920 AN ACT CONCERNING THE MASHANTUCKET PEQUOT AND
1021 MOHEGAN FUND.
1122 Be it enacted by the Senate and House of Representatives in General
1223 Assembly convened:

14-Section 1. Section 3-55i of the general statutes is repealed and the
15-following is substituted in lieu thereof (Effective July 1, 2023):
16-(a) (1) There is established the "Mashantucket Pequot and Mohegan
17-Fund" which shall be a separate nonlapsing fund. All funds received by
18-the state of Connecticut from the Mashantucket Pequot Tribe pursuant
19-to the joint memorandum of understanding entered into by and
20-between the state and the tribe on January 13, 1993, as amended on April
21-30, 1993, and any successor thereto, shall be deposited in the General
22-Fund. [During the fiscal year]
23-(2) For the fiscal years ending June 30, 2015, [and each fiscal year
24-thereafter] to June 30, 2025, inclusive, from the funds received by the
25-state from the tribe pursuant to said joint memorandum of
26-understanding, as amended, and any successor thereto, an amount
27-equal to the appropriation to the Mashantucket Pequot and Mohegan
28-Fund for Grants to Towns shall be transferred to the Mashantucket
29-Pequot and Mohegan Fund. [and shall be distributed by the Office of
30-Policy and Management, during said fiscal year, in accordance with the Senate Bill No. 1213
25+Section 1. Section 3-55i of the general statutes is repealed and the 1

27+(a) (1) There is established the "Mashantucket Pequot and Mohegan 3
28+Fund" which shall be a separate nonlapsing fund. All funds received 4
29+by the state of Connecticut from the Mashantucket Pequot Tribe 5
30+pursuant to the joint memorandum of understanding entered into by 6
31+and between the state and the tribe on January 13, 1993, as amended 7
32+on April 30, 1993, and any successor thereto, shall be deposited in the 8
33+General Fund. [During the fiscal year] 9
34+(2) For the fiscal years ending June 30, 2015, [and each fiscal year 10
35+thereafter] to June 30, 2025, inclusive, from the funds received by the 11
36+state from the tribe pursuant to said joint memorandum of 12
37+understanding, as amended, and any successor thereto, an amount 13
38+equal to the appropriation to the Mashantucket Pequot and Mohegan 14
39+Fund for Grants to Towns shall be transferred to the Mashantucket 15 Bill No. 1213

34-provisions of section 3-55j] For the fiscal year ending June 30, 2026, and
35-each fiscal year thereafter, one hundred thirty-nine million three
36-hundred eighty thousand dollars of the funds deposited in the General
37-Fund pursuant to subdivision (1) of this subsection or received by the
38-state pursuant to the memorandum of understanding entered into by
39-and between the state and the Mohegan Tribe of Indians of Connecticut
40-on May 17, 1994, as amended from time to time, shall be transferred
41-from the General Fund to the Mashantucket Pequot and Mohegan Fund.
42-During each fiscal year, the Office of Policy and Management shall make
43-distributions of any funds transferred to the Mashantucket Pequot and
44-Mohegan Fund pursuant to this section in accordance with the
45-provisions of section 3-55j. The amount of the grant payable to each
46-municipality during any fiscal year, in accordance with [said] section 3-
47-55j, shall be reduced proportionately if the total of such grants exceeds
48-the amount of funds available for such year. The grant shall be paid in
49-three installments as follows: The Secretary of the Office of Policy and
50-Management shall, annually, not later than the fifteenth day of
51-December, the fifteenth day of March and the fifteenth day of June
52-certify to the Comptroller the amount due each municipality under the
53-provisions of section 3-55j and the Comptroller shall draw an order on
54-the Treasurer on or before the fifth business day following the fifteenth
55-day of December, the fifth business day following the fifteenth day of
56-March and the fifth business day following the fifteenth day of June and
57-the Treasurer shall pay the amount thereof to such municipality on or
58-before the first day of January, the first day of April and the thirtieth day
59-of June.
60-(b) The transfers from the General Fund to the Mashantucket Pequot
61-and Mohegan Fund required by subsection (a) of this section shall not
62-be reduced except upon (1) submission to the General Assembly by the
63-Governor of a certification of an emergency requiring such reduction;
64-and (2) a vote of at least two-thirds of the members of each house of the
65-General Assembly approving such reduction. Senate Bill No. 1213

48+the provisions of section 3-55j] For the fiscal year ending June 30, 2026, 18
49+and each fiscal year thereafter, one hundred thirty-nine million three 19
50+hundred eighty thousand dollars of the funds deposited in the General 20
51+Fund pursuant to subdivision (1) of this subsection or received by the 21
52+state pursuant to the memorandum of understanding entered into by 22
53+and between the state and the Mohegan Tribe of Indians of 23
54+Connecticut on May 17, 1994, as amended from time to time, shall be 24
55+transferred from the General Fund to the Mashantucket Pequot and 25
56+Mohegan Fund. During each fiscal year, the Office of Policy and 26
57+Management shall make distributions of any funds transferred to the 27
58+Mashantucket Pequot and Mohegan Fund pursuant to this section in 28
59+accordance with the provisions of section 3-55j. The amount of the 29
60+grant payable to each municipality during any fiscal year, in 30

62+the total of such grants exceeds the amount of funds available for such 32
63+year. The grant shall be paid in three installments as follows: The 33
64+Secretary of the Office of Policy and Management shall, annually, not 34
65+later than the fifteenth day of December, the fifteenth day of March 35
66+and the fifteenth day of June certify to the Comptroller the amount due 36
67+each municipality under the provisions of section 3-55j and the 37
68+Comptroller shall draw an order on the Treasurer on or before the fifth 38
69+business day following the fifteenth day of December, the fifth 39
70+business day following the fifteenth day of March and the fifth 40
71+business day following the fifteenth day of June and the Treasurer 41
72+shall pay the amount thereof to such municipality on or before the first 42
73+day of January, the first day of April and the thirtieth day of June. 43
74+(b) The transfers from the General Fund to the Mashantucket Pequot 44

87+Fund shall be paid to municipalities as specified in the general statutes 51
88+and biennial budget approved by the General Assembly. 52
89+This act shall take effect as follows and shall amend the following
