1819 AN ACT CONCERNING THE TEACHERS' RETIREMENT BOARD'S
1920 RECOMMENDATIONS FOR CHANGES TO THE TEACHERS'
2021 RETIREMENT SYSTEM STATUTES.
2122 Be it enacted by the Senate and House of Representatives in General

2425 Section 1. Subdivision (15) of section 10-183b of the 2024 supplement 1
2526 to the general statutes is repealed and the following is substituted in lieu 2

2728 (15) "Employer" means an elected school committee, a board of 4
2829 education, the State Board of Education, the Office of Early Childhood, 5
2930 the Technical Education and Career System, the Board of Regents for 6

4345 (21) "Public school" means any day school conducted within or 16
4446 without this state under the orders and superintendence of a duly 17
4547 elected school committee, a board of education, the State Board of 18
4648 Education, the Office of Early Childhood, the Board of Regents for 19
4749 Higher Education, or any of its constituent units, The University of 20
4850 Connecticut Board of Trustees, the board of governors or any of its 21
4951 constituent units, the Technical Education and Career System, the E. O. 22

5759 supported by the state at which teachers are employed or any 30
5860 incorporated secondary school not under the orders and 31
5961 superintendence of a duly elected school committee or board of 32
6062 education but located in a town not maintaining a high school and 33
6163 providing free tuition to pupils of the town in which it is located, and 34
6264 which has been approved by the State Board of Education under the 35
6365 provisions of part II of chapter 164, or (B) on and after July 1, 2023, any 36
6466 school operated by an interdistrict magnet school operator described in 37
6567 section 10-264s, provided such institution, secondary school or school is 38
6668 classified as a public school by the retirement board. 39
6769 Sec. 3. Subsection (g) of section 10-183g of the general statutes is 40
6870 repealed and the following is substituted in lieu thereof (Effective July 1, 41
6971 2024): 42
7072 (g) A member's complete formal application for retirement, if sent by 43
7173 mail, shall be deemed to have been filed with the board on the date such 44
7274 application is postmarked. Such application for retirement shall be 45
7375 irrevocable on the date the member retires. No benefit computed under 46
74-subsections (a) to (d), inclusive, of this section and under subsections (a) 47 Bill No. 377

7982 to (g), inclusive, of section 10-183aa shall become effective until a 48
8083 member eligible for retirement under section 10-183f files with the board 49
8184 a complete formal application for retirement and terminates service 50
8285 with such member's employer. Such benefit shall accrue from the first 51
8386 day of the month following the calendar month in which such 52
8487 application is filed and payment of such benefit in equal monthly 53
8588 installments shall commence on the last day of the month in which such 54
8689 benefit begins to accrue. The initial payment of such benefit may be 55
8790 made not later than three months following the effective date of 56
8891 retirement, provided such payment shall be retroactive to such effective 57
8992 date. Upon a finding that extenuating circumstances relating to the 58
9093 health of a member caused a delay in the filing of the member's complete 59
9194 formal application, and such application is filed on or after July 1, 1986, 60
9295 the board may deem such application to have been filed up to three 61
9396 months earlier than the actual date of the filing. Upon a finding that 62
9497 extenuating circumstances related to the health of a member caused a 63
9598 delay in the filing of an election pursuant to subsection (g) of section 10-64
9699 183aa, and such election is filed on or after July 1, 1986, the board may 65
97100 deem such election to have been filed as of the date such member's 66
98101 benefits would otherwise have been converted to a normal retirement 67
99102 benefit under this section. 68
100103 Sec. 4. Subsection (c) of section 10-183h of the general statutes is 69
101104 repealed and the following is substituted in lieu thereof (Effective July 1, 70
102105 2024): 71
103106 (c) In lieu of a basic survivor's benefit and a lump sum death benefit, 72
104107 a [sole] survivor who has attained age eighteen, and is the member's 73
105108 designated beneficiary may elect to receive an amount equal to such 74
106109 member's accumulated contributions together with credited interest. In 75
107110 the absence of a designation, the member's surviving spouse or, if none, 76
108111 the member's surviving children in equal shares or, if none, the 77
109112 member's estate, shall be entitled to the lump sum payment of the 78
110113 accumulated contributions with credited interest. 79

118122 (a) (1) On and after July 1, 1991, the management of the system shall 83
119123 continue to be vested in the Teachers' Retirement Board, whose 84
120124 members shall include the Treasurer, the Secretary of the Office of Policy 85
121125 and Management and the Commissioner of Education, or the ir 86
122126 designees, who shall be voting members of the board, ex officio. (2) On 87
123127 or before June 15, 1985, and quadrennially thereafter, the members of 88
124128 the system shall elect from their number, in a manner prescribed by said 89
125129 board, two persons to serve as members of said board for terms of four 90
126130 years beginning July first following such election. Both of such persons 91
127131 shall be active teachers who shall be nominated by the members of the 92
128132 system who are not retired and elected by all the members of the system. 93
129133 On or before July 1, 1991, and quadrennially thereafter, the members of 94
130134 the system shall elect from their number, in a manner prescribed by said 95
131135 board, three persons to serve as members of said board for terms of four 96
132136 years beginning July first following such election. Two of such persons 97
133137 shall be retired teachers who shall be nominated by the retired members 98
134138 of the system and elected by all the members of the system and one shall 99
135139 be an active teacher who shall be nominated by the members of the 100
136140 system who are not retired and elected by all the members of the system. 101
137141 (3) On or before July 1, 2011, and quadrennially thereafter, the members 102
138142 of the system shall elect from their number, in a manner prescribed by 103
139143 said board, one person to serve as a member of said board for a term of 104
140144 four years beginning July first following such election. Such person shall 105
141145 be an active teacher who shall be nominated by the members of the 106
142146 system who are not retired, elected by all the members of the system 107
143147 and a member of an exclusive representative of a teachers' bargaining 108
144148 unit that is not represented by the members of the board elected under 109
145149 subdivision (2) of this subsection. (4) On or before October 1, 2023, and 110
146150 in July quadrennially thereafter, the retired members of the system shall 111
147151 elect from their number, in a manner prescribed by said board, two 112
148152 persons to serve as members of said board for a term of four years 113

154159 shall be (A) retired teachers who are receiving a pension benefit from 115
155160 the system, and (B) nominated and elected by the members of the 116
156161 system who are retired. (5) If a vacancy occurs in the positions filled by 117
157162 the members of the system who are not retired, said board shall elect a 118
158163 member of the system who is not retired to fill the unexpired portion of 119
159164 the term. If a vacancy occurs in the positions filled by the retired 120
160165 members of the system, said board shall elect a retired member of the 121
161166 system to fill the unexpired portion of the term. The Governor shall 122
162167 appoint five public members to said board in accordance with the 123
163168 provisions of section 4-9a, one of whom shall be the mayor, first 124
164169 selectman or chief elected official of a municipality. On and after 125
165170 October 31, 2017, the Governor shall fill the next vacant position on the 126
166171 board that is appointed by the Governor with a person who is the 127
167172 mayor, first selectman or chief elected official of a municipality. The 128
168173 members of the board shall serve without compensation, but shall be 129
169174 reimbursed for any expenditures or loss of salary or wages which they 130
170175 incur through service on the board. A majority of the membership of the 131
171176 board shall constitute a quorum for the transaction of any business. 132
172177 Sec. 6. Subsection (b) of section 4d-80 of the general statutes is 133
173178 repealed and the following is substituted in lieu thereof (Effective July 1, 134
174179 2024): 135
175180 (b) The Governor shall appoint a chairperson from among the 136
176181 members of the commission or their designees. Subject to the provisions 137
177182 of chapter 67, and within available appropriations, the commission may 138
178183 appoint an executive director and such other employees as may be 139
179184 necessary for the discharge of the duties of the commission. 140
180185 Notwithstanding any provision of the general statutes, the executive 141
181186 director shall have the option to elect participation in the state 142
182187 employees retirement system, or the alternate retirement program 143
