AN ACT CONCERNING REMOVAL OF AN UNAUTHORIZED INDIVIDUAL FROM RESIDENTIAL REAL PROPERTY. Be it enacted by the Senate and House of Representatives in General Assembly convened: That the general statutes be amended to (1) establish a procedure to 1 allow a property owner to request a state marshal to remove an 2 unauthorized individual from residential real property on an expedited 3 basis whereby the property owner may contact the state marshal and 4 file a complaint under penalty of perjury, the state marshal verifies 5 ownership of such property and the veracity of the complaint and the 6 state marshal removes the unauthorized person from such property, 7 and (2) establish a cause of action for wrongful removal against a 8 property owner to recover actual costs and damages incurred, including 9 statutory damages equal to triple the fair market rent and reasonable 10 attorney's fees. 11 Statement of Purpose: To establish an expedited procedure for removal of an unauthorized individual from residential real property and a cause of action for wrongful removal.
