2221 AN ACT STANDARDIZING DRIVE-ONLY LICENSES.
2322 Be it enacted by the Senate and House of Representatives in General

2625 Section 1. Section 14-36m of the general statutes is repealed and the 1
2726 following is substituted in lieu thereof (Effective January 1, 2025): 2
2827 (a) As used in this section: 3
2928 (1) "Primary proof of identity" means documentation indicating the 4
3029 identity of an applicant for a motor vehicle operator's license in the form 5
3130 of (A) a valid foreign passport issued by an applicant's country of 6
3231 citizenship that is unexpired or expired for less than three years before 7
3332 an application for such motor vehicle operator's license, or (B) a valid, 8
3433 unexpired consular identification document issued by an applicant's 9
3534 country of citizenship. 10
3635 (2) "Secondary proof of identity" means documentation indicating the 11
3736 identity of an applicant for a motor vehicle operator's license in the form 12

4644 identification card, (C) a certified copy of a marriage certificate issued 15
4745 by any state or territory of the United States, or any political subdivision 16
4846 thereof, including any county, city or town, or (D) an original birth 17
4947 certificate with a raised seal issued by a foreign country. 18
5048 (3) "Proof of residency" means a piece of mail or electronic mail that 19
5149 includes an applicant's name and address, indicates that such applicant 20
5250 resides in the state and is dated, unless otherwise indicated, not earlier 21
5351 than ninety days before an application for a motor vehicle operator's 22
5452 license, from any two of the following sources: (A) A bill from a bank or 23
5553 mortgage company, utility company, credit card company, doctor or 24
5654 hospital, (B) a bank statement or bank transaction receipt showing the 25
5755 bank's name and mailing address, (C) a preprinted pay stub, (D) a 26
5856 property or excise tax bill dated not earlier than twelve months before 27
5957 such application, (E) an annual benefits summary statement from the 28
6058 Social Security Administration or other pension or retirement plan 29
6159 dated not earlier than twelve months before such application, (F) a 30
6260 Medicaid or Medicare benefit statement, (G) a current homeowners 31
6361 insurance or renter's insurance policy or motor vehicle insurance card 32
6462 or policy dated not earlier than twelve months before such application, 33
6563 (H) a residential mortgage or similar loan contract, lease or rental 34
6664 contract showing signatures from all parties needed to execute the 35
6765 agreement dated not earlier than twelve months before such 36
6866 application, (I) any postmarked mail, (J) a change of address 37
6967 confirmation from the United States Postal Service indicating an 38
7068 applicant's current and prior address, (K) a survey of an applicant's real 39
7169 property issued by a licensed surveyor, or (L) any official school records 40
7270 showing enrollment. 41
7371 (b) (1) Notwithstanding any provision of the general statutes or any 42
7472 regulation, the Commissioner of Motor Vehicles shall not decline to 43
7573 issue a motor vehicle operator's license to any applicant who meets the 44
7674 licensure requirements provided in section 14-36 but who cannot 45

76+have a Social Security number if such applicant (A) submits proof of 47

84-have a Social Security number if such applicant (A) submits proof of 47
85-residency in the state, (B) submits either two forms of primary proof of 48

8683 identity or one form of primary proof of identity and one form of 49
8784 secondary proof of identity, and (C) files an affidavit with the 50
8885 commissioner attesting that such applicant has filed an application to 51
8986 legalize his or her immigration status or will file such an application as 52
9087 soon as he or she is eligible to do so. Any form of primary proof of 53
9188 identity, secondary proof of identity or proof of residency submitted to 54
9289 the commissioner that is in a language other than English shall be 55
9390 accompanied by a certified English translation of such document 56
9491 prepared by a translator approved by the commissioner. No photocopy, 57
9592 notarized photocopy or noncertified document is acceptable as a form 58
9693 of primary proof of identity or secondary proof of identity. 59
9794 (2) The commissioner shall not issue a motor vehicle operator's 60
9895 license under this section to any applicant who has been convicted of 61
9996 any felony in Connecticut. 62
10097 (3) The commissioner shall administer a class D motor vehicle 63
10198 operator's license knowledge test to any such applicant after such 64
10299 applicant has submitted proof of residency and proof of identity that 65
103100 satisfy the requirements of this section. Not later than thirty days after 66
104101 such applicant has passed such knowledge test, the commissioner shall 67
105102 determine whether such applicant has been convicted of any felony in 68
106103 Connecticut by searching the electronic criminal record system 69
107104 maintained on the Internet web site of the Judicial Department for 70
108105 convictions matching such applicant's name and date of birth. If such 71
109106 applicant has not been convicted of any such felony, the commissioner 72
110107 shall mail the applicant an adult instruction permit or youth instruction 73
111108 permit. The commissioner shall not refund the application fee of any 74
112109 applicant who fails a knowledge test or has been convicted of any such 75
113110 felony. 76
114111 (c) Any motor vehicle operator's license issued pursuant to this 77
115112 section shall include an indication on such license that such license shall 78

124120 section shall expire [from three to six] within a period not exceeding 81
125121 eight years after the date of issuance [and may be renewed every three 82
126122 years thereafter] or renewal. The fee for the issuance or renewal of an 83
127123 operator's license that expires [six] eight years from the date of issuance 84
128124 or renewal shall be [seventy-two] ninety-six dollars. The commissioner 85
129125 shall charge a prorated amount of such fee for an operator's license that 86
130126 expires less than [six] eight years from the date of issuance or renewal. 87
131127 The commissioner shall not renew any such operator's license unless the 88
132128 holder of such operator's license makes personal appearance and 89
133129 demonstrates proof of residency at the time of renewal. [The fee for the 90
134130 renewal of any such operator's license shall be thirty-six dollars.] 91
135131 (e) No motor vehicle operator's license issued pursuant to this section 92
136132 shall be used as identification for voting purposes. [The back of such 93
137133 license shall contain language indicating that it cannot be used for 94
138134 voting purposes. For any such license issued prior to July 1, 2016, the 95
139135 language required by this subsection shall be added upon renewal of 96
140136 such license.] 97
141137 [(f) The commissioner shall place a restriction on each motor vehicle 98
142138 operator's license issued pursuant to this section, indicating that such 99
143139 motor vehicle operator's license is "for driving purposes only".] 100
144140 [(g)] (f) The commissioner may adopt regulations, in accordance with 101
145141 the provisions of chapter 54, to implement the provisions of this section. 102
