2828 Section 1. Section 10a-91d of the general statutes is repealed and the 1
2929 following is substituted in lieu thereof (Effective July 1, 2023): 2
3030 (a) (1) It is hereby determined and found to be in the best interest of 3
3131 this state and the system to establish CSCU 2020 as the efficient and cost-4
3232 effective course to achieve the objective of renewing, modernizing, 5
3333 enhancing, expanding, acquiring and maintaining the infrastructure of 6
3434 the system, the particular project or projects, each being hereby 7
3535 approved as a project of CSCU 2020, and the presently estimated cost 8

378378 (b) The plan of funding CSCU 2020 shall be from the proceeds of 17
379379 general obligation bonds of the state in an amount authorized pursuant 18
380380 to subsection (a) of section 10a-91e. The proceeds of the general 19
381381 obligation bonds issued pursuant to section 10a-91e shall be deposited 20
382382 into the CSCU 2020 Fund. 21
383383 (c) With respect to CSCU 2020 and within the authorized funding 22
384384 amount, the board of regents may, from time to time, and shall, 23
385385 whenever appropriate or necessary, revise, delete or add a particular 24
386386 project or projects, provided: 25
387387 (1) A formal approving vote of the board of regents shall be needed 26
388388 for (A) a revision that deviates from the estimated costs of projects 27
389389 pursuant to subsection (a) of this section in an amount that is [less] more 28
390390 than (i) ten per cent of such costs for a project with an estimated cost of 29
391391 [one] two million dollars or lower, or (ii) five per cent of such costs for a 30
392392 project with an estimated cost of more than [one] two million dollars, 31
393393 provided such change in the costs does not include changes in the costs 32
394394 of materials, (B) a deletion, or (C) an addition dictated by a change in 33 Raised Bill No. 1246

400400 system planning as determined by the board of regents or otherwise 34
401401 necessary because of reasons beyond the control of the system; 35
402402 (2) Any other revision [shall be subject only to such formal approval 36
403403 of the board of regents as long as the board of regents finds and 37
404404 determines that such revision is consistent with the intent or purpose of 38
405405 the original project] may be made at the direction of the president of the 39
406406 Connecticut State Colleges and Universities; and 40
407407 (3) [(A) A revision that deviates from the estimated costs of projects 41
408408 pursuant to subsection (a) of this section in an amount that is equal to 42
409409 or greater than (i) ten per cent of such costs for a project with an 43
410410 estimated cost of one million dollars or lower, or (ii) five per cent of such 44
411411 costs for a project with an estimated cost of more than one million 45
412412 dollars, provided such change in the costs does not include changes in 46
413413 the costs of materials, (B) an addition, or (C) a deletion, shall be] Any 47
414414 additions of projects not enumerated in subsection (a) of this section 48
415415 shall be limited to two hundred million dollars in the aggregate, unless 49
416416 conditioned not only upon such formal approval of the board of regents 50
417417 but also upon a request by the board of regents for, and enactment of, a 51
418418 subsequent public or special act approving [(i)] such addition, [or 52
419419 deletion, if such addition is to add a project not outlined in subsection 53
420420 (a) of this section or the deletion is the deletion of a project outlined in 54
421421 subsection (a) of this section, or (ii) such revision, except] provided if 55
422422 such [revision] addition is due to the use of funds remaining from a 56
423423 completed project, then such [revision] addition shall be conditioned 57
424424 only upon such formal approval of the board of regents. 58
425425 (4) Subject to the limitations in the authorized funding amount, the 59
426426 board of regents may determine the sequencing and timing of such 60
427427 project or projects, revise estimates of cost and reallocate from any 61
428428 amounts estimated in subsection (a) of this section, for one or more 62
429429 projects to one or more other projects then constituting a component of 63
430430 CSCU 2020 as long as, at the time of such reallocation, it has found that 64
431431 any such project to which a reallocation is made has been revised or 65
432432 added in accordance with this section and such project from which a 66 Raised Bill No. 1246

438438 reallocation is made either has been so revised or added and can be 67
439439 completed within the amounts remaining allocated to it, or has been so 68
440440 deleted. The board of regents' actions under this section shall be 69
441441 included in reports to the Governor and the General Assembly under 70
442442 section 10a-91f. If the board of regents requests a revision, addition or 71
443443 deletion pursuant to subdivision (3) of this subsection, the board of 72
444444 regents shall submit such request to the Governor at the same time that 73
445445 the request is submitted to the General Assembly. 74
446446 (d) (1) In accordance with the provisions of chapters 59 and 60, the 75
447447 Commissioner of Administrative Services shall be responsible for the 76
448448 duties specified in said provisions, and, on a quarterly basis, the 77
449449 commissioner shall provide the system with information needed for 78
450450 compliance with sections 10a-91a to 10a-91h, inclusive, including, but 79
451451 not limited to, costs, timeliness of completion of projects and any issues 80
452452 that have developed in implementation of any project under the 81
453453 commissioner's jurisdiction. 82
454454 (2) Not later than January 1, 2009, and annually thereafter, the 83
455455 Commissioner of Administrative Services shall, in accordance with 84
456456 section 11-4a, report to the Governor and the General Assembly on any 85
457457 (A) construction management services costs, (B) administrative services 86
458458 costs, and (C) costs of fees associated with CSCU 2020. 87
459459 (e) The Commissioner of Administrative Services and the system 88
460460 shall enter into and maintain a memorandum of understanding that 89
461461 shall provide for the assignment of personnel from the Department of 90
462462 Administrative Services to ensure that buildings or projects that are part 91
463463 of the CSCU 2020 program are designed and constructed in compliance 92
464464 with the Fire Safety Code and the State Building Code with respect to 93
465465 buildings or building projects that (1) are part of CSCU 2020, as 94
466466 authorized by sections 10a-91a to 10a-91h, inclusive, (2) do not meet the 95
467467 threshold limits, as defined in section 29-276b, and (3) construction of 96
468468 which is initiated during the period of time in which the memorandum 97

475475 (f) Not later than July 1, 2015, and biannually thereafter, the Board of 99
476476 Regents for Higher Education shall, in accordance with section 11-4a, 100
477477 report to the joint standing committees of the General Assembly having 101
478478 cognizance of matters relating to higher education and finance on how 102
479479 the Board of Regents for Higher Education disbursed to and divided 103
480480 among each state university and each regional community-technical 104
481481 college the proceeds of the general obligation bonds issued pursuant to 105
482482 subsection (a) of section 10a-91e for each of the projects listed under the 106
483483 Board of Regents for Higher Education in subsection (a) of this section. 107
484484 Sec. 2. Subsections (a) and (b) of section 10a-91e of the general statutes 108
485485 are repealed and the following is substituted in lieu thereof (Effective July 109
486486 1, 2023): 110
487487 (a) (1) The State Bond Commission shall approve the CSCU 2020 111
488488 program and authorize the issuance of bonds of the state in principal 112
489489 amounts not exceeding in the aggregate one billion sixty-nine million 113
490490 five hundred thousand dollars. The amount provided for the issuance 114
491491 and sale of bonds in accordance with this section shall be capped in each 115
492492 fiscal year in the following amounts, provided, to the extent the board 116
493493 of regents does not provide for the issuance of all or a portion of such 117
494494 amount in a fiscal year, or the Governor disapproves the request for 118
495495 issuance of all or a portion of the amount of the bonds as provided in 119
496496 subsection (d) of this section, any amount not provided for or 120
497497 disapproved, as the case may be, shall be carried forward and added to 121
498498 the capped amount for a subsequent fiscal year, but not later than the 122
499499 fiscal year ending June 30, 2021, and provided further, the costs of 123
500500 issuance and capitalized interest, if any, may be added to the capped 124
501501 amount in each fiscal year, and each of the authorized amounts shall be 125
502502 effective on July first of the fiscal year indicated as follows: 126

576576 (2) The State Bond Commission shall approve a memorandum of 160
577577 understanding between the board of regents and the state, acting by and 161
578578 through the Secretary of the Office of Policy and Management and the 162
579579 Treasurer, providing for the issuance of bonds under subdivision (2) of 163
580580 subsection (a) of this section for the purposes of sections 10a-91a to 10a-164
581581 91h, inclusive, including provisions regarding the extent to which 165

594594 Sec. 3. Section 10a-91f of the general statutes is repealed and the 173
595595 following is substituted in lieu thereof (Effective July 1, 2023): 174
596596 (a) Not later than January 1, [2015] 2024, and [semiannually] annually 175
597597 thereafter, the system shall, in accordance with the provisions of section 176
598598 11-4a, report to the Governor and the General Assembly on the status 177
599599 and progress of CSCU 2020. Each report shall include, but not be limited 178
600600 to: (1) Information on the number of projects authorized and approved 179
601601 hereunder including, relative to such projects, project costs, timeliness 180
602602 of completion and any problems which have developed in 181
603603 implementation, and a schedule of projects remaining and their 182
604604 expected costs; and (2) the amount of money raised from private sources 183
605605 for the capital and endowment programs. For purposes of preparing 184
606606 each report, upon request of the board of regents, the Treasurer shall 185
607607 promptly provide information concerning bonds authorized, approved 186
608608 and issued under sections 10a-91a to 10a-91h, inclusive. 187
609609 (b) [Commencing January 1, 2010, the first semiannual report in each 188
610610 year] Each report submitted in accordance with subsection (a) of this 189
611611 section shall include such information as requested by the bonding 190
612612 subcommittee of the joint standing committee of the General Assembly 191
613613 having cognizance of matters relating to finance, revenue and bonding, 192
614614 including, but not limited to: (1) The use of bond funds in the current 193
615615 fiscal year, (2) projected use of bond funds for the next succeeding fiscal 194
616616 year, and (3) any updated master plans impacting the balance of the 195
617617 projects. In the event that said bonding subcommittee determines that 196
618618 there has been a significant change in the economic circumstances of the 197
619619 state sufficient to warrant recommendations for modification of the 198
620620 program, the subcommittee may make recommendations for 199

627627 Sec. 4. (NEW) (Effective July 1, 2023) The Board of Regents for Higher 201
628628 Education shall have the power to lease or sublease real or personal 202
629629 property. In connection with any lease of personal property, including 203
630630 any lease considered embedded within another contract, including, but 204
631631 not limited to, a power purchase agreement, the board shall have the 205
632632 power to grant a security interest under article 9 of title 42a of the 206
633633 general statutes to any person from whom the board has leased such 207
634634 personal property, including permitting the exercise of remedies 208
635635 provided for in article 9 of title 42a of the general statutes. 209
636636 Sec. 5. Subsection (a) of section 4b-51 of the general statutes is 210
637637 repealed and the following is substituted in lieu thereof (Effective July 1, 211

639639 (a) The Commissioner of Administrative Services shall have charge 213
640640 and supervision of the remodeling, alteration, repair or enlargement of 214
641641 any real asset, except any dam, flood or erosion control system, 215
642642 highway, bridge or any mass transit, marine or aviation transportation 216
643643 facility, a facility of the Connecticut Marketing Authority, an asset of the 217
644644 Department of Agriculture program established pursuant to section 26-218
645645 237a, or any building under the supervision and control of the Joint 219
646646 Committee on Legislative Management, involving an expenditure in 220
647647 excess of five hundred thousand dollars, and except that (1) the Judicial 221
648648 Branch may have charge and supervision of the remodeling, alteration, 222
649649 repair, construction or enlargement of any real asset involving an 223
650650 expenditure of not more than two million dollars, (2) each constituent 224
651651 unit of the state system of higher education may have charge and 225
652652 supervision of the remodeling, alteration, repair, construction or 226
653653 enlargement of any real asset involving an expenditure of not more than 227
654654 [two] ten million dollars, (3) The University of Connecticut shall have 228
655655 charge and supervision of the remodeling, alteration, repair, 229
656656 construction, or enlargement of any project, as defined in subdivision 230
657657 (16) of section 10a-109c, notwithstanding the amount of the expenditure 231
658658 involved, and (4) the Military Department may have charge and 232
659659 supervision of the remodeling, alteration, repair, construction or 233

667667 any real asset, the commissioner shall consider the capability of the real 236

669669 Sec. 6. Subsection (a) of section 4b-52 of the general statutes is 238

672672 (a) (1) No repairs, alterations or additions involving expense to the 241
673673 state of five hundred thousand dollars or less or, in the case of repairs, 242

676676 case of repairs, alterations or additions to a building rented or occupied 245
677677 by a constituent unit of the state system of higher education, [two] ten 246
678678 million dollars or less, shall be made to any state building or premises 247
679679 occupied by any state officer, department, institution, board, 248
680680 commission or council of the state government and no contract for any 249
681681 construction, repairs, alteration or addition shall be entered into without 250
682682 the prior approval of the Commissioner of Administrative Services, 251
683683 except repairs, alterations or additions to a building under the 252
684684 supervision and control of the Joint Committee on Legislative 253
685685 Management or the Military Department and repairs, alterations or 254
686686 additions to a building under the supervision of The University of 255
687687 Connecticut. Repairs, alterations or additions which are made pursuant 256
688688 to such approval of the Commissioner of Administrative Services shall 257
689689 conform to all guidelines and procedures established by the Department 258
690690 of Administrative Services for agency-administered projects. (2) 259
691691 Notwithstanding the provisions of subdivision (1) of this subsection, 260
692692 repairs, alterations or additions involving expense to the state of five 261
693693 hundred thousand dollars or less may be made to any state building or 262
694694 premises under the supervision of the Office of the Chief Court 263

721721 index, as calculated by the United States Department of Labor, over the 285
722722 preceding calendar year, rounded to the nearest multiple of one 286
723723 hundred dollars. 287
724724 Sec. 9. (NEW) (Effective July 1, 2023) (a) As used in this section, 288
725725 "surplus property" means any land, improvement to land or interest in 289
726726 land that is (1) in the custody and control of an institution of higher 290
727727 education within the Connecticut State Colleges and Universities, and 291
728728 (2) determined by the Board of Regents for Higher Education to not be 292
729729 required for the discharge of any duty or function of such institution. 293
730730 (b) Notwithstanding section 4b-21 of the general statutes, the Board 294
731731 of Regents for Higher Education may, upon the review and approval of 295
732732 the Secretary of the Office of Policy and Management and, if such 296
733733 surplus property was purchased or improved with the proceeds of tax-297
734734 exempt obligations issued or to be issued by the state, the Treasurer, sell, 298
735735 exchange, lease or otherwise transfer and convey any surplus property 299
736736 to a bona fide purchaser for a price and on terms that said board 300 Raised Bill No. 1246

743743 property based on at least two appraisals conducted not earlier than 302

746746 higher education that has custody and control over the surplus 305
747747 property, and (3) consistent with the objectives and purposes of such 306
748748 institution. The Treasurer may disapprove such a conveyance only if the 307
749749 conveyance would affect the tax-exempt status of such obligations and 308
750750 could not be modified to maintain such tax-exempt status. 309
751751 (c) The Board of Regents for Higher Education shall use the proceeds 310
752752 from any sale, exchange, lease or other transfer and conveyance of 311
753753 surplus property in the following order of priority: (1) To pay any 312
754754 outstanding bonds or other debt associated with the surplus property 313
755755 or any improvements to such property, (2) for any costs associated with 314
756756 such sale, exchange, lease or other transfer and conveyance, and (3) for 315
757757 any capital expenditure that is consistent with said board's plan for 316
758758 campus development. 317
