animal and certification that such cattle or bison meet the following 583
710+requirements: (1) They originated from a herd that was negative to a 584
711+whole herd tuberculin test performed not more than twelve months 585
712+prior to such entry into this state and each imported animal was 586
713+included in such whole herd test or tested negative to a tuberculosis test 587
714+performed not more than sixty days prior to entry into this state, and (2) 588
715+for bulls and non-brucellosis vaccinated female cattle six months of age 589
716+and older and for official calfhood vaccinates eighteen months of age 590
717+and older, that they are negative to an official test for brucellosis that 591
718+was performed not more than thirty days prior to entry into this state. 592
719+Spayed heifers and steers imported as feeder cattle are exempt from 593
720+such brucellosis testing. Cattle and bison vaccinated as adults for 594
721+brucellosis are not eligible for entry into the state. Cattle and bison that 595 Substitute Bill No. 6726

937-an interstate health certificate for such animal at the expense of the
938-licensee. All animals offered for dairy or breeding purposes shall be
939-identified by an official ear tag, or by a breed registration number if
940-accompanied by the corresponding breed registration certificate.
941-Animals consigned for slaughter shall be sold only to owners or agents
942-of slaughtering establishments and moved directly to such slaughtering
943-establishments for immediate slaughter or slaughter that occurs not
944-later than seventy-two hours after the time of sale. All stables and sales
945-rings shall be kept clean and shall be suitably disinfected prior to each
946-sale. The provisions of this section shall not apply to the sale of an
947-individual herd at an auction conducted by the owner thereof. Any
948-person, or any officer or agent of any corporation, who violates any
949-provision of this section or who obstructs or attempts to obstruct the
950-Commissioner of Agriculture or the commissioner's deputy or assistants
951-in the performance of their duty, shall be guilty of a class D
952-misdemeanor.
953-Sec. 28. Subsection (c) of section 22-342 of the general statutes, as
954-amended by section 3 of public act 23-17, is repealed and the following
955-substituted in lieu thereof (Effective from passage):
956-(c) The commissioner, the Chief Animal Control Officer or any state
957-animal control officer may at any time inspect any kennel including all
958-facilities of any kennel in which dogs are bred or housed or cause it to
959-be inspected by a Connecticut licensed veterinarian appointed by the
960-commissioner. If, in the judgment of the commissioner, such kennel is
961-not being maintained in good repair and in a sanitary and humane
962-manner or if the commissioner finds that communicable or infectious
963-disease or other unsatisfactory conditions exist in the kennel, he may
964-issue such orders as he deems necessary for the correction of such
965-conditions and may quarantine the premises and animals. If the owner
966-or keeper of such kennel fails to comply with such orders, the
967-commissioner shall revoke or suspend the kennel license of such owner Substitute House Bill No. 6726

734+certificate of veterinary inspection issued by an accredited veterinarian 602
735+not more than thirty days prior to entry into this state that includes the 603
736+dates and results of any required tests, the official identification of each 604
737+animal and certification that the sheep listed on the certificate of 605
738+veterinary inspection have not been exposed to scrapie. 606
739+Sec. 18. (NEW) (Effective from passage) Any goat imported into this 607
740+state shall be accompanied by an import permit required pursuant to 608
741+section 22-308 of the general statutes, as amended by this act, and a 609
742+certificate of veterinary inspection issued by an accredited veterinarian 610
743+not more than thirty days prior to entry into this state that includes: (1) 611
744+The dates and results of any tests required by this section, (2) the official 612
745+identification of each animal, and (3) certification that any goat listed on 613
746+the certificate of veterinary inspection has not been exposed to scrapie. 614
747+Additionally, any such goat shall meet the following requirements: (A) 615
748+They shall originate from a herd where they were included in a whole 616
749+herd with negative tuberculosis tests administered not more than 617
750+twelve months prior to such entry, (B) any such goat over three months 618
751+of age shall have tested negative to a tuberculin test not more than sixty 619
752+days prior to such entry, and (C) any goat over three months of age shall 620
753+have tested negative for brucellosis not more than thirty days prior to 621
754+such entry. Any kid goat under three months of age may be imported 622
755+on the dam's test chart if the dam was brucellosis tested and found 623
756+negative not more than twelve months prior to such entry and a copy of 624
757+such test result is provided to the commissioner. Any wether shall be 625
758+exempt from such brucellosis testing. 626
759+Sec. 19. (NEW) (Effective from passage) Any camelid imported into this 627
760+state shall be accompanied by an import permit required pursuant to 628 Substitute Bill No. 6726

971-or keeper. [Each] On or after July 1, 2023, each such kennel [shall] may
972-be inspected annually by an animal control officer appointed pursuant
973-to section 22-331 or 22-331a with jurisdiction in the municipality in
974-which such kennel is located, or upon receipt of any complaint about
975-such kennel. Such inspection shall include an evaluation of: (1) The
976-sanitary conditions in which the dogs are kept, (2) the dogs' access to
977-proper and wholesome food, potable water, exercise and veterinary care
978-when necessary, including rabies vaccinations, and (3) records of
979-veterinary care and records of the transfer of dogs or puppies to new
980-owners. Any crate or other enclosure in which any dog is kept for more
981-than four hours shall be clean and in good repair, such that the crate or
982-enclosure does not pose a hazard to the dog, and shall be of sufficient
983-size as to allow the dogs to stand, sit, lie down, turn around and make
984-normal postural movements. If any animal control officer finds
985-conditions exist in such kennel that may adversely affect the health,
986-safety or welfare of any dog, such animal control officer may issue such
987-orders as are necessary for the correction of such conditions. If such
988-animal control officer suspects a communicable or infectious disease is
989-present, such officer may order the licensee to consult a Connecticut
990-licensed veterinarian at such licensee's expense to address the suspected
991-health condition. The licensee shall implement any order of the animal
992-control officer to correct any condition that may adversely affect the
993-health, safety or welfare of any such dog, and shall follow any
994-recommendation of such veterinarian, as applicable. A municipality
995-may suspend, revoke or refuse to issue any local kennel license under
996-this section for cause.
997-Sec. 29. Sections 22-284, 22-304, 22-318, 22-318b, 22-291 to 22-293,
998-inclusive, and 22-310 to 22-313, inclusive, of the general statutes are
999-repealed. (Effective from passage)

774+six months of age or older, test negative for brucellosis not more than 636
775+thirty days prior to such entry. 637
776+Sec. 20. (NEW) (Effective from passage) All cervidae imported into this 638
777+state shall be accompanied by an import or exhibition permit required 639
778+pursuant to section 22-308 of the general statutes, as amended by this 640
779+act, and a certificate of veterinary inspection that verifies compliance 641
780+with the provisions of section 26-57a of the general statutes and any 642
781+regulations adopted pursuant to said section. 643
782+Sec. 21. Section 22-316 of the general statutes is repealed and the 644
783+following is substituted in lieu thereof (Effective from passage): 645
784+[All cattle or goats found to be affected with a communicable disease 646
785+shall be killed and the carcasses disposed of and premises disinfected in 647
786+accordance with the order of the Commissioner of Agriculture and at 648
787+the expense of the owner.] All carcasses of diseased livestock 649
788+condemned pursuant to this chapter shall be disposed of in a manner 650
789+acceptable to the commissioner. The premises shall be disinfected in a 651
790+manner acceptable to the commissioner before livestock are 652
791+reintroduced to such premises. 653
792+Sec. 22. Section 22-318a of the general statutes is repealed and the 654
793+following is substituted in lieu thereof (Effective from passage): 655
794+Any herd owner, auctioneer, [cattle] livestock dealer or sales 656
795+manager, who contemplates a complete dispersal sale of a herd or a sale 657
796+in which more than ten head is to be sold in a group shall furnish a list 658
797+of animals to be sold to the [Commissioner of Agriculture] 659 Substitute Bill No. 6726

808+dealer or sales manager shall conduct a dispersal sale without the 664
809+approval of the commissioner. The [commissioner may, in his 665
810+discretion,] State Veterinarian may require such herd to be [tuberculin 666
811+or brucellosis tested, or both,] tested for diseases, as the State 667
812+Veterinarian determines are necessary, before such sale. If such herd has 668
813+been tested or is tested in accordance with the provisions of this section 669
814+[and is found negative to both tests, or a permit has been issued by the 670
815+commissioner in accordance with the provisions of section 22-303] and 671
816+is found negative, permission shall be granted for said sale. [These tests 672
817+shall be applied as private tests if not a routine test assignment. Any 673
818+person who violates any provision of this section shall be fined not more 674
819+than one hundred dollars.] Any test required pursuant to this section 675
820+shall be performed at the owner's expense. 676
821+Sec. 23. Section 22-319b of the general statutes is repealed and the 677
822+following is substituted in lieu thereof (Effective from passage): 678
823+(a) Any person, firm or corporation engaged in the growing of swine 679
824+that are to be used or disposed of elsewhere than on the premises where 680
825+such swine are grown shall register with the [Commissioner of 681
826+Agriculture] commissioner on forms furnished by the commissioner. 682
827+The commissioner may make orders and adopt re gulations, in 683
828+accordance with the provisions of chapter 54, concerning examination, 684
829+quarantine, disinfection, preventive treatment, disposition, 685
830+transportation, importation, feeding and sanitation for the protection of 686
831+swine from contagious and infectious disease. Said commissioner shall, 687
832+at once, cause an investigation of all cases of such diseases coming to the 688
833+commissioner's knowledge and shall use all proper means to 689
834+exterminate and prevent spread of the same. Instructions shall be 690
835+issued, in writing, by the commissioner or the commissioner's agent that 691
836+shall contain directions for quarantine and disinfection of the premises 692 Substitute Bill No. 6726

843+where such disease exists. [No swine shall be brought into Connecticut 693
844+by any individual, corporation or common carrier, unless the same 694
845+originate from a herd that is validated as brucellosis-free and qualified 695
846+pseudorabies-negative, and are accompanied by a permit issued by the 696
847+commissioner and an official health certificate showing such animals to 697
848+be free from any contagious or infectious disease, except that swine 698
849+brought into this state for the purpose of immediate slaughter upon 699
850+premises where federal inspection is maintained need not be 700
851+accompanied by an official health certificate and the owner of each 701
852+establishment where federal inspection is maintained shall report 702
853+weekly to the commissioner, upon forms furnished by the 703
854+commissioner, the number of such swine imported. Such permit shall 704
855+accompany all waybills or, if animals are driven or carted over 705
856+highways, shall be in the possession of the person in charge of swine. In 706
857+addition to any other requirements of this section, all swine imported 707
858+for other than immediate slaughter that are over three months of age, 708
859+other than barrows, shall be negative as to a blood test for brucellosis 709
860+and pseudorabies within thirty days of importation. With approval of 710
861+the State Veterinarian, a thirty-day blood test may not be required for 711
862+swine originating from, and residing for at least thirty days prior to 712
863+importation in, a state that is validated as brucellosis-free and stage V 713
864+pseudorabies-free, or for swine originating from any herd which the 714
865+State Veterinarian determines to be pathogen-free. With such approval, 715
866+swine may be imported pursuant to an import permit and a current 716
867+official health certificate. All swine brought into the state for immediate 717
868+slaughter shall be killed in an approved slaughterhouse under 718
869+veterinary inspection.] 719
870+(b) Any person, firm or corporation engaged in breeding swine in this 720
871+state shall have all breeding swine tested for brucellosis and 721
872+pseudorabies. Such testing shall be performed by an accredited 722
873+veterinarian, a veterinarian employed by the USDA, or the department 723
874+or an employee employed by the department, under supervision of the 724
875+State Veterinarian. The owner of any herd or animal to be so tested shall 725
876+provide assistance and proper restraint for confining the animals for and 726 Substitute Bill No. 6726
877+

883+during the application and diagnosis of said test. The state shall not be 727
884+liable for any damages incurred or alleged to have been incurred from 728
885+such test. Testing for brucellosis shall comply with section 22-298, as 729
886+amended by this act. The procedures for testing for pseudorabies and 730
887+the control and disposition of pseudorabies positive swine shall 731
888+conform to the USDA, pseudorabies eradication program standards. 732
889+(c) All swine imported into this state shall be accompanied by an 733
890+import permit required pursuant to section 22-308, as amended by this 734
891+act, and a certificate of veterinary inspection issued by an accredited 735
892+veterinarian not more than thirty days prior to entry into this state and 736
893+that includes the dates and results of any tests required by this section, 737
894+the official identification of each swine and certification that each swine 738
895+originated from a: (1) Brucellosis validated free herd, provided the herd 739
896+number, the date of the last whole herd negative brucellosis test that 740
897+includes the swine being imported shall be recorded on the certificate of 741
898+veterinary inspection, or, in the alternative, each swine over three 742
899+months of age shall have been tested and found negative for brucellosis 743
900+not more than thirty days prior to such entry; and (2) pseudorabies 744
901+qualified free herd, provided the number and date of the last whole herd 745
902+negative test that includes the swine being imported shall be recorded 746
903+on the certificate of veterinary inspection, or, in the alternative, each 747
904+swine shall have been tested and found negative for pseudorabies not 748
905+more than thirty days prior to such entry. Barrows shall be exempt from 749
906+such brucellosis testing. 750
907+Sec. 24. Section 22-320a of the general statutes is repealed and the 751
908+following is substituted in lieu thereof (Effective from passage): 752
909+As used in [sections 22-320a] this section and sections 22-320b to 22-753
910+320h, inclusive: 754
911+[(a) "Department" means the Department of Agriculture; 755
912+(b) "Commissioner" means the Commissioner of Agriculture; 756
913+(c) "Person" means the state or any political subdivision thereof, or 757 Substitute Bill No. 6726

921+company, any individual or any partnership; 759
922+(d)] (1) "Garbage" means any material containing meat resulting from 760
923+the handling, preparation, cooking and consumption of foods including 761
924+animal carcasses or parts thereof. [, but the term "garbage" shall] 762
925+"Garbage" does not [apply to] include waste materials from 763
926+slaughterhouses [which] that go directly to rendering plants for 764
927+processing; and 765
928+[(e)] (2) "Garbage-feeding swine farm" includes all premises on which 766
929+one or more swine are maintained and are fed garbage. 767
930+Sec. 25. Section 22-321 of the general statutes is repealed and the 768
931+following is substituted in lieu thereof (Effective from passage): 769
932+(a) Any person, or any officer or agent of any corporation, who 770
933+violates any provision of this chapter for which no other penalty is 771
934+provided, [or] who obstructs or attempts to obstruct the [Commissioner 772
935+of Agriculture or his deputy or any of his assistants] commissioner, an 773
936+authorized agent of the commissioner or an employee of the department 774
937+in the performance of [his duty] a duty established in this chapter, or 775
938+who violates any regulation established by said commissioner, shall be 776
939+fined two hundred fifty dollars for a first such violation or obstruction 777
940+and for any such second violation or obstruction shall be guilty of a class 778
941+D misdemeanor. 779
942+(b) Any person who misleads or attempts to mislead the 780
943+commissioner by removing or altering the official identification of any 781
944+livestock or by falsifying a certificate of veterinary inspection shall be 782
945+fined two hundred fifty dollars for a first such violation and shall be 783
946+guilty of a class D misdemeanor for any second or subsequent such 784
947+violation. 785
948+Sec. 26. (NEW) (Effective from passage) Any laboratory or veterinarian 786
949+that conducts testing of livestock or poultry in this state shall notify the 787
950+State Veterinarian, on forms or in a manner prescribed by the 788 Substitute Bill No. 6726

957+Commissioner of Agriculture, of any positive test results for any 789
958+notifiable or reportable disease pursuant to section 22-26f of the general 790
959+statutes. Such notification shall be made not later than twenty-four 791
960+hours after receipt of any such results. Any person who violates this 792
961+section for a first violation shall be subject to an administrative civil 793
962+penalty, issued pursuant to section 22-7 of the general statutes, of not 794
963+more than five hundred dollars, and for any such second or subsequent 795
964+violation, not more than one thousand dollars. 796
965+Sec. 27. (NEW) (Effective October 1, 2023) The Commissioner of 797
966+Agriculture shall be the state official in charge of inspecting any 798
967+producer and any producer that also operates as a rabbit processing 799
968+facility. Any inspection conducted pursuant to this section by the 800
969+commissioner, or the commissioner's designated agent, shall be 801
970+consistent with the requirements of any applicable provision of the 802
971+Code of Federal Regulations, including, but not limited to, any health, 803
972+sanitary and safety-related provision. Rabbit processing facilities that 804
973+have passed Department of Agriculture facility inspections pursuant to 805
974+this section shall be designated as approved food sources for household 806
975+consumers, restaurants, hotels, boarding houses and retail food 807
976+establishments. For purposes of this section, "producer" means any 808
977+person, firm or corporation engaged in the breeding, raising or keeping 809
978+of not more than one thousand rabbits in a calendar year for the purpose 810
979+of food production. 811
980+Sec. 28. Subsection (a) of section 22-277 of the general statutes is 812
981+repealed and the following is substituted in lieu thereof (Effective from 813
982+passage): 814
983+(a) As used in this section, "livestock animal" means any camelid or 815
984+hooved animal raised for domestic or commercial use. The 816
985+Commissioner of Agriculture shall supervise commission sales stables 817
986+where livestock animals are sold at public auctions. Any person, firm or 818
987+corporation engaged in the business of selling livestock animals at such 819
988+auctions or sales shall annually apply to said commissioner for a license 820
989+upon a form to be prescribed by the commissioner. The fee for each such 821 Substitute Bill No. 6726

996+license shall be one hundred ninety dollars, payable to said 822
997+commissioner. Each such license shall be issued for the period of one 823
998+year from July first and may be revoked for cause. If, in the judgment of 824
999+the commissioner, any provision of this section has been violated, the 825
1000+commissioner shall send notice by registered or certified mail to the 826
1001+licensee, who shall be given a hearing, and, if violation is proven, the 827
1002+license shall be revoked. If a license to deal in livestock, issued to any 828
1003+person, firm or corporation by another state, has been suspended or 829
1004+revoked by such state within five years next preceding the date of 830
1005+issuance or renewal of a license to such person, firm or corporation 831
1006+under the provisions of this section, such suspension or revocation shall 832
1007+constitute just cause for revocation under this section. All dairy animals 833
1008+to be sold at such auction shall be segregated from beef animals prior to 834
1009+such sales. The sale of dairy animals shall precede the sale of those 835
1010+assigned for slaughter. All bovines more than three hundred pounds in 836
1011+weight, except dairy and breeding animals, that are delivered to a sale 837
1012+shall be branded with the letter "S" in a conspicuous place or identified 838
1013+in a manner acceptable to the commissioner or the commissioner's 839
1014+designee by the operator of the sale or the operator's representative. All 840
1015+dairy and breeding animals from within the state arriving at a sale shall 841
1016+be from a herd that: (1) Is under state supervision for the control of 842
1017+brucellosis and tuberculosis and that has been tested for brucellosis and 843
1018+tuberculosis less than fourteen months before the sale, (2) has been 844
1019+tested for tuberculosis less than fourteen months before the sale and is 845
1020+regularly tested under the brucellosis ring test program of the 846
1021+Department of Agriculture, or (3) is certified to be brucellosis-free under 847
1022+the program established pursuant to section 22-299a. All dairy and 848
1023+breeding animals arriving at a sale from outside the state shall comply 849
1024+with [section 22-304] chapter 433 and be accompanied by a health 850
1025+certificate issued by the livestock official of the state of their origin and 851
1026+by an import permit from the commissioner. All animals offered for 852
1027+dairy or breeding purposes shall be identified by an official ear tag, or 853
1028+by a breed registration number if accompanied by the corresponding 854
1029+breed registration certificate. Animals consigned for slaughter shall be 855
1030+sold only to owners or agents of slaughtering establishments and moved 856 Substitute Bill No. 6726

1037+directly to such slaughtering establishments for immediate slaughter or 857
1038+slaughter that occurs not later than seventy-two hours after the time of 858
1039+sale. All stables and sales rings shall be kept clean and shall be suitably 859
1040+disinfected prior to each sale. The provisions of this section shall not 860
1041+apply to the sale of an individual herd at an auction conducted by the 861
1042+owner thereof. Any person, or any officer or agent of any corporation, 862
1043+who violates any provision of this section or who obstructs or attempts 863
1044+to obstruct the Commissioner of Agriculture or the commissioner's 864
1045+deputy or assistants in the performance of their duty, shall be guilty of 865
1046+a class D misdemeanor. 866
1047+Sec. 29. Sections 22-284, 22-304, 22-318, 22-318b, 22-291 to 22-293, 867
1048+inclusive, and 22-310 to 22-313, inclusive, of the general statutes are 868
1049+repealed. (Effective from passage) 869
