1219 AN ACT CONCERNING PARTICIPATION IN THE TIRE STEWARDSHIP
1320 PROGRAM BY TIRE RETAILERS.
1421 Be it enacted by the Senate and House of Representatives in General
1522 Assembly convened:

1724 Section 1. Subsections (b) and (c) of section 22a-905i of the general 1
1825 statutes are repealed and the following is substituted in lieu thereof 2
1926 (Effective from passage): 3
2027 (b) On or before January 1, 2025, each producer, or such producer's 4
2128 designee, shall join a tire stewardship organization and such 5
2229 organization shall submit a plan, for the Commissioner of Energy and 6
2330 Environmental Protection's approval, to establish a state-wide tire 7
2431 stewardship program, as described in this subsection. [Any retailer may 8
2532 participate in any such tire stewardship organization.] On or before 9
2633 January 1, 2026, each retailer shall participate in a tire stewardship 10
2734 organization. Such tire stewardship program shall, to the extent it is 11
2835 technologically feasible and economically practical: (1) Establish and 12
2936 manage a state-wide collection system utilizing covered entities; (2) 13
3037 provide access to the collection system to the public, free of charge, for 14
3138 the drop-off of discarded tires; (3) ensure discarded tires are picked up 15
3239 from the collection system and transported for recycling; (4) ensure all 16

3345 discarded tires collected in the collection system are resold or recycled; 17
3446 (5) provide suitable storage containers for tires, as required, throughout 18

47+the collection system; (6) implement public promotion and education 19
4048 about the program; (7) assist in market development, as needed, to 20
4149 achieve performance goals; (8) finance all program activities solely 21
4250 through producer funding; and (9) ensure that all collectors and 22
4351 processors are qualified to perform their respective functions pursuant 23
4452 to such program and are in substantial compliance with the laws and 24
4553 regulations of any state in which such collector or processor operates, 25
4654 including, but not limited to, any financial assurance and closure plan 26
4755 requirements. 27
4856 (c) Any plan submitted pursuant to subsection (b) of this section shall: 28
49-(1) Identify each producer participating in the program and, on and after 29
50-January 1, 2026, identify each retailer participating in the program, in 30
51-accordance with subsection (g) of this section; (2) describe how the 31
52-program will be financed; (3) establish performance goals for the first 32
53-two years of the program; (4) describe the industry transition timeline 33
54-that is required to achieve such performance goals and how the plan 34
55-will, to the greatest extent economically feasible, utilize existing service 35
56-providers and infrastructure in the state; (5) identify proposed facilities 36
57-to be used by the program in the collection system and discarded tire 37
58-transportation and recycling activities; (6) detail how the program 38
59-follows the solid waste hierarchy, as defined in the state-wide solid 39
60-waste management plan established pursuant to section 22a-228, and 40
61-will promote the recycling of discarded tires to higher value products 41
62-and sustainability; and (7) include a description of the public education 42
63-program that will be used to promote consumer knowledge of such 43
64-program. 44
65-Sec. 2. Subsection (l) of section 22a-905i of the general statutes is 45
66-repealed and the following is substituted in lieu thereof (Effective from 46
67-passage): 47
68-(l) Any producer, retailer and tire stewardship organization shall be 48
69-immune from liability for any claim of a violation of antitrust law or 49
70-unfair trade practice, if such conduct is a violation of antitrust law, to 50
71-the extent such producer or tire stewardship organization is exercising 51
72-authority pursuant to the provisions of this section. 52 Substitute Bill No. 5017

81-program authorized pursuant to this section shall not supply tires in this 57
82-state. On and after January 1, 2026, any retailer who fails to participate 58
83-in a tire stewardship program authorized pursuant to this section shall 59
84-not supply tires in this state. 60
