1818 AN ACT CONCERNING THE TERMINATION OF INPATIENT OR
1919 OUTPATIENT SERVICES OFFERED BY A HOSPITAL.
2020 Be it enacted by the Senate and House of Representatives in General
2121 Assembly convened:

2323 That chapter 638z of the general statutes be amended to (1) require a 1
2424 hospital to demonstrate, with clear and convincing evidence, to the 2
2525 Office of Health Strategy in conjunction with an application for a 3
2626 certificate of need for the termination of any inpatient or outpatient 4
2727 services that such termination would not decrease health care 5
2828 accessibility or affordability in the affected area, (2) require the Office of 6
2929 Health Strategy to notify the joint standing committee of the General 7
3030 Assembly having cognizance of matters relating to public health 8
3131 regarding a hospital's appeal of a decision of said office denying an 9
3232 application for a certificate of need for the termination of any inpatient 10
3333 or outpatient services, and (3) prohibit the overturning of a decision by 11
3434 the Office of Health Strategy denying a hospital's application for a 12
3535 certificate of need for the termination of inpatient or outpatient services 13
3636 absent any new information that was otherwise unavailable at the time 14

4242 Statement of Purpose:
4343 To (1) prohibit the termination of inpatient or outpatient services
4444 provided by a hospital without clear and convincing evidence that such
4545 termination would not decrease health care accessibility or affordability
4646 in the affected area, (2) require the notification of the joint standing
4747 committee of the General Assembly having cognizance of matters
4848 relating to public health regarding the need for termination of any
4949 inpatient or outpatient services offered by a hospital, and (3) prohibit
5050 the overturning of a decision made by the Office of Health Strategy
5151 denying an application for a certificate of need for termination of
5252 inpatient or outpatient services offered by a hospital absent new
5353 evidence.
