914 AN ACT ESTABLISHING AND TRANSFERRING VARIOUS
1015 FUNCTIONS TO A DIVISION OF FIRE SERVICES ADMINISTRATION

1520 Be it enacted by the Senate and House of Representatives in General
1621 Assembly convened:

18-Section 1. Section 29-1b of the general statutes is repealed and the
19-following is substituted in lieu thereof (Effective July 1, 2025):
20-(a) There shall be within the Department of Emergency Services and
21-Public Protection a Division of State Police. The Commissioner of
22-Emergency Services and Public Protection shall serve as administrative
23-head and commanding officer of the State Police Division. As
24-administrative head, said commanding officer of the Division of State
25-Police shall delegate said commanding officer's jurisdiction of the affairs
26-of the Division of State Police to a deputy commissioner who shall have
27-the powers and privileges conferred by statute upon a state policeman.
28-(b) There shall be within said department a Division of Emergency
29-Management and Homeland Security. The commissioner shall serve as
30-administrative head of said division. As administrative head, said
31-commissioner shall delegate said commissioner's jurisdiction of the Substitute House Bill No. 5483

38-years of managerial or strategic planning experience in matters relating
39-to public safety, security, emergency services and emergency response.
40-No person possessing a record of any criminal, unlawful or unethical
41-conduct shall be eligible for or hold such position. Any person with any
42-present or past political activities or financial interests that may
43-substantially conflict with the duties of the deputy commissioner or
44-expose such person to potential undue influence or compromise such
45-person's ability to be entrusted with necessary state or federal security
46-clearances or information shall be deemed unqualified for such position
47-and shall not be eligible to hold such position.
48-(c) (1) There shall be within said department a Division of Fire
49-Services Administration. The State Fire Administrator shall be the
50-administrative head of said division.
51-(2) The functions, powers, duties and personnel of the former Office
52-of State Fire Administration shall be transferred to the Division of Fire
53-Services Administration pursuant to the provisions of sections 4-38d
54-and 4-39.
55-(3) The Division of Fire Services Administration shall constitute the
56-successor to the Office of State Fire Administration in accordance with
57-the provisions of sections 4-38d, 4-38e and 4-39. Wherever the words
58-"Office of State Fire Administration" are used in the general statutes, the
59-words "Division of Fire Services Administration within the Department
60-of Emergency Services and Public Protection" shall be substituted in lieu
61-thereof. Any order or regulation of the former Office of State Fire
62-Administration that is in force on the effective date of this section shall
63-continue in force and effect as an order or regulation of the Division of
64-Fire Services Administration within the Department of Emergency
65-Services and Public Protection until amended, repealed or superseded Substitute House Bill No. 5483

66+Administrative Services shall be transferred to the Division of Fire 38
67+Services Administration pursuant to the provisions of sections 4-38d 39

69+(3) The Division of Fire Services Administration shall constitute the 41

70-Sec. 2. Section 7-323k of the general statutes is repealed and the
71-following is substituted in lieu thereof (Effective from passage):
72-(a) (1) There is established a Commission on Fire Prevention and
73-Control. [to] Until June 30, 2025, the commission shall consist of twelve
74-members appointed by the Governor. The State Fire Marshal or his or
75-her designee and the president of the Connecticut State Colleges and
76-Universities or his or her designee shall serve as ex-officio, voting
77-members of said commission. Of the twelve members appointed by the
78-Governor, two shall represent The Connecticut State Firefighter's
79-Association, two shall represent the Connecticut Fire Chiefs
80-Association, two shall represent the Uniformed Professional Firefighters
81-of the International Association of Firefighters, AFL-CIO, two shall
82-represent the Connecticut Fire Marshals Association, two shall
83-represent the Connecticut Fire Department Instructors Association and
84-two shall represent the Connecticut Conference of Municipalities. The
85-term of any member appointed pursuant to this subdivision shall end
86-on June 30, 2025.
87-(2) On and after July 1, 2025, the commission shall consist of the
88-following members:
89-(A) Two members of The Connecticut State Firefighter's Association,
90-one of whom is the chairperson of the association's education
91-committee, appointed by the Governor;
92-(B) Two members of the Connecticut Fire Chiefs Association,
93-appointed by the Governor;
94-(C) Two members of the Connecticut Career Fire Chiefs' Association,
95-appointed by the Governor;
96-(D) Two members of the Uniformed Professional Firefighters of the Substitute House Bill No. 5483

101-Governor;
102-(E) Two members of the Connecticut Fire Marshals Association,
103-appointed by the Governor;
104-(F) Two members of the Connecticut Fire Department Instructors
105-Association, appointed by the Governor;
106-(G) A representative of the Connecticut Council of Small Towns,
107-appointed by the Governor;
108-(H) A representative of the Connecticut Conference of Municipalities,
109-appointed by the Governor;
110-(I) A representative of the Connecticut Council of Small Towns,
111-appointed by the House chairperson of the joint standing committee of
112-the General Assembly having cognizance of matters relating to public
113-safety and security;
114-(J) A representative of the Connecticut Conference of Municipalities,
115-appointed by the Senate chairperson of the joint standing committee of
116-the General Assembly having cognizance of matters relating to public
117-safety and security;
118-(K) A member of the Connecticut Fire Equipment Mechanics
119-Association, appointed by the House ranking member of the joint
120-standing committee of the General Assembly having cognizance of
121-matters relating to public safety and security;
122-(L) A representative of the Emergency Medical Services Advisory
123-Board, appointed by the Senate ranking member of the joint standing
124-committee of the General Assembly having cognizance of matters
125-relating to public safety and security;
126-(M) The State Fire Marshal, who shall be a nonvoting member; Substitute House Bill No. 5483
82+Services and Public Protection" shall be substituted in lieu thereof. Any 48
83+order or regulation of the former Office of State Fire Administration, 49
84+Office of the State Fire Marshal or Office of Education and Data 50

90+Sec. 2. Section 7-323k of the general statutes is repealed and the 56
91+following is substituted in lieu thereof (Effective July 1, 2025): 57

111+International Association of Firefighters, AFL-CIO, appointed by the 77

130-(N) The forest protection supervisor within the Forestry Division of
131-the Department of Energy and Environmental Protection, or such
132-supervisor's designee, who shall be a nonvoting member; and
133-(O) The commanding officer of the Fire and Explosion Investigation
134-Unit of the Division of State Police within the Department of Emergency
135-Services and Public Protection, or such officer's designee, who shall be
136-a nonvoting member.
137-(b) On or before July fifteenth, annually, each organization to be
138-represented on said commission shall submit to the [Governor]
139-appropriate appointing authority a list of nominees for appointment to
140-said commission, which list the [Governor] appointing authority may
141-use when making appointments to said commission. [On or before
142-September 1, 1975, the Governor shall appoint eight members of said
143-commission to serve for a term of three years and on or before
144-September 1, 1976, he shall appoint four members for a term of one year.
145-Thereafter he] Appointing authorities shall appoint members to said
146-commission [, to replace those whose terms have expired,] to serve for
147-three years, or until a successor is appointed. Any vacancy in the
148-membership of the commission shall be filled by the appointing
149-authority for the unexpired portion of the term. Persons appointed to
150-said commission shall be qualified, by experience or education, in the
151-fields of fire protection, fire prevention, fire suppression, fire fighting
152-and related fields.
153-(c) The commission shall meet at such times and at such places as it
154-deems proper. [Said] On and before June 30, 2025, the commission shall
155-elect from its membership a [chairman, vice chairman] chairperson, vice
156-chairperson and secretary who shall serve a one year term commencing
157-on October first of the year in which they are elected, provided such
158-terms shall expire on June 30, 2025, and nothing contained herein shall
159-prevent their reelection to such office. On and after July 1, 2025, the
160-Governor shall appoint the chairperson of the commission from the Substitute House Bill No. 5483

137+(12) A member of the Connecticut Fire Marshals Association, 97
138+appointed by the minority leader of the Senate; 98
139+(13) A representative of the Connecticut Council of Small Towns, 99
140+appointed by the House chairperson of the joint standing committee of 100
141+the General Assembly having cognizance of matters relating to public 101
142+safety and security; 102
143+(14) A representative of the Connecticut Conference of 103
144+Municipalities, appointed by the Senate chairperson of the joint 104
145+standing committee of the General Assembly having cognizance of 105
146+matters relating to public safety and security; 106 Substitute Bill No. 5483

164-commission's membership, and the commission shall elect from its
165-membership a vice chairperson and secretary, who shall serve one year
166-terms, provided nothing contained herein shall prevent their reelection
167-to such office. No member of said commission shall receive
168-compensation for such member's services.
169-(d) Members of the commission shall not be considered as holding
170-public office solely by virtue of their membership on said commission.
171-(e) On and after July 1, 2025, the members of the education committee
172-of the Connecticut State Firefighters Association, Inc., shall serve as a
173-subcommittee of the commission on matters relating to fire schools.
174-[(e)] (f) The commission shall be within the Department of Emergency
175-Services and Public Protection.
176-Sec. 3. Section 7-323l of the general statutes is repealed and the
177-following is substituted in lieu thereof (Effective July 1, 2025):
178-(a) The commission shall:
179-(1) Recommend minimum standards of education and physical
180-condition [required of each candidate] for candidates for any firefighter
181-position;
182-(2) Establish standards for [a] fire service training and education
183-[program, on a voluntary basis] programs, and develop and conduct an
184-examination program to certify those fire service personnel who
185-satisfactorily demonstrate their ability to meet the requirements of the
186-fire service training and education program standards;
187-(3) Establish an optional fire service training and education program
188-in the handling of incidents, such as wandering, that involve juveniles
189-and adults with autism spectrum disorder, cognitive impairment or
190-nonverbal learning disorder, provided the curriculum for such Substitute House Bill No. 5483

194-techniques is made available at no cost from (A) institutions of higher
195-education, health care professionals or advocacy organizations that are
196-concerned with juveniles and adults with autism spectrum disorder,
197-cognitive impairment or nonverbal learning disorder, or (B)
198-collaborations of such institutions, professionals or organizations;
199-(4) Conduct fire fighting training and education programs designed
200-to assist firefighters in developing and maintaining their skills and
201-keeping abreast of technological advances in fire suppression, fire
202-protection, fire prevention and related fields;
203-(5) Recommend standards for promotion to the various ranks of fire
204-departments;
205-(6) Be authorized, with the approval of the Commissioner of
206-Emergency Services and Public Protection, to apply for, receive and
207-distribute any state, federal or private funds or contributions available
208-for training and education of fire fighting personnel;
209-(7) Recommend that the Commissioner of Emergency Services and
210-Public Protection approve or reject the establishment of, or, when
211-appropriate, suspend or revoke the approval of, regional fire schools in
212-accordance with section 7-323u; [and]
213-(8) Advise the Division of Fire Services Administration within the
214-Department of Emergency Services and Public Protection on the
215-management of the Statewide Fire Service Disaster Response Plan;
216-(9) Implement the recommendations of the study of the fire service
217-authorized pursuant to subdivision (36) of subsection (b) of section 41
218-of public act 23-204; and
219-[(8)] (10) Submit to the Governor, the [Joint Legislative Management
220-Committee of the General Assembly] joint standing committee of the
221-General Assembly having cognizance of matters relating to public safety Substitute House Bill No. 5483
153+(15) A member of the Connecticut Fire Equipment Mechanics 107

166+(20) The director of the Division of Emergency Management and 120
167+Homeland Security within the Department of Emergency Services and 121
168+Public Protection, or said director's designee, who shall be a nonvoting 122
169+member; 123
170+(21) The director of the Fire and Explosion Investigation Unit of the 124
171+Division of State Police within the Department of Emergency Services 125
172+and Public Protection, who shall be a nonvoting member; and 126
173+(22) The executive director of the Connecticut Technical Education 127
174+and Career System, or said executive director's designee, who shall be a 128
175+nonvoting member. 129
176+(b) On or before July fifteenth, annually, each organization to be 130
177+represented on said commission shall submit to the [Governor] 131
178+appropriate appointing authority a list of nominees for appointment to 132
179+said commission, which list the [Governor] appointing authority may 133
180+use when making appointments to said commission. [On or before 134
181+September 1, 1975, the Governor shall appoint eight members of said 135 Substitute Bill No. 5483

225-and security, in accordance with the provisions of section 11-4a, and the
226-Commissioner of Emergency Services and Public Protection an annual
227-report (A) relating to the activities, recommendations and
228-accomplishments of the commission, and (B) making recommendations
229-on the funding necessary for the operation of, the maintenance of and
230-capital improvements to the state fire school and regional fire schools.
231-(b) The commission may recommend, and the Commissioner of
232-Emergency Services and Public Protection may adopt, regulations in
233-accordance with the provisions of chapter 54 as necessary to implement
234-the provisions of this section.
235-Sec. 4. Section 7-323n of the general statutes is repealed and the
236-following is substituted in lieu thereof (Effective July 1, 2025):
237-[There is established an Office of State Fire Administration, which
238-office] The Division of State Fire Services Administration within the
239-Department of Emergency Services and Public Protection shall: [(a)] (1)
240-Carry out the provisions of this part; [(b)] (2) administer the state's
241-responsibilities under federal laws relevant to fire service; [(c)] (3)
242-develop a master plan for fire prevention and control; and [(d)] (4) carry
243-out any other function which the commission may devise. [Subject to
244-the provisions of chapter 67, the commission may appoint such clerical
245-and other assistants as it may deem necessary to carry out the provisions
246-of this section.]
247-Sec. 5. Section 7-323o of the general statutes is repealed and the
248-following is substituted in lieu thereof (Effective July 1, 2025):
249-(a) There is established the position of State Fire Administrator. [who]
250-Prior to July 1, 2025, the State Fire Administrator shall be recommended
251-by the Commission on Fire Prevention and Control and be appointed by
252-the Commissioner of Emergency Services and Public Protection. [and

193+commission shall be qualified, by experience or education, in the fields 141

207+commission on matters relating to fire schools. 155
208+[(e)] (f) The commission shall be within the Department of Emergency 156
209+Services and Public Protection. 157
210+Sec. 3. Section 7-323l of the general statutes is repealed and the 158
211+following is substituted in lieu thereof (Effective July 1, 2025): 159
212+(a) The commission shall: 160
213+(1) [Recommend] Establish and periodically update required 161
214+minimum standards of education and physical condition [required of 162
215+each candidate] for candidates for any firefighter position; 163
216+(2) Establish and periodically update required standards for [a] fire 164 Substitute Bill No. 5483

257-occurring on or after July 1, 2025, the Commission on Fire Prevention
258-and Control may recommend candidates for the position of State Fire
259-Administrator to the commissioner, and the commissioner shall appoint
260-such State Fire Administrator, who shall be qualified for the position by
261-at least five years of experience in the fire service.
262-(b) The Division of Fire Services Administration shall:
263-[(1) Carry out the requirements of section 7-323n; (2) administer]
264-(1) Administer federal funds and grants allocated to the fire services
265-of the state; [(3) provide]
266-(2) Provide technical assistance and guidance to fire fighting forces of
267-any state or municipal agency; [(4) develop]
268-(3) Develop a centralized information and audiovisual library
269-regarding fire prevention and control; [(5) accumulate]
270-(4) Accumulate, disseminate and analyze fire prevention data; [(6)
271-recommend]
272-(5) Recommend specifications of fire service materials and equipment
273-and assist in the purchasing thereof; [(7) assist]
274-(6) Assist in mutual aid coordination; [(8) coordinate]
275-(7) Coordinate fire programs with those of the other states; [(9) assist]
276-(8) Assist in communications coordination; [(10) establish]
277-(9) Establish and maintain a fire service information program; [and
278-(11) review]
279-(10) Review and approve the purchase of fire apparatus or equipment

302-(c) The provisions of this section shall not be construed to apply to
303-forest fire prevention and control programs administered by the
304-Commissioner of Energy and Environmental Protection pursuant to
305-sections 23-33 to 23-57, inclusive.
306-Sec. 6. Section 7-313m of the general statutes is repealed and the
307-following is substituted in lieu thereof (Effective July 1, 2025):
308-(a) Not later than January 1, 2022, and annually thereafter, the chief
309-of a volunteer fire department for a distressed municipality, as defined
310-in section 32-9p, shall submit to the [State Fire Administrator] Division Substitute House Bill No. 5483
223+service training and education [program, on a voluntary basis] 165
224+programs, and develop and conduct an examination program to certify 166
225+those fire service personnel who satisfactorily demonstrate their ability 167

233+higher education, health care professionals or advocacy organizations 175
234+that are concerned with juveniles and adults with autism spectrum 176
235+disorder, cognitive impairment or nonverbal learning disorder, or (B) 177
236+collaborations of such institutions, professionals or organizations; 178
237+(4) Conduct fire fighting training and education programs designed 179
238+to assist firefighters in developing and maintaining their skills and 180
239+keeping abreast of technological advances in fire suppression, fire 181
240+protection, fire prevention and related fields; 182
241+(5) [Recommend] Establish standards for promotion to the various 183
242+ranks of fire departments; 184
243+(6) Be authorized, with the approval of the Commissioner of 185
244+Emergency Services and Public Protection, to apply for, receive and 186
245+distribute any state, federal or private funds or contributions available 187
246+for training and education of fire fighting personnel; 188
247+(7) Recommend that the Commissioner of Emergency Services and 189
248+Public Protection approve or reject the establishment of, or, when 190
249+appropriate, suspend or revoke the approval of, regional fire schools in 191
250+accordance with section 7-323u; [and] 192
251+(8) Distribute any state, federal or private funds or contributions for 193
252+the daily operation of the state fire school and regional fire schools; and 194 Substitute Bill No. 5483

320-for purposes of calculating such average.
321-(b) For the fiscal year ending June 30, 2022, and each fiscal year
322-thereafter, the [State Fire Administrator] Division of Fire Services
323-Administration shall award a grant to any distressed municipality with
324-a volunteer fire department for the purposes of covering costs related to
325-the provision of Firefighter I certification and recruit training for
326-volunteer firefighters at regional fire schools. The amount of such grant
327-award for each such distressed municipality shall be equal to the
328-product of (1) the average cost of a Firefighter I certification and recruit
329-training program at a regional fire school, and (2) the average number
330-of volunteer firefighters from such distressed municipality's volunteer
331-fire department who enrolled at a regional fire school for such
332-certification and training.
333-(c) Not later than February 1, 2022, and annually thereafter, the [State
334-Fire Administrator] Division of Fire Services Administration shall
335-submit, in accordance with the provisions of section 11-4a, to the joint
336-standing committee of the General Assembly having cognizance of
337-matters relating to appropriations and the budgets of state agencies a
338-report on the (1) reports submitted by the chiefs of volunteer fire
339-departments of distressed municipalities pursuant to subsection (a) of
340-this section, and (2) average cost of a Firefighter I certification and
341-recruit training program at a regional fire school.
342-Sec. 7. Section 7-323s of the general statutes is repealed and the

273+following is substituted in lieu thereof (Effective July 1, 2025): 209
274+[There is established an Office of State Fire Administration, which 210
275+office] The Division of State Fire Services Administration within the 211
276+Department of Emergency Services and Public Protection shall: [(a)] (1) 212
277+Carry out the provisions of this part; [(b)] (2) administer the state's 213
278+responsibilities under federal laws relevant to fire service; [(c)] (3) 214
279+develop a master plan for fire prevention and control; and [(d)] (4) carry 215
280+out any other function which the commission may devise. [Subject to 216
281+the provisions of chapter 67, the commission may appoint such clerical 217
282+and other assistants as it may deem necessary to carry out the provisions 218

284+Sec. 5. Section 7-323o of the general statutes is repealed and the 220
285+following is substituted in lieu thereof (Effective July 1, 2025): 221

352-volunteer emergency personnel in entering into agreements authorizing
353-volunteer emergency personnel to serve during personal time.
354-(b) A municipality with paid municipal emergency personnel and a
355-municipality with volunteer emergency personnel may enter into an
356-agreement authorizing paid emergency personnel to serve during
357-personal time as active members of a volunteer fire department in the
358-municipality in which they reside. In developing such agreements, such
359-municipalities shall consider the model guidelines developed by the
360-[State Fire Administrator] Division of Fire Services Administration
361-within the Department of Emergency Services and Public Protection
362-pursuant to subsection (a) of this section.
363-(c) The municipalities that are parties to an agreement entered into
364-under subsection (b) of this section may request the Labor
365-Commissioner to provide assistance, within available appropriations, in
366-resolving such issues arising out of the agreement as the commissioner
367-deems appropriate.
368-Sec. 8. Section 7-323v of the general statutes is repealed and the
369-following is substituted in lieu thereof (Effective July 1, 2025):
370-(a) The [State Fire Administrator] Division of Fire Services
371-Administration within the Department of Emergency Services and
372-Public Protection shall, within available appropriations, pay five
373-hundred dollars to each volunteer fire company for each call to which it
374-responds on (1) a limited access highway, designated pursuant to
375-section 13b-27, (2) the section of the highway known as the Berlin
376-Turnpike, which begins at the end of the existing Wilbur Cross Parkway Substitute House Bill No. 5483

385-(b) No municipality that provides funds to a volunteer fire company
386-may reduce such funding based on the payments that such company
387-receives, or is anticipated to receive, under subsection (a) of this section.
388-Sec. 9. (NEW) (Effective July 1, 2025) Any regional fire school may
389-receive and use federal, state or private funds or contributions for the
390-facilities and operations of such school.
391-Sec. 10. (Effective from passage) (a) There is established a working
392-group to make recommendations regarding the structure and
393-operations of the Office of State Fire Marshal and the Office of Education
394-and Data Management within the Department of Administrative
395-Services in order to effectively administer code development, code
396-enforcement, fire prevention and fire investigation functions.
397-(b) The working group shall consist of the following members:
398-(1) The chairpersons, vice-chairpersons and ranking members of the
399-joint standing committee of the General Assembly having cognizance of
400-matters relating to public safety and security, or their designees;
401-(2) The Commissioner of Emergency Services and Public Protection,
402-or the commissioner's designee;
403-(3) The Commissioner of Administrative Services, or the
404-commissioner's designee;
405-(4) The head of the Office of Education and Data Management within
406-the Department of Administrative Services; and Substitute House Bill No. 5483

414-(c) All initial appointments to the working group shall be made not
415-later than July 1, 2024. Any vacancy shall be filled by the appointing
416-authority.
417-(d) The working group shall select a chairperson from among its
418-members. Such chairperson shall schedule the first meeting of the
419-working group, which shall be held not later than August 1, 2024.
420-(e) The administrative staff of the joint standing committee of the
421-General Assembly having cognizance of matters relating to public safety
422-and security shall serve as administrative staff of the working group.
423-(f) Not later than January 1, 2025, the working group shall submit a
424-report on its findings and recommendations to the joint standing
425-committee of the General Assembly having cognizance of matters
426-relating to public safety and security, in accordance with the provisions
427-of section 11-4a of the general statutes. The working group shall
428-terminate on the date that it submits such report or January 1, 2025,
429-whichever is later.
430-Sec. 11. Section 7-323j of the general statutes is repealed and the
431-following is substituted in lieu thereof (Effective July 1, 2024):
432-As used in this part, "commission" means the Commission on Fire
433-Prevention and Control; "municipality" means town, city, consolidated
434-town and city, consolidated town and borough, borough, school district,
435-fire district, fire and sewer district, sewer district, lighting district or any
436-other municipal corporation or taxing district upon which is placed the
437-duty of, or which has itself assumed the duty of, protecting its

523+(b) No municipality that provides funds to a volunteer fire company 417
524+may reduce such funding based on the payments that such company 418
525+receives, or is anticipated to receive, under subsection (a) of this section. 419
526+Sec. 10. Subsection (a) of section 14-103d of the general statutes is 420
527+repealed and the following is substituted in lieu thereof (Effective July 1, 421
528+2025): 422
529+(a) No motor vehicle which uses any pressurized gas except natural 423
530+gas or hydrogen as a fuel for its engine may enter or be parked in any 424
531+area that is under grade level. Any vehicle within the state which carries 425

543+Gas" or a standard abbreviation or symbol as determined by the [Office 431
544+of the State Fire Marshal] Division of Fire Services Administration 432
545+within the Department of Emergency Services and Public Protection, in 433
546+block letters at least two inches high, which letters shall be of contrasting 434
547+colors and shall be placed as near as possible to the area where the tank 435
548+is located. No person may dispense any pressurized gas used as a 436
549+vehicle fuel into any tank in a concealed area of a vehicle unless the 437
550+vehicle is in compliance with the requirements of this subsection. The 438
551+Commissioner of Motor Vehicles shall adopt regulations in accordance 439
552+with the provisions of chapter 54 to carry out the provisions of this 440
553+section. 441
554+Sec. 11. Subsection (a) of section 19a-510a of the general statutes is 442
555+repealed and the following is substituted in lieu thereof (Effective July 1, 443
556+2025): 444
557+(a) The attending physician, the director of a health care institution, 445
558+his designee, or any health care provider shall report the provision of 446
559+treatment for (1) a second or third degree burn to five per cent or more 447
560+of the body, (2) any burn to the upper respiratory tract, (3) laryngeal 448
561+edema due to the inhalation of superheated air, (4) each case of a burn 449
562+injury which is likely to or may result in death, and (5) any injury 450
563+resulting from the use of fireworks, immediately, by telephone, to the 451
564+local fire marshal of the jurisdiction where the incident which caused 452
565+the burn occurred, and within forty-eight hours, in writing, to the 453
566+[Office of the State Fire Marshal] Division of Fire Services 454
567+Administration within the Department of Emergency Services and 455
568+Public Protection on forms provided by that office. The office shall 456
569+compile the information and publish a statistical abstract to be 457
570+submitted annually to local fire marshals and the General Assembly. 458
571+Sec. 12. Subdivision (10) of section 20-330 of the general statutes is 459 Substitute Bill No. 5483

590+shall, within available appropriations, establish and administer a pilot 472
591+program for the purpose of implementing a data collection system 473
592+related to fire and rescue service delivery in the state. For a period of 474
593+three years commencing from July 1, 2022, the commissioner shall 475
594+administer such pilot program in any local or regional fire department 476
595+or district that has self-identified as challenged or in crisis regarding the 477
596+delivery of fire and rescue services. 478
597+Sec. 14. Section 29-250 of the general statutes is repealed and the 479
598+following is substituted in lieu thereof (Effective July 1, 2025): 480
599+There shall be [(1) an Office of the State Fire Marshal, and (2)] an 481
600+Office of the State Building Inspector, within the Department of 482
601+Administrative Services. The head of [each] said office shall report to the 483
602+Commissioner of Administrative Services. 484
603+Sec. 15. Section 29-291 of the general statutes is repealed and the 485
604+following is substituted in lieu thereof (Effective July 1, 2025): 486
605+For the purposes of this part and any other statute related to fire 487
606+prevention and safety, the Commissioner of [Administrative Services] 488

620+provided the commissioner and the president of The University of 496
621+Connecticut enter into a memorandum of understanding concerning 497
622+such delegation of powers in accordance with section 10a-109ff, and (3) 498
623+the Connecticut Airport Authority upon any premises, road or land 499
624+under the control of the authority, provided the commissioner and the 500
625+executive director of the authority enter into a memorandum of 501
626+understanding concerning such delegation of powers. 502
627+Sec. 16. Section 29-291e of the general statutes is repealed and the 503
628+following is substituted in lieu thereof (Effective July 1, 2025): 504
629+(a) For the purposes of this section, "proposed code" means a 505
630+proposal by the State Fire Marshal, in coordination with the advisory 506
631+committee for a new State Fire Prevention Code or for a change in, 507
632+addition to or repeal of any provision of the State Fire Prevention Code 508
633+and "advisory committee" means the advisory committee established 509
634+under subsection (b) of section 29-291a. 510
635+(b) Notwithstanding the provisions of chapter 54, the adoption of the 511
636+State Fire Prevention Code and any amendments thereto shall not be 512
637+required to comply with the provisions of chapter 54, except as provided 513
638+in this section. 514
639+(c) Prior to the adoption of the State Fire Prevention Code and any 515
640+amendments thereto, the State Fire Marshal shall (1) post any proposed 516
641+code, a statement of purpose for which the proposed code is proposed, 517
642+a fiscal note associated with compliance with the proposed code 518
643+prepared pursuant to section 4-168 and a regulatory flexibility analysis 519
644+prepared pursuant to section 4-168a on the Internet web site of the 520
645+Department of [Administrative Services] Emergency Services and 521 Substitute Bill No. 5483

659+proposed code not less than twenty nor more than thirty-five days after 529
660+such posting. 530
661+(d) After the close of the public comment period, the State Fire 531
662+Marshal, in coordination with the advisory committee, shall respond to 532
663+each written and oral comment respecting the proposed code received 533
664+during the public comment period and at the public hearing. Such 534
665+response shall include any change made to the proposed code if 535
666+applicable, and the rationale for such change. The State Fire Marshal 536
667+shall post such response on the Internet web site of the Department of 537
668+[Administrative Services] Emergency Services and Public Protection not 538
669+later than thirty days after the close of the public comment period. 539
670+(e) The State Fire Marshal, in coordination with the advisory 540
671+committee, shall create and maintain a code-making record for each 541
672+proposed code, submit such code-making record electronically to the 542
673+standing legislative regulation review committee and the joint standing 543
674+committee of the General Assembly having cognizance of matters 544
675+relating to public safety and security, and post such code-making record 545
676+on the Internet web site of the Department of [Administrative Services] 546
677+Emergency Services and Public Protection. Such code-making record 547
678+shall include, but need not be limited to: (1) The final wording of the 548
679+proposed code in a format consistent with a nationally recognized 549
680+model building code, (2) the fiscal note prepared pursuant to subsection 550
681+(c) of this section, (3) the regulatory flexibility analysis prepared 551
682+pursuant to subsection (c) of this section, (4) all written and oral 552
683+comments received during the public comment period, and (5) the 553
684+response to such comments prepared pursuant to subsection (d) of this 554 Substitute Bill No. 5483

694+submitted to the committee pursuant to subsection (e) of this section to 558

696+the proposed code, in whole or in part. If the proposed code is 560
697+withdrawn, the State Fire Marshal shall resubmit the proposed code and 561
698+the committee shall have not more than forty-five days from the date of 562
699+such resubmittal to convene a meeting to approve, disapprove or reject 563
700+without prejudice the resubmitted proposed code. If the committee 564
701+notifies the State Fire Marshal in writing that it is waiving its right to 565
702+convene a meeting or does not act on a proposed code or a resubmitted 566
703+proposed code, as the case may be, within such forty-five-day period, 567
704+the proposed code or resubmitted proposed code shall be deemed to be 568
705+approved by the committee. 569
706+(g) If the committee disapproves a proposed code, in whole or in part, 570
707+the committee shall notify the State Fire Marshal of the disapproval and 571
708+the reasons for the disapproval. The State Fire Marshal shall not take 572
709+any action to implement such disapproved code, except that the State 573
710+Fire Marshal may submit a substantively new proposed code in 574
711+accordance with the provisions of this section, provided the General 575
712+Assembly may reverse such disapproval in accordance with the 576
713+provisions of section 4-171. 577
714+(h) If the committee rejects a proposed code without prejudice, in 578
715+whole or in part, the committee shall notify the State Fire Marshal of the 579
716+reasons for the rejection and the State Fire Marshal shall resubmit the 580
717+proposed code in revised form to the committee not later than thirty 581
718+days after the date of rejection without prejudice. Each resubmission of 582
719+the proposed code under this subsection shall include a summary of any 583
720+revisions to the proposed code. The committee shall have not more than 584
721+forty-five days after the receipt of the resubmittal to review and take 585
722+action on such resubmitted proposed code in the same manner as 586

734+[Administrative Services] Emergency Services and Public Protection, 592
735+except that: (1) If a later date is required by statute or specified in the 593
736+code, the later date is the effective date, and (2) a code may not be 594
737+effective before the effective date of the public act requiring or 595
738+permitting the code. Such posting shall include a statement by the State 596
739+Fire Marshal certifying that the electronic copy of the code is a true and 597
740+accurate copy of the code approved or deemed approved in accordance 598
741+with subsection (f) of this section. The electronic copy of the State Fire 599
742+Prevention Code posted on the Internet web site of the Department of 600
743+[Administrative Services] Emergency Services and Public Protection 601
744+shall be the official version for all purposes, including all legal and 602
745+administrative proceedings. 603
746+(j) No provision of the State Fire Prevention Code or any amendment 604
747+thereto adopted after May 31, 2016, is valid unless adopted in 605
748+substantial compliance with the requirements of this section. A 606
749+proceeding to contest any provision of the code on the ground of 607
750+noncompliance with the requirements of this section shall be 608
751+commenced within two years from the effective date of the code. 609
752+(k) The State Fire Marshal shall advise the public concerning how to 610
753+obtain a copy of the State Fire Prevention Code and any amendments 611
754+thereto. 612
755+Sec. 17. Section 29-292a of the general statutes is repealed and the 613
756+following is substituted in lieu thereof (Effective July 1, 2025): 614
757+(a) For the purposes of this section, "proposed code" means a 615
758+proposal by the State Fire Marshal and the Codes and Standards 616
759+Committee for a new Fire Safety Code or for a change in, addition to or 617

860+later date is required by statute or specified in the code, the later date is 700
861+the effective date, and (2) a code may not be effective before the effective 701
862+date of the public act requiring or permitting the code. Such posting 702
863+shall include a statement by the State Fire Marshal certifying that the 703
864+electronic copy of the code is a true and accurate copy of the code 704
865+approved or deemed approved in accordance with subsection (f) of this 705
866+section. The electronic copy of the Fire Safety Code posted on the 706
867+Internet web site of the Department of [Administrative Services] 707
868+Emergency Services and Public Protection shall be the official version 708
869+for all purposes, including all legal and administrative proceedings. 709
870+(j) No provision of the Fire Safety Code or any amendment thereto 710
871+adopted after May 31, 2016, is valid unless adopted in substantial 711
872+compliance with the requirements of this section. A proceeding to 712
873+contest any provision of the code on the ground of noncompliance with 713
874+the requirements of this section shall be commenced within two years 714
875+from the effective date of the code. 715
876+(k) The State Fire Marshal shall advise the public concerning how to 716

888+Emergency Services and Public Protection in accordance with section 722
889+29-292a, as amended by this act, and, in addition, a copy shall be 723
890+provided to each local fire marshal, fire chief and building inspector, 724
891+and other governmental officials who request said code. 725
892+Sec. 19. Section 29-298a of the general statutes is repealed and the 726
893+following is substituted in lieu thereof (Effective July 1, 2025): 727
894+There shall be established within the Department of [Administrative 728
895+Services] Emergency Services and Public Protection a Fire Marshal 729
896+Training Council which shall advise the State Fire Marshal and the 730
897+Codes and Standards Committee on all matters pertaining to (1) 731
898+certification training programs, (2) decertification hearings, (3) in-732
899+service training for fire marshals in the state, and (4) programs for all 733
900+other persons eligible to receive training pursuant to subsections (a) to 734
901+(c), inclusive, of section 29-251c. The council shall be composed of 735
902+twelve members as follows: The State Fire Marshal or his designee; a 736
903+member of the Codes and Standards Committee to be elected by such 737
904+committee; three members appointed by the Connecticut Fire Marshals 738
905+Association, one of whom shall be a volunteer, one of whom shall be a 739
906+part-time paid, and one of whom shall be a full-time, local fire marshal, 740
907+deputy fire marshal or fire inspector; one member appointed by the 741
908+Board of Regents for Higher Education; two members appointed by the 742
909+Board of Trustees for the Community-Technical Colleges; the chief 743
910+elected official of a municipality having a population in excess of 744
911+seventy thousand persons, appointed by the Governor; the chief elected 745
912+official of a municipality having a population of less than seventy 746
913+thousand persons, appointed by the Governor; and two public 747
914+members, appointed by the Governor. Members shall be residents of 748
915+this state and shall not be compensated for their services but shall be 749
916+reimbursed for necessary expenses incurred in the performance of their 750 Substitute Bill No. 5483

924+Sec. 20. Section 29-312 of the general statutes is repealed and the 752

927+and Public Protection may appoint a Deputy State Fire Marshal who 755
928+shall be subject to the supervision and direction of the [Commissioner 756
929+of Administrative Services] commissioner and be vested with all the 757
930+powers conferred upon the State Fire Marshal by section 29-310. 758
931+Sec. 21. Section 29-315c of the general statutes is repealed and the 759
932+following is substituted in lieu thereof (Effective July 1, 2025): 760
933+The Commissioner of [Administrative Services] Emergency Services 761
934+and Public Protection may establish, within available appropriations, a 762
935+public awareness campaign to educate the public concerning the 763
936+dangers of not having smoke and carbon monoxide detection and 764
937+warning equipment in residential dwellings and to promote the 765
938+installation of smoke and carbon monoxide detection and warning 766
939+equipment in all residential dwellings. 767
940+Sec. 22. Section 29-319 of the general statutes is repealed and the 768
941+following is substituted in lieu thereof (Effective July 1, 2025): 769
942+As used herein, "emergency" means the existence in any community 770
943+of general distress because of a shortage of fuel, or threatened distress 771
944+because of probable shortage of fuel, when public proclamation to that 772
945+effect is made by the Governor; "hoard" means the withholding by any 773
946+person, firm or corporation dealing in fuel of the same from sale or 774
947+delivery at a reasonable price during an emergency; and "profiteer" 775
948+means to hold for sale, or sell, fuel at an excessive profit, or charge an 776
949+excessive rate or place unreasonable restrictions or conditions upon the 777
950+sale, delivery or transportation of fuel. Whenever the Governor, by 778
951+public proclamation, declares that an emergency exists, the provisions 779
952+hereof may be enforced from the date of such proclamation until, in like 780
953+manner, he declares the emergency at an end. During such emergency, 781 Substitute Bill No. 5483

963+Each person, firm or corporation dealing in fuel shall make and keep 785
964+accurate and complete written records of all transactions concerning the 786
965+same, showing, as to each purchase and sale, the date, kind, quantity 787
966+and price, the name and address of the vendor and vendee and the 788
967+identity of the agency of delivery. No person, firm or corporation shall 789
968+knowingly give any false, deceiving or misleading information, or 790
969+knowingly engage in any transaction that is calculated to create false, 791
970+deceiving or misleading information, or knowingly incorporate or 792
971+permit to remain in his or its books, accounts or other printed or written 793
972+record any information that is calculated to create or convey false, 794
973+deceiving or misleading information essential to the ascertainment of 795
974+the facts concerning his or its dealings and profit in fuel. During any 796
975+emergency, the Labor Commissioner, any member of the Labor 797
976+Department under his direction and any local fire marshal shall have 798
977+and exercise, in the enforcement of this section, the same powers of 799
978+investigation, as far as applicable, as are conferred upon local fire 800
979+marshals under the provisions of this part, and the commissioner, in the 801
980+enforcement of this section, shall have and exercise the same powers, as 802
981+far as applicable, as are conferred upon the Commissioner of 803
982+[Administrative Services] Emergency Services and Public Protection by 804
983+the provisions of section 29-310. Any person, firm or corporation 805
984+violating any provision of this section shall be fined not more than one 806
985+thousand dollars or imprisoned not more than six months, or both. 807
986+Sec. 23. Subsection (b) of section 29-417 of the general statutes is 808
987+repealed and the following is substituted in lieu thereof (Effective July 1, 809
988+2025): 810
989+(b) Cigarettes to be sold, or offered for sale, to consumers within this 811
990+state, whether directly or through a distributor, dealer, or similar 812
991+intermediary or intermediaries, shall: (1) Have been tested in 813
992+accordance with the test method specified in section 29-418, as amended 814 Substitute Bill No. 5483

999+by this act, and meet the performance standard specified in section 29-815
1000+418, as amended by this act; (2) have been listed in a written certification 816
1001+submitted to the [Office of the State Fire Marshal] Division of Fire 817
1002+Services Administration within the Department of Emergency Services 818
1003+and Public Protection in accordance with section 29-419, as amended by 819
1004+this act; and (3) be in packages marked in accordance with section 29-820
1005+421. 821
1006+Sec. 24. Section 29-418 of the general statutes is repealed and the 822
1007+following is substituted in lieu thereof (Effective July 1, 2025): 823
1008+(a) All testing by or on behalf of a holder of a cigarette manufacturer's 824
1009+license or by or on behalf of the [Office of the State Fire Marshal] 825
1010+Division of Fire Services Administration within the Department of 826
1011+Emergency Services and Public Protection to determine a cigarette's 827
1012+compliance with the performance standard specified in this section shall 828
1013+be conducted in accordance with the following requirements: 829
1014+(1) Testing of cigarettes shall be conducted in accordance with the 830
1015+American Society of Testing and Materials or "ASTM" standard E2187-831
1016+04, "Standard Test Method for Measuring the Ignition Strength of 832
1017+Cigarettes" or a subsequent ASTM Standard Test Method for Measuring 833
1018+the Ignition Strength of Cigarettes upon a finding by the State Fire 834
1019+Marshal that such subsequent method does not result in a change in the 835
1020+percentage of full-length burns exhibited by any tested cigarette when 836
1021+compared to the percentage of full-length burns the same cigarette 837
1022+would exhibit when tested in accordance with ASTM standard E2187-838
1023+04 and the performance standard in subdivision (3) of this subsection; 839
1024+(2) Testing shall be conducted on ten layers of filter paper; 840
1025+(3) Not more than twenty-five per cent of the cigarettes tested in a test 841
1026+trial in accordance with this section shall exhibit full-length burns. Forty 842
1027+replicate tests shall comprise a complete test trial for each cigarette 843
1028+tested; 844
1029+(4) The performance standard required by this section shall only be 845 Substitute Bill No. 5483

1036+applied to a complete test trial; 846
1037+(5) Written certifications shall be based upon testing conducted by a 847
1038+laboratory that has been accredited pursuant to standard ISO or IEC 848
1039+17025 of the International Organization for Standardization or such 849
1040+other comparable accreditation standard as the [Office of the State Fire 850
1041+Marshal] Division of Fire Services Administration within the 851
1042+Department of Emergency Services and Public Protection may require 852
1043+by regulation; 853
1044+(6) Laboratories conducting testing in accordance with this section 854
1045+shall implement a quality control and quality assurance program that 855
1046+includes a procedure that will determine the repeatability of the testing 856
1047+results. The repeatability value shall be no greater than 0.19. Such 857
1048+program ensures that the testing repeatability remains within the 858
1049+required repeatability value set forth in this subdivision for all test trials 859
1050+used to certify cigarettes in accordance with this section and section 29-860
1051+419, as amended by this act; and 861
1052+(7) No additional testing under this section is required if cigarettes 862
1053+are tested consistent with this section for any other purpose. 863
1054+(b) Each cigarette that uses lowered permeability bands in the 864
1055+cigarette paper to achieve compliance with the performance standard 865
1056+set forth in this section shall have not less than two nominally identical 866
1057+bands on the paper surrounding the tobacco column. At least one 867
1058+complete band shall be located not less than fifteen millimeters from the 868
1059+lighting end of the cigarette. For cigarettes on which the bands are 869
1060+positioned by design, there shall be not less than two bands fully located 870
1061+at least fifteen millimeters from the lighting end and ten millimeters 871
1062+from the filter end of the tobacco column, or ten millimeters from the 872
1063+labeled end of the tobacco column for nonfiltered cigarettes. 873
1064+(c) A holder of a cigarette manufacturer's license that manufactures a 874
1065+cigarette that the State Fire Marshal determines cannot be tested in 875
1066+accordance with the test method prescribed in subdivision (1) of 876 Substitute Bill No. 5483

1073+subsection (a) of this section may propose an alternate test method and 877
1074+performance standard for the cigarette to the State Fire Marshal. Upon 878
1075+approval and a determination by the State Fire Marshal that the 879
1076+performance standard proposed by the holder is equivalent to the 880
1077+performance standard prescribed in subdivision (3) of subsection (a) of 881
1078+this section, the holder may employ such test method and performance 882
1079+standard to certify such cigarette pursuant to section 29-419, as 883
1080+amended by this act. If the State Fire Marshal determines that another 884
1081+state has enacted reduced cigarette ignition propensity standards that 885
1082+include a test method and performance standard that are the same as 886
1083+those contained in this section, and the State Fire Marshal finds that the 887
1084+officials responsible for implementing those requirements have 888
1085+approved the proposed alternative test method and performance 889
1086+standard for a particular cigarette proposed by a holder as meeting the 890
1087+reduced cigarette ignition propensity standards of that state's law or 891
1088+regulations under a legal provision comparable to this section, then the 892
1089+State Fire Marshal shall authorize that holder to employ the alternative 893
1090+test method and performance standard to certify that cigarette for sale 894
1091+in this state, unless the State Fire Marshal has a reasonable basis for 895
1092+deciding that the alternative test should not be accepted under said 896
1093+sections. All other applicable requirements of this section shall apply to 897
1094+the holder. 898
1095+(d) Each holder of a cigarette manufacturer's license shall maintain 899
1096+copies of the reports of all tests conducted on all cigarettes with respect 900
1097+to which such holder has submitted written certification in accordance 901
1098+with the provisions of section 29-419, as amended by this act. Such 902
1099+holder shall provide copies of the reports available to the [Office of the 903
1100+State Fire Marshal] Division of Fire Services Administration within the 904
1101+Department of Emergency Services and Public Protection and to the 905
1102+office of the Attorney General upon written request. Any holder that 906
1103+fails to provide such copies not later than sixty days after receiving a 907
1104+written request shall be subject to a civil penalty not to exceed ten 908
1105+thousand dollars for each day after the sixtieth day that the holder does 909

1113+Sec. 25. Subsection (a) of section 29-419 of the general statutes is 911
1114+repealed and the following is substituted in lieu thereof (Effective July 1, 912

1116+(a) Each holder of a cigarette manufacturer's license shall submit to 914
1117+the [Office of the State Fire Marshal] Division of Fire Services 915
1118+Administration within the Department of Emergency Services and 916
1119+Public Protection a written certification every three years attesting that: 917
1120+(1) Each cigarette listed in the certification has been tested in accordance 918
1121+with section 29-418, as amended by this act; and (2) each cigarette listed 919
1122+in the certification meets the performance standard set forth in section 920
1123+29-418, as amended by this act. 921
1124+Sec. 26. Subsection (a) of section 29-420 of the general statutes is 922
1125+repealed and the following is substituted in lieu thereof (Effective July 1, 923
1126+2025): 924
1127+(a) Not later than July 1, 2008, the [Office of the State Fire Marshal] 925
1128+Division of Fire Services Administration within the Department of 926
1129+Emergency Services and Public Protection shall develop and make 927
1130+available for public inspection, on its web site and in such other forms 928
1131+as the State Fire Marshal deems appropriate, a Connecticut Fire Safe 929
1132+Cigarette Directory listing of all holders that have provided current 930
1133+certifications conforming to the requirements of section 29-419, as 931
1134+amended by this act, and all cigarettes that are listed in such 932
1135+certifications. The State Fire Marshal shall update the directory as 933
1136+necessary in order to correct mistakes and to add or remove a holder or 934
1137+cigarette to keep the directory current and in conformity with the 935
1138+requirements of sections 29-416 to 29-421, inclusive. 936
1139+Sec. 27. Subsection (d) of section 29-453 of the 2024 supplement to the 937
1140+general statutes is repealed and the following is substituted in lieu 938
1141+thereof (Effective July 1, 2025): 939
1142+(d) The [Office of the State Fire Marshal] Division of Fire Services 940

1156+and warning equipment requirements to assist transferors with the 948
1157+completion of such affidavit. 949
