19	19	AN ACT CONCERNING TELECOMMUNICATIONS.
20	20	Be it enacted by the Senate and House of Representatives in General
21	21	Assembly convened:

23	23	Section 1. Section 16-330b of the general statutes is repealed and the 1
24	24	following is substituted in lieu thereof (Effective October 1, 2025): 2
25	25	(a) The Office of Policy and Management shall, in accordance with 3
26	26	sections 4d-90 and 4-67p and in consultation with other state agencies 4
27	27	deemed appropriate by the Secretary of the Office of Policy and 5
28	28	Management, develop and maintain an up-to-date broadband map, 6
29	29	with accompanying data, showing the availability and adoption of 7
30	30	broadband Internet access service, including broadband Internet 8
31	31	download and upload speeds, in the state. The Office of Policy and 9
32	32	Management [may] shall rely on credible and relevant data, as 10
33	33	determined by the Secretary of the Office of Policy and Management, 11
34	34	provided by broadband Internet access service providers, state agencies, 12
35	35	political subdivisions of the state and other third parties, including, but 13
36	36	not limited to, broadband Internet access service consumers, in the 14
37	37	development and maintenance of said map. The Secretary of the Office 15

46	46	(b) On or before December 1, 2022, and each year thereafter, the 18
47	47	Secretary of the Office of Policy and Management shall publish said up-19
48	48	to-date broadband map on the Office of Policy and Management's 20
49	49	Internet web site. 21
50	50	(c) (1) Each broadband Internet access service provider shall provide 22
51	51	the Office of Policy and Management, in a form and manner prescribed 23
52	52	by the Secretary of the Office of Policy and Management, with 24
53	53	information required to develop and maintain an up-to-date broadband 25
54	54	map showing the availability of broadband Internet access service and 26
55	55	subscription data by broadband Internet speed offered by such 27
56	56	provider. 28
57	57	(A) Such information may be submitted in the form of a labeled 29
58	58	shapefile that [shall include] includes (i) for each address or structure in 30
59	59	the state at which service is available from the broadband Internet access 31
60	60	service provider, the maximum advertised downstream bandwidth, 32
61	61	maximum advertised upstream bandwidth and transmission 33
62	62	technology, and (ii) for each area served by the broadband Internet 34
63	63	access service provider, provided such area is not larger than a census 35
64	64	block group, for each combination of advertised downstream and 36
65	65	upstream bandwidth of the service as sold and transmission technology, 37
66	66	the total number of connections and total number of consumer 38
67	67	connections. 39
68	68	(B) In prescribing the form and manner of the information submitted 40
69	69	pursuant to this subsection, the Secretary of the Office of Policy and 41
70	70	Management shall make reasonable efforts to conform with the 42
71	71	Broadband Deployment Accuracy and Technological Availability Act, 43
72	72	47 USC 641 et seq., as amended from time to time, the Federal 44
73	73	Communications Commission rules adopted thereunder and the 45
74	74	Federal Communications Commission's Form 477 filing process. 46
75	75	(2) Any information provided by a broadband Internet access service 47

82	82	provider pursuant to this subsection shall be deemed a trade secret and 48
83	83	exempt from public disclosure pursuant to section 1-210. Pursuant to a 49
84	84	data sharing agreement, the Office of Policy and Management may 50
85	85	provide such information to the Department of Energy and 51
86	86	Environmental Protection, the Office of State Broadband and the 52
87	87	Commission for Educational Technology for the purposes of 53
88	88	administering the grant program and preparing the reports required 54
89	89	under section 16-330c, and shall not disclose such information to any 55
90	90	nongovernmental individual or entity, other than an outside consultant 56
91	91	employed pursuant to subsection (a) of this section or section 16-330c, 57
92	92	except: (A) In an aggregated form necessary to develop and maintain 58
93	93	the map and data pursuant to subsection (a) of this section, or (B) with 59
94	94	the permission of the broadband Internet access service provider. Any 60
95	95	contract or data-sharing agreement entered into by the Office of Policy 61
96	96	and Management with any other governmental [entities] entity or 62
97	97	outside [consultants] consultant shall include a confidentiality 63
98	98	agreement concerning the trade secret information obtained pursuant to 64
99	99	this subsection. 65
100	100	(d) Each state agency and political subdivision of the state shall 66
101	101	provide all information requested by the Office of Policy and 67
102	102	Management for the purpose of developing and maintaining an up-to-68
103	103	date broadband map. 69
104	104	This act shall take effect as follows and shall amend the following
