1820 AN ACT PROHIBITING CERTAIN GAMING -RELATED ADVERTISING,
1921 MARKETING AND PROMOTIONAL ACTIVITIES.
2022 Be it enacted by the Senate and House of Representatives in General

2325 Section 1. Subsection (e) of section 12-863 of the general statutes is 1
2426 repealed and the following is substituted in lieu thereof (Effective from 2
2527 passage): 3
2628 (e) Advertising, marketing and other promotional materials 4
2729 published, aired, displayed or disseminated by or on behalf of any 5
2830 gaming entity licensee shall: 6
2931 (1) Not depict an individual who is, or appears to be, under twenty-7
3032 one years of age, unless such individual is a professional athlete or a 8
3133 collegiate athlete who, if permitted by applicable law, is able to profit 9
3234 from the use of his or her name and likeness; 10
3335 (2) Not be aimed exclusively or primarily at individuals under 11
3436 twenty-one years of age, or at individuals under eighteen years of age if 12
3537 pertaining exclusively to keno, online lottery ticket sales or fantasy 13

4144 (3) Not directly advertise, target or promote Internet games or retail 15
4245 sports wagering to specific individuals, rather than a general audience, 16
4346 who are excluded pursuant to a self-exclusion process as described in 17
4447 subdivision (5) of subsection (c) of this section, through methods, 18
4548 including, but not limited to, electronic mail, telephone calls, text 19
4649 messages, direct messaging applications, mail and social media; 20
4750 (4) State that individuals shall be eighteen or twenty-one years of age 21
4851 or older, as applicable, to participate in the type of gaming advertised, 22
4952 marketed or promoted; 23
5053 (5) Not contain images, symbols, celebrity or entertainer 24
5154 endorsements or language designed to appeal specifically to those 25
5255 under twenty-one years of age, or, if pertaining exclusively to keno, 26
5356 online lottery ticket sales or fantasy contests, or any combination 27
5457 thereof, to those under eighteen years of age; 28
5558 (6) Not contain inaccurate or misleading information that would 29
5659 reasonably be expected to confuse and mislead patrons in order to 30
5760 induce them to engage in gaming; 31
5861 (7) Not offer or provide any bonus, credit or other inducement to 32
5962 engage in or continue gaming; 33
6063 [(7)] (8) Not be published, aired, displayed or disseminated to a 34
6164 media outlet or on social media, that appeal primarily to individuals 35
6265 under twenty-one years or age, or, if pertaining exclusively to keno, 36
6366 online lottery ticket sales or fantasy contests, or any combination 37
6467 thereof, to those under eighteen years of age; 38
6568 [(8)] (9) Not be placed before any audience where the majority of the 39
6669 viewers or participants is presumed to be under twenty-one years of 40
6770 age, or, if pertaining exclusively to keno, online lottery ticket sales or 41
6871 fantasy contests, or any combination thereof, to those under eighteen 42

9094 recipient to unsubscribe by clicking on one link. 60
9195 This act shall take effect as follows and shall amend the following
