| 33 | 33 | failure to establish a pregnancy or to carry a pregnancy to live birth after 3 | |
| 34 | 34 | regular, unprotected sexual intercourse in accordance with the 4 | |
| 35 | 35 | guidelines published by the American Society for Reproductive 5 | |
| 36 | 36 | Medicine, its successor organization or a comparable organization; (2) a 6 | |
| 37 | 37 | person's inability to reproduce without medical intervention either as a 7 | |
| 38 | 38 | single individual or with such person's partner; or (3) a licensed 8 | |
| 39 | 39 | physician's findings based on a patient's medical, sexual and 9 | |
