1019 AN ACT ADDING CERTAIN PLANTS TO THE INVASIVE PLANTS LIST.
1120 Be it enacted by the Senate and House of Representatives in General
1221 Assembly convened:

1423 Section 1. Section 22a-381d of the general statutes is repealed and the 1
1524 following is substituted in lieu thereof (Effective from passage): 2
1625 (a) Except as provided in subsection (d) of this section and 3
1726 notwithstanding the provisions of any ordinance adopted by a 4
1827 municipality, no person shall import, move, sell, purchase, transplant, 5
1928 cultivate or distribute any of the following invasive plants: (1) Curly 6
2029 leaved Pondweed (Potamogeton crispus); (2) fanwort (Cabomba 7
2130 caroliniana); (3) eurasian water milfoil (Myriophyllum spicatum); (4) 8

6474 (b) (1) Except as provided in subsection (d) of this section and 47

8697 (2) Except as provided in subsection (d) of this section and 65
8798 notwithstanding the provisions of any ordinance adopted by a 66
8899 municipality, on or after October 1, 2024, no person shall import, move, 67
89100 sell, purchase, transplant, cultivate or distribute any of the following 68
90101 invasive plants: (A) Porcelainberry (Ampelopsis brevipedunculata), (B) 69
91102 mugwort (Artemisia vulgaris), (C) quackgrass (Elymus repens), (D) 70
92103 Japanese angelica tree (Aralia elata), (E) Japanese wisteria (Wisteria 71
93104 floribunda), and (F) Chinese wisteria (Wisteria sinensis). 72
94105 (3) Except as provided in subsection (d) of this section and 73
95106 notwithstanding the provisions of any ordinance adopted by a 74
96107 municipality, on or after October 1, 2027, no person shall import, move, 75
97108 sell, purchase, transplant, cultivate or distribute callery pear (Pyrus 76
98109 calleryana). 77
99110 (4) Except as provided in subsection (d) of this section and 78
100111 notwithstanding the provisions of any ordinance adopted by a 79
101112 municipality, on or after October 1, 2028, no person shall import, move, 80

116128 sell, purchase, transplant, cultivate or distribute Norway maple (Acer 91

118130 (c) Except as provided in subsection (d) of this section, and 93
119131 notwithstanding the provisions of any ordinance adopted by a 94
120132 municipality, no person shall move, import, sell, purchase, transplant, 95
121133 cultivate or distribute any reproductive portion of any invasive plant 96
122134 listed in subsection (a) or (b) of this section. For the purposes of this 97
123135 section, "reproductive portion" includes, but is not limited to, seeds, 98
124136 flowers, roots and tubers. 99
125137 (d) The provisions of subsections (a) to (c), inclusive, of this section 100
126138 shall not apply to the moving for eradication, research or educational 101
127139 purposes of any invasive plant listed in subsection (a) or (b) of this 102
128140 section or of any reproductive portion of such an invasive plant or to the 103
129141 cultivating for research purposes of any such plant or reproductive 104
130142 portion. 105
131143 (e) [From July 1, 2009, until October 1, 2014, no] No municipality shall 106
132144 adopt any ordinance regarding the retail sale or purchase of any 107
133145 invasive plant. 108
134146 (f) Any person who violates the provisions of this section shall be 109
135147 fined not more than one hundred dollars per plant. 110
136148 This act shall take effect as follows and shall amend the following
