1818 AN ACT ELIMINATING CERTAIN CERTIFICATE OF NEED
1919 REQUIREMENTS.
2020 Be it enacted by the Senate and House of Representatives in General
2121 Assembly convened:

2323 That section 19a-638 of the general statutes be amended to eliminate 1
2424 all certificate of need requirements, except for: (1) A transfer of 2
2525 ownership of a health care facility or ownership of a large group practice 3
2626 to any entity other than a physician or group of two or more physicians, 4
2727 legally organized in a partnership, professional corporation or limited 5
2828 liability company formed to render professional services and not 6
2929 employed by or an affiliate of any hospital, medical foundation, 7
3030 insurance company or similar entity; (2) the termination of inpatient or 8
3131 outpatient services offered by a hospital, including, but not limited to, 9
3232 the termination by a short-term acute care general hospital or children's 10
3333 hospital of inpatient and outpatient mental health and substance abuse 11
3434 services; (3) the termination of surgical services by an outpatient 12
3535 surgical facility, as defined in section 19a-493b of the general statutes, or 13
3636 a facility that provides outpatient surgical services as part of the 14
3737 outpatient surgery department of a short-term acute care general 15 Proposed Bill No. 6600

4242 hospital, provided termination of outpatient surgical services due to (A) 16
4343 insufficient patient volume, or (B) the termination of any subspecialty 17
4444 surgical service; (4) the termination of an emergency department by a 18
4545 short-term acute care general hospital or the termination of inpatient or 19
4646 outpatient services offered by a hospital or other facility or institution 20
4747 operated by the state that provides services that are eligible for 21
4848 reimbursement under Title XVIII or XIX of the federal Social Security 22
4949 Act, 42 USC 301; (5) the relocation of outpatient, behavioral health care, 23
5050 substance use disorder, women's health care or emergency medical 24
5151 services outside of the municipality in which such services are currently 25
5252 provided; (6) any investment in a health care facility by a private equity 26
5353 company in which the private equity company acquires a controlling 27
5454 interest, either directly or indirectly, in a health care facility, or 28
5555 otherwise obtains the ability to exercise operational control, managerial 29
5656 control or decision-making authority over such facility; and (7) any 30
5757 transaction in which a private equity company acquires a controlling 31
5858 interest, either directly or indirectly, in a large group practice of ten or 32
5959 more full-time equivalent physicians, or otherwise obtains the ability to 33
6060 exercise operational control, managerial control or decision-making 34
6161 authority over such large group practice. 35
