23 | 24 | | Section 1. Section 31-40z of the general statutes is repealed and the 1 |
---|
24 | 25 | | following is substituted in lieu thereof (Effective October 1, 2025): 2 |
---|
25 | 26 | | (a) As used in this section: 3 |
---|
26 | 27 | | (1) "Benefits" means health insurance benefits, retirement benefits, 4 |
---|
27 | 28 | | fringe benefits, paid leave and any other compensation to be offered 5 |
---|
28 | 29 | | with a position; 6 |
---|
29 | 30 | | [(1)] (2) "Employer" means any individual, corporation, limited 7 |
---|
30 | 31 | | liability company, firm, partnership, voluntary association, joint stock 8 |
---|
31 | 32 | | association, the state and any political subdivision thereof and any 9 |
---|
32 | 33 | | public corporation within the state using the services of one or more 10 |
---|
33 | 34 | | employees for pay; 11 |
---|
34 | 35 | | [(2)] (3) "Employee" means any individual employed or permitted to 12 |
---|

---|
40 | 42 | | [(3)] (4) "Wages" means compensation for labor or services rendered 14 |
---|
41 | 43 | | by an employee, whether the amount is determined on a time, task, 15 |
---|
42 | 44 | | piece, commission or other basis of calculation; and 16 |
---|
43 | 45 | | [(4)] (5) "Wage range" means the range of wages an employer 17 |
---|
44 | 46 | | [anticipates relying on when setting wages] sets in good faith for a 18 |
---|
45 | 47 | | position, and may include reference to any applicable pay scale, 19 |
---|
46 | 48 | | previously determined range of wages for the position, actual range of 20 |
---|
47 | 49 | | wages for those employees currently holding [comparable] equivalent 21 |
---|
48 | 50 | | positions or the employer's budgeted amount for the position. 22 |
---|
49 | 51 | | (b) No employer shall: 23 |
---|
50 | 52 | | (1) Prohibit an employee from disclosing or discussing the amount of 24 |
---|
51 | 53 | | his or her wages or the wages of another employee of such employer 25 |
---|
52 | 54 | | that have been disclosed voluntarily by such other employee; 26 |
---|
53 | 55 | | (2) Prohibit an employee from inquiring about the wages of another 27 |
---|
54 | 56 | | employee of such employer; 28 |
---|
55 | 57 | | (3) Require an employee to sign a waiver or other document that 29 |
---|
56 | 58 | | denies the employee his or her right to disclose or discuss the amount 30 |
---|
57 | 59 | | of his or her wages or the wages of another employee of such employer 31 |
---|
58 | 60 | | that have been disclosed voluntarily by such other employee; 32 |
---|
59 | 61 | | (4) Require an employee to sign a waiver or other document that 33 |
---|
60 | 62 | | denies the employee his or her right to inquire about the wages of 34 |
---|
61 | 63 | | another employee of such employer; 35 |
---|
62 | 64 | | (5) Inquire or direct a third party to inquire about a prospective 36 |
---|
63 | 65 | | employee's wage and salary history unless a prospective employee has 37 |
---|
64 | 66 | | voluntarily disclosed such information, except that this subdivision 38 |
---|
65 | 67 | | shall not apply to any actions taken by an employer, employment 39 |
---|
66 | 68 | | agency or employee or agent thereof pursuant to any federal or state law 40 |
---|
67 | 69 | | that specifically authorizes the disclosure or verification of salary 41 |
---|
68 | 70 | | history for employment purposes. Nothing in this section shall prohibit 42 |
---|

74 | 77 | | employee's compensation structure, as long as such employer does not 44 |
---|
75 | 78 | | inquire about the value of the elements of such compensation structure; 45 |
---|
76 | 79 | | (6) Discharge, discipline, discriminate against, retaliate against or 46 |
---|
77 | 80 | | otherwise penalize any employee who discloses or discusses the 47 |
---|
78 | 81 | | amount of his or her wages or the wages of another employee of such 48 |
---|
79 | 82 | | employer that have been disclosed voluntarily by such other employee; 49 |
---|
80 | 83 | | (7) Discharge, discipline, discriminate against, retaliate against or 50 |
---|
81 | 84 | | otherwise penalize any employee who inquires about the wages of 51 |
---|
82 | 85 | | another employee of such employer; 52 |
---|
83 | 86 | | (8) Fail or refuse to provide an applicant for employment the wage 53 |
---|
84 | 87 | | range for a position for which the applicant is applying and a general 54 |
---|
85 | 88 | | description of the benefits to be offered with such position, if such 55 |
---|
86 | 89 | | position has not been made available to an applicant pursuant to 56 |
---|
87 | 90 | | subdivision (10) of this subsection, upon the earliest of (A) the 57 |
---|
88 | 91 | | applicant's request, or (B) prior to [or at the time the applicant is made 58 |
---|
91 | 94 | | (9) Fail or refuse to provide an employee the wage range for the 61 |
---|
92 | 95 | | employee's position and a general description of the benefits to be 62 |
---|
93 | 96 | | offered with such position upon (A) the hiring of the employee, (B) a 63 |
---|
94 | 97 | | change in the employee's position with the employer, or (C) the 64 |
---|
95 | 98 | | employee's first request for a wage range; 65 |
---|
96 | 99 | | (10) Fail or refuse to disclose in an internal or public job 66 |
---|
97 | 100 | | advertisement for a position the wage or wage range for such position 67 |
---|
98 | 101 | | and a general description of the benefits to be offered with such position. 68 |
---|
99 | 102 | | Nothing in this subdivision shall be construed to require an employer 69 |
---|
100 | 103 | | to post a job advertisement if such employer utilizes an alternative 70 |
---|
101 | 104 | | method of hiring or recruiting for a position; 71 |
---|
102 | 105 | | (11) Fail or refuse to annually provide an employee with the current 72 |
---|
103 | 106 | | wage or wage range for such employee's position and a general 73 |
---|
109 | 113 | | (12) Retaliate or discriminate against an applicant, including, but not 75 |
---|
110 | 114 | | limited to, refusing to interview or hire a prospective employee, 76 |
---|
111 | 115 | | refusing to promote an employee or terminating an employee, for 77 |
---|
112 | 116 | | exercising such applicant's or employee's rights under this section. 78 |
---|
113 | 117 | | [(c) Nothing in this section shall be construed to require any employer 79 |
---|
114 | 118 | | or employee to disclose the amount of wages paid to any employee.] 80 |

115 | 119 | | [(d)] (c) An action to redress a violation of subsection (b) of this 81 |
---|
116 | 120 | | section may be maintained in any court of competent jurisdiction by any 82 |
---|
117 | 121 | | one or more employees or prospective employees. An employer who 83 |
---|
118 | 122 | | violates subsection (b) of this section may be found liable for statutory 84 |
---|
119 | 123 | | damages of not less than one thousand dollars and not more than ten 85 |
---|
120 | 124 | | thousand dollars or compensatory damages, whichever is greater, 86 |
---|
121 | 125 | | attorney's fees and costs, punitive damages and such legal and equitable 87 |
---|
122 | 126 | | relief as the court deems just and proper. 88 |
---|
123 | 127 | | [(e) No action shall be brought for any] (d) An action for a violation 89 |
