AN ACT CONCERNING A RAILROAD CROSSING FOR PEDESTRIANS AND BICYCLISTS TO CROSS THE HOUSATONIC RAILROAD AT GRADE. Be it enacted by the Senate and House of Representatives in General Assembly convened: That (1) the Department of Transportation install a railroad crossing 1 for pedestrians and bicyclists, but not persons operating motorized 2 vehicles, to cross the Housatonic Railroad at grade, (2) the cost of such 3 installation and maintenance of the railroad crossing shall be borne by 4 the town of Newtown, and (3) section 52-557 of the general statutes be 5 amended to redefine "recreational purpose" to include using such 6 railroad crossing and redefine "owner" to include the Housatonic 7 Railroad and its successors. 8 Statement of Purpose: To allow pedestrians and bicyclists to cross the Housatonic Railroad at grade and include the Housatonic Railroad as owners of land entitled to immunity under the Recreational Lane Use Act.
