1818 AN ACT ESTABLISHING A CAUSE OF ACTION AGAINST THE STATE
1919 FOR INJURY OR ILLNESS CAUSED TO A STUDENT AS A RESULT
2020 OF VACCINATION OR MEDICINAL TREATMENT REQUIREMENTS.
2121 Be it enacted by the Senate and House of Representatives in General
2222 Assembly convened:

2424 That the general statutes be amended to allow a student to bring a 1
2525 cause of action in the Superior Court against the State of Connecticut 2
2626 for: (1) Actual damages for injuries or illness caused by a vaccination or 3
2727 medicinal treatment program if the state required students at a school 4
2828 or institution of higher education in this state to receive such vaccination 5
2929 or medicinal treatment program as a condition of school admission; and 6
3030 (2) punitive damages, if the state knowingly requires the vaccination or 7
3131 medicinal treatment without confirming its safety based on publicly 8
3232 available medical testing and documentation. 9
3333 Statement of Purpose:
3434 To create a cause of action allowing a student to recover actual and
3535 punitive damages for injuries or illness caused by a vaccination or
3636 medicinal treatment program if the state required the student to receive
3737 the vaccine or medicinal treatment as a condition of school admission.
