AN ACT PROHIBITING CERTAIN POWER PURCHASE AGREEMENTS AND REQUIRING JOINT SOLICITATIONS FOR CERTAIN CLEAN ENERGY PROJECTS. Be it enacted by the Senate and House of Representatives in General Assembly convened: That the general statutes be amended to (1) prohibit the 1 Commissioner of Energy and Environmental Protection or any electric 2 distribution company from entering into a power purchase agreement 3 that provides for the purchase of electricity at a rate exceeding one 4 hundred fifty per cent above the wholesale price of electricity calculated 5 over the preceding twelve-month average rate or the market rate for the 6 subsequent twelve-month period, and (2) require the Commissioner of 7 Energy and Environmental Protection to conduct a solicitation for any 8 clean energy project with a capacity that exceeds twenty megawatts 9 with two or more other states. 10 Proposed Bill No. 5400 LCO No. 1872 2 of 2 Statement of Purpose: To (1) prohibit the Commissioner of Energy and Environmental Protection or any electric distribution company from entering into a power purchase agreement that provides for the purchase of electricity at a rate exceeding one hundred fifty per cent above the wholesale price of electricity, and (2) require the commissioner to solicit any clean energy project with a capacity exceeding twenty megawatts with two or more other states.
