1219 AN ACT IMPLEMENTING THE RECOMMENDATIONS OF THE
1320 CONNECTICUT AIRPORT AUTHORITY.
1421 Be it enacted by the Senate and House of Representatives in General

1724 Section 1. Section 13b-39a of the general statutes is repealed and the 1
1825 following is substituted in lieu thereof (Effective July 1, 2023): 2
1926 [(a) The executive director of the Connecticut Airport Authority shall 3
2027 establish a program of registration for all aircraft in the state, in 4
2128 accordance with which the] The owner of any aircraft, as defined in 5
2229 subdivision (5) of section 15-34, which is based or primarily used at any 6
2330 airport facility, heliport, air navigation facility, restricted landing area 7
2431 or seaplane base in a municipality within this state shall, not later than 8
2532 October 1, 1993, and annually thereafter, be required to register with the 9
2633 municipality in which such aircraft is based or primarily used, by filing 10
2734 an application form, or renewal thereof, and paying the appropriate 11
2835 registration fee, as provided for in section 12-71, this section and section 12
2936 13b-39b, as amended by this act. The owner of any aircraft which is 13

4349 [(b) The executive director, subject to the provisions of section 1-121, 21
4450 shall adopt such rules and procedures as deemed necessary by said 22

4652 section and sections 13b-39b to 13b-39g, inclusive.] 24
4753 Sec. 2. Section 13b-39b of the general statutes is repealed and the 25
4854 following is substituted in lieu thereof (Effective July 1, 2023): 26
4955 The executive director of the Connecticut Airport Authority shall 27
5056 prepare and distribute to each municipality in which aircraft are based 28
5157 or primarily used, forms and decals for the registration of aircraft and 29
5258 the renewal of such registrations. [The registration forms shall contain 30
5359 such information as the authority may prescribe, including, but not 31
5460 limited to, information concerning (1) the form and identity of 32
5561 ownership, including information as to whether such ownership is by 33
5662 an individual, partnership, corporation or other entity, (2) the type of 34
5763 aircraft, including the year of manufacture, the manufacturer, the model 35
5864 and the certified gross weight, (3) the Federal Aviation Certificate 36
5965 number, and (4) the location at which such aircraft is based or primarily 37
6066 used in this state.] Each municipality shall designate a municipal 38
6167 registration official who may be an official or employee of the 39
6268 municipality or of any airport facility, heliport or seaplane base located 40
6369 within the municipality, to utilize the information obtained pursuant to 41
64-section 13b-49a, as amended by this act, and perform the duties of 42
65-registration of aircraft as set forth in sections 13b-39a to 13b-39g, 43
66-inclusive, as amended by this act, and shall furnish to the executive 44
67-director, in writing, the name, address and telephone number of each 45
68-such official. The municipality shall immediately notify the executive 46
69-director upon any changes relative to the municipal registration official. 47

88-Aircraft manufactured before 1946 shall pay the lesser of one hundred 53
89-dollars or the fee as required on the basis of gross weight as set forth in 54
90-this section. [The executive director may establish, by procedures 55
91-adopted in accordance with the provisions of section 1-121, a uniform 56
92-schedule for the expiration and renewal of registrations and may 57
93-prorate the fees in this section accordingly.] Any person or firm that 58

96101 provided no additional registration fee shall be payable in cases where 61
97102 one or more new ownership interests are being added to the registration 62
98103 or in cases of legal change of name of the registrant. All registrations 63
99104 shall be renewed within thirty days of the date of expiration as stated in 64
100105 the certificate. If a valid certificate or number decal is lost, mutilated or 65
101106 destroyed, the aircraft owner shall notify the municipal registration 66
102107 official within fifteen days, and such owner shall be issued a duplicate 67
103108 certificate or number decal upon payment of a fee of five dollars. 68
104109 Sec. 4. Section 13b-39g of the general statutes is repealed and the 69
105110 following is substituted in lieu thereof (Effective July 1, 2023): 70

118122 shall furnish the executive director with [such reports] a report 77
119123 concerning [the total amount of fees received pursuant to sections 12-71 78
120124 and 13b-39a to 13b-39g, inclusive,] the number of registrations issued, 79
121125 the names of registrants and the descriptions of aircraft registered 80
122126 during the preceding calendar year. 81
123127 Sec. 5. Section 13b-50 of the general statutes is repealed and the 82
124128 following is substituted in lieu thereof (Effective July 1, 2023): 83
125129 (a) The executive director of the Connecticut Airport Authority is 84
126130 authorized to cooperate with the government of the United States or any 85
127131 agency or department thereof in the acquisition, construction, 86
128132 improvement, maintenance and operation of airports, heliports, landing 87
129133 fields and other aeronautical facilities in this state where federal 88
130134 financial aid is received and to comply with the provisions of the laws 89
131135 of the United States and any regulations made thereunder for the 90
132136 expenditure of federal moneys upon such airports, heliports and 91
133137 facilities. The executive director is authorized to accept, receive and 92
134138 receipt for federal or other moneys for and on behalf of this state or any 93
135139 political subdivision thereof for the acquisition, construction, 94
136140 improvement, maintenance and operation of facilities within this state. 95
137141 All moneys accepted for disbursement by the executive director 96
138142 pursuant to this subsection shall be [deposited in the state treasury and] 97
139143 disbursed in accordance with the provisions of the respective grants. 98
140144 (b) Any municipality is authorized to accept, receive and receipt for 99
141145 federal moneys and other moneys, either public or private, for the 100
142146 acquisition, construction, enlargement, improvement, maintenance, 101
143147 equipment or operation of airports and other air navigation facilities 102
144148 and sites therefor and to comply with the provisions of the laws of the 103
145149 United States and any rules and regulations made thereunder for the 104
146-expenditure of federal moneys upon such airports and facilities. No 105

158161 (c) Any municipality is authorized to designate by ordinance the 111
159162 executive director as its agent to accept, receive and receipt for federal 112
160163 moneys in its behalf for airport purposes and to contract for the 113
161164 acquisition, construction, enlargement, improvement, maintenance, 114
162165 equipment or operation of such airports or other air navigation facilities, 115
163166 and may enter into an agreement with the executive director prescribing 116
164167 the terms and conditions of such agency in accordance with federal 117
165168 laws, rules and regulations and applicable laws of this state. Such 118
166169 moneys as are paid by the United States government shall be paid to 119
167170 such municipality under such terms and conditions as may be imposed 120
168171 by the United States in making such grant. 121
169172 (d) All contracts for the acquisition, construction, enlargement, 122
170173 improvement, maintenance, equipment or operation of airports or other 123
171174 air navigation facilities, made by the municipality itself or through the 124
172175 executive director, shall be made pursuant to the laws of this state 125
173176 governing the making of like contracts; provided, where such 126
174177 acquisition, construction, improvement, enlargement, maintenance, 127
175178 equipment or operation is financed wholly or partly with federal 128
176179 moneys, the municipality, or the executive director as its agent, may let 129
177180 contracts in the manner prescribed by the federal authorities, acting 130
178181 under the laws of the United States, and any rules or regulations made 131
179182 thereunder, notwithstanding any other state law to the contrary. 132
180183 (e) The executive director may render financial assistance by grant of 133
181184 funds to any municipality or municipalities acting jointly in the 134
182185 planning, acquisition, construction or improvement of an airport owned 135
183186 or controlled, or to be owned or controlled, by such municipality or 136
184187 municipalities. [, out of appropriations made by the General Assembly 137
185-for such purposes.] Such financial assistance may be furnished in 138

195197 granting funds under this subsection and may prescribe forms to be 142
196198 used in connection therewith. 143
197199 (f) The executive director may, whenever the executive director 144
198200 considers such assistance desirable or feasible, make available 145
199201 engineering and other technical services of the executive director, with 146
200202 or without charge, to any municipality or owner of a commercial airport 147
201203 requesting such services in connection with the planning, acquisition, 148
202204 construction, improvement, maintenance or operation of airports or 149
203205 aeronautical facilities. 150
204206 (g) Any town, city or borough may lease any airport or contract for 151
205207 any airport facilities or privileges from any person, firm or corporation, 152
206208 municipal or private, operating a municipal or private airport in any 153
207209 location which has been approved by the executive director. 154
208210 Sec. 6. Section 13b-47 of the general statutes is repealed and the 155
209211 following is substituted in lieu thereof (Effective July 1, 2023): 156
210212 (a) In determining whether to issue a certificate of approval or license 157
211213 for the use or operation of any proposed [commercial] public use air 158
212214 navigation facility, the executive director of the Connecticut Airport 159
213215 Authority shall take into consideration (1) its proposed location, size 160
214216 and layout, (2) its relationship to any comprehensive plan for state-wide 161
215217 and nation-wide development, (3) the availability of areas suitable for 162
216218 safe future expansion, (4) the freedom of adjoining areas from 163
217219 obstructions based on a proper glide ratio, (5) the nature of the terrain 164
218220 and of the uses to which the proposed [airport] facility will be put, and 165
219221 (6) the possibilities for future development. Prior to the issuance of a 166
220-certificate of approval, license or license renewal, each proposed or 167
221-existing public use air navigation facility shall provide documentation 168
222-to the authority, in such form as the executive director may prescribe, 169
223-that the factors described in subdivisions (1) to (6), inclusive, of this 170
224-subsection demonstrate that such facility will provide or currently 171
225-provides for safe aircraft operations. 172 Substitute Bill No. 993

232+provide or currently provides for safe aircraft operations. 172
232233 (b) In determining whether to issue a certificate of approval or license 173
233234 for the use or operation of any proposed private use air navigation 174
234235 facility, the executive director shall take into consideration: (1) Its 175
235236 proposed location, size and layout; (2) the freedom of adjacent areas 176
236237 from obstructions based on a proper glide ratio; (3) the nature of the 177
237238 terrain and the uses to which the proposed air navigation facility will be 178
238239 put; (4) the type of equipment to be utilized and the flight experience of 179
239240 the operator; (5) the amount of noise to be produced at such facility; and 180
240241 (6) such other factors as the executive director deems appropriate. Prior 181
241242 to the issuance of a certificate of approval, license or license renewal, 182
242-each proposed or existing private use air navigation facility shall 183
243-provide documentation to the authority, in such form as the executive 184
244-director may prescribe, that the factors described in subdivisions (1) to 185
245-(6), inclusive, of this subsection demonstrate that such facility will 186
246-provide or currently provides for safe aircraft operations. 187
247-Sec. 7. Section 13b-49a of the general statutes is repealed and the 188
248-following is substituted in lieu thereof (Effective July 1, 2023): 189
249-(a) Not later than July thirty-first annually, the owner or operator of 190
250-any airport, heliport, restricted landing area, seaplane base or other air 191
251-navigation facility licensed under the provisions of section 13b-46 shall 192
252-submit to the executive director and the municipality in which the 193
253-aircraft is based, the following information with respect to an aircraft 194
254-which is based or primarily used at such facility as of July first of such 195
255-year: (1) The [name] identity and address of the owner [thereof] and 196
256-form of ownership, including information as to whether the owner is an 197
257-individual, partnership, corporation or other entity; (2) the type of 198
258-aircraft, including the year of manufacture, the manufacturer, the model 199
259-and the certified gross weight; and (3) the Federal Aviation Aircraft 200
260-Registration number. [The executive director shall forward such 201
261-information to the municipality in which an aircraft is based.] 202
262-(b) The executive director, after notice and opportunity for hearing, 203
263-may suspend or revoke the license of any such facility in the event the 204
264-owner or operator thereof knowingly or intentionally fails to comply 205 Substitute Bill No. 993

275-Connecticut's licensed privately owned, publicly used airports which 210
276-have a paved runway and a minimum of five thousand operations per 211
277-year: (1) The state shall have the right of first refusal to purchase, via fair 212
278-market value and state property acquisition procedures, an airport, if 213
279-that airport is threatened with sale or closure, for the express purpose of 214
280-preserving the airport; (2) the executive director may acquire the 215
281-development rights, based on fair market value for such rights, of such 216
282-airports, provided the airport remains a public airport; (3) the state 217
283-[shall] may fund capital improvements to private airports, in which case 218
284-the state [shall participate in] may fund not more than ninety per cent of 219
285-the eligible costs and the balance by the sponsor, with budget and 220
286-priorities to be determined by the executive director, and engineering in 221
287-accordance with Federal Aviation Administration Advisory Circulars; 222
288-and (4) the establishment of a new airport zoning category for the 223
289-airport's imaginary surfaces as defined by Federal Aviation Regulations 224
290-and a program to mitigate noise in airport neighborhoods in which the 225
291-noise exceeds applicable Federal Aviation Administration standards. 226
292-Such program may be combined with existing energy conservation 227
293-programs. Funding for such program shall be from available federal 228
294-resources. 229
295-Sec. 9. Section 15-44 of the general statutes is repealed and the 230
296-following is substituted in lieu thereof (Effective July 1, 2023): 231
297-The executive director [, and] of the Connecticut Airport Authority, 232
298-aeronautics inspectors of the authority, [and] each state, county and 233
299-municipal officer charged with the enforcement of state and municipal 234
300-laws and each special police officer, appointed under section 29-19, shall 235
301-enforce and assist in the enforcement of this chapter and of all 236
302-regulations made pursuant thereto, and of all other laws of this state 237 Substitute Bill No. 993

310-Sec. 10. Subsection (a) of section 15-76 of the general statutes is 239
311-repealed and the following is substituted in lieu thereof (Effective July 1, 240
312-2023): 241
313-(a) The executive director of the Connecticut Airport Authority, any 242
314-employee of the authority, any officer attached to an organized police 243
315-department, any state police officer or any constable, within his or her 244
316-precinct, upon discovery of any aircraft apparently abandoned, whether 245
317-situated within or without any airport or landing field in this state, shall 246
318-take such aircraft into custody and may cause the same to be taken to 247
319-and stored in a suitable place. All charges necessarily incurred by such 248
320-person in the performance of such duty shall be a lien upon such aircraft. 249
321-The owner or keeper of any hangar or other place where such aircraft is 250
322-stored shall have a lien upon the same for storage charges. If such 251
323-aircraft has been so stored for a period of ninety days, such owner or 252
324-keeper may sell the same at public auction for cash, at such owner's or 253
325-keeper's place of business, and apply the avails of such sale toward the 254
326-payment of such owner's or keeper's charges and the payment of any 255
327-debt or obligation incurred by the person who placed the same in 256
328-storage, provided such sale shall be advertised three times in a 257
329-newspaper published or having a circulation in the town where such 258
330-hangar or other place is located, such advertisement to commence at 259
331-least five days before such sale; and, if the last place of abode of the 260
332-owner of such aircraft is known to or may be ascertained by such hangar 261
333-owner or keeper by the exercise of reasonable diligence, notice of the 262
334-time and place of sale shall be given such owner by mailing such notice 263
335-to the owner in a registered or certified letter, postage paid, at such last 264
336-usual place of abode, at least five days before the time of sale. The 265

310+Sec. 10. Subsection (a) of section 15-76 of the general statutes is 240
311+repealed and the following is substituted in lieu thereof (Effective July 1, 241
312+2023): 242
313+(a) The executive director of the Connecticut Airport Authority, any 243
314+employee of the authority, any officer attached to an organized police 244
315+department, any state police officer or any constable, within his or her 245
316+precinct, upon discovery of any aircraft apparently abandoned, whether 246
317+situated within or without any airport or landing field in this state, shall 247
318+take such aircraft into custody and may cause the same to be taken to 248
319+and stored in a suitable place. All charges necessarily incurred by such 249
320+person in the performance of such duty shall be a lien upon such aircraft. 250
321+The owner or keeper of any hangar or other place where such aircraft is 251
322+stored shall have a lien upon the same for storage charges. If such 252
323+aircraft has been so stored for a period of ninety days, such owner or 253
324+keeper may sell the same at public auction for cash, at such owner's or 254
325+keeper's place of business, and apply the avails of such sale toward the 255
326+payment of such owner's or keeper's charges and the payment of any 256
327+debt or obligation incurred by the person who placed the same in 257
328+storage, provided such sale shall be advertised three times in a 258
329+newspaper published or having a circulation in the town where such 259
330+hangar or other place is located, such advertisement to commence at 260
331+least five days before such sale; and, if the last place of abode of the 261
332+owner of such aircraft is known to or may be ascertained by such hangar 262
333+owner or keeper by the exercise of reasonable diligence, notice of the 263
334+time and place of sale shall be given such owner by mailing such notice 264
335+to the owner in a registered or certified letter, postage paid, at such last 265
336+usual place of abode, at least five days before the time of sale. The 266
337+proceeds of such sale, after deducting the amount due such hangar 267
338+owner or keeper and all expenses connected with such sale, including 268

367-operator may obtain and consider the views of the agency of the federal 290
368-government charged with the fostering of civil aeronautics as to the 291
369-aerial approaches necessary to safe flying operations at the airport. 292
370-Sec. 12. Section 15-101m of the general statutes is repealed and the 293
371-following is substituted in lieu thereof (Effective July 1, 2023): 294
372-[(a)] Subject to the provisions of the general statutes and resolution 295
373-authorizing the issuance of bonds pursuant to subsection (a) of section 296
374-15-101l, the [Commissioner of Transportation is authorized to] executive 297

395-revenues or moneys available therefor, if any, (1) to pay the cost of 312
396-maintaining, repairing and operating the facilities of Bradley 313
397-International Airport and each and every portion thereof, to the extent 314
398-that the payment of such cost has not otherwise been adequately 315
399-provided for, (2) to pay the principal of and the interest on any 316
400-outstanding revenue obligations of the state or the authority issued in 317
401-respect of the project as the same shall become due and payable, and (3) 318
402-to create and maintain reserves and sinking funds required or provided 319
403-for in any resolution authorizing, or trust agreement securing, such 320
404-bonds. A sufficient amount of the revenues as may be necessary to pay 321
405-the cost of maintenance, repair and operation and to provide reserves 322
406-and for renewals, replacements, extensions, enlargements and 323
407-improvements as may be provided for in the resolution authorizing the 324
408-issuance of any bonds or in the trust agreement securing the same, shall 325
409-be set aside at such regular intervals as may be provided in such 326
410-resolution or trust agreement in a reserve, sinking or other similar fund 327
411-which is hereby pledged to, and charged with, the payment of the 328
412-principal of and the interest on such bonds as the same shall become 329
413-due, and the redemption price or the purchase price of bonds retired by 330
414-call or purchase as therein provided. The use and disposition of moneys 331
415-to the credit of such reserve, sinking or other similar fund shall be 332
416-subject to the provisions of the resolution authorizing the issuance of 333
417-such bonds or of such trust agreement. 334

433-fiscal year, to the extent that the payment of such costs has not otherwise 344
434-been adequately provided for, (2) the payment of the principal of and 345
435-interest on any outstanding revenue obligations of the state issued in 346
436-respect of the project and becoming due and payable in such fiscal year 347
437-and (3) the creation and maintenance of reserves and sinking funds 348
438-required or provided for in any resolution authorizing, or trust 349
439-agreement securing, such bonds. Such annual operating budget shall 350
440-include an estimate of revenues from the rates, rents, fees and charges 351
441-fixed by the Department of Transportation pursuant to subsection (a), 352
442-and from any and all other sources, to meet the estimated expenditures 353
443-of Bradley International Airport for such fiscal year. Within thirty days 354
444-prior to the first day of such fiscal year the Secretary of the Office of 355
445-Policy and Management shall approve said annual operating budget, 356
446-with such changes, amendments, additions and deletions as shall be 357
447-agreed upon prior to that date by the Department of Transportation and 358
448-the Secretary of the Office of Policy and Management. The annual 359
449-operating budget of Bradley International Airport as so approved shall 360
450-take effect as of the date of its approval. On or before the twentieth day 361
451-of each month, including the month next preceding the first month of 362
452-the fiscal year to which the annual operating budget applies, the 363
453-Treasurer or the trustee under any trust indenture securing the bonds 364
454-issued under subsection (a) of section 15-101l shall pay to the 365
455-Department of Transportation out of the funds available for such 366
456-purpose such amount as may be necessary to make the amount then 367
457-held by said department for the payment of operating expenses of 368
458-Bradley International Airport equal to such amount as shall be 369
459-necessary for the payment of such operating expenses during the next 370
460-ensuing two months, as shown by the annual operating budget for such 371 Substitute Bill No. 993

477-operating budget for Bradley International Airport to the Secretary of 382
478-the Office of Policy and Management pursuant to subsection (b) of this 383
479-section, the department shall submit a copy of such budget to the joint 384
480-standing committee of the General Assembly having cognizance of 385
481-matters relating to appropriations and the budgets of state agencies, 386
482-through the legislative Office of Fiscal Analysis. Upon the approval of 387
483-the annual operating budget, the department shall submit a copy of the 388
484-budget as so approved to said joint standing committee, through the 389
485-Office of Fiscal Analysis.] 390
486-Sec. 13. Subsection (b) of section 15-120ii of the general statutes is 391

525-necessary to make the amount then held within such accounts for the 424
526-payment of operating expenses of Bradley, the general aviation airports 425
527-and any other airports equal to such amount as shall be necessary for 426
528-the payment of such operating expenses during the next ensuing two 427
529-months, as shown by the annual operating budget for such fiscal year. 428
530-Except as otherwise provided in sections 15-120aa to 15-120oo, 429
531-inclusive, either expressly or by implication, all provisions of the general 430
532-statutes governing state employees and state property, and all other 431
533-provisions of the general statutes applicable to Bradley, the general 432

556-agreement shall not take precedence over its obligation to provide 449

565-Sec. 15. (NEW) (Effective October 1, 2023) (a) No person shall operate, 458

567-state unless there is a liability insurance policy on such aircraft that 460
568-covers the owner and pilot for claims by passengers or other persons for 461
569-any injuries to such passengers or other persons or their property that 462
570-might arise out of the operation of such aircraft. 463
571-(b) The liability insurance shall provide coverage of at least (1) five 464
572-hundred thousand dollars for damages by reason of bodily injury or 465
573-death or for property damages per accident, and (2) one hundred 466
574-thousand dollars for damages by reason of bodily injury or death or for 467
575-property damages per passenger seat. 468
