1919 AN ACT CONCERNING TELECOMMUNICATIONS.
2020 Be it enacted by the Senate and House of Representatives in General

2323 Section 1. Section 16-330b of the general statutes is repealed and the 1
2424 following is substituted in lieu thereof (Effective October 1, 2025): 2
2525 (a) The Office of Policy and Management shall, in accordance with 3
2626 sections 4d-90 and 4-67p and in consultation with other state agencies 4
2727 deemed appropriate by the Secretary of the Office of Policy and 5
2828 Management, develop and maintain an up-to-date broadband map, 6
2929 with accompanying data, showing the availability and adoption of 7
3030 broadband Internet access service, including broadband Internet 8
3131 download and upload speeds, in the state. The Office of Policy and 9
3232 Management [may] shall rely on credible and relevant data, as 10
3333 determined by the Secretary of the Office of Policy and Management, 11
3434 provided by broadband Internet access service providers, state agencies, 12
3535 political subdivisions of the state and other third parties, including, but 13
3636 not limited to, broadband Internet access service consumers, in the 14
3737 development and maintenance of said map. The Secretary of the Office 15
3838 of Policy and Management may employ outside consultants in the 16

4646 (b) On or before December 1, 2022, and each year thereafter, the 18
4747 Secretary of the Office of Policy and Management shall publish said up-19
4848 to-date broadband map on the Office of Policy and Management's 20
4949 Internet web site. 21
5050 (c) (1) Each broadband Internet access service provider shall provide 22
5151 the Office of Policy and Management, in a form and manner prescribed 23
5252 by the Secretary of the Office of Policy and Management, with 24
5353 information required to develop and maintain an up-to-date broadband 25
5454 map showing the availability of broadband Internet access service and 26
5555 subscription data by broadband Internet speed offered by such 27
5656 provider. 28
5757 (A) Such information may be submitted in the form of a labeled 29
5858 shapefile that [shall include] includes (i) for each address or structure in 30
5959 the state at which service is available from the broadband Internet access 31
6060 service provider, the maximum advertised downstream bandwidth, 32
6161 maximum advertised upstream bandwidth and transmission 33
6262 technology, and (ii) for each area served by the broadband Internet 34
6363 access service provider, provided such area is not larger than a census 35
6464 block group, for each combination of advertised downstream and 36
6565 upstream bandwidth of the service as sold and transmission technology, 37
6666 the total number of connections and total number of consumer 38
6767 connections. 39
6868 (B) In prescribing the form and manner of the information submitted 40
6969 pursuant to this subsection, the Secretary of the Office of Policy and 41
7070 Management shall make reasonable efforts to conform with the 42
7171 Broadband Deployment Accuracy and Technological Availability Act, 43
7272 47 USC 641 et seq., as amended from time to time, the Federal 44
7373 Communications Commission rules adopted thereunder and the 45
7474 Federal Communications Commission's Form 477 filing process. 46
7575 (2) Any information provided by a broadband Internet access service 47

8282 provider pursuant to this subsection shall be deemed a trade secret and 48
8383 exempt from public disclosure pursuant to section 1-210. Pursuant to a 49
8484 data sharing agreement, the Office of Policy and Management may 50
8585 provide such information to the Department of Energy and 51
8686 Environmental Protection, the Office of State Broadband and the 52
8787 Commission for Educational Technology for the purposes of 53
8888 administering the grant program and preparing the reports required 54
8989 under section 16-330c, and shall not disclose such information to any 55
9090 nongovernmental individual or entity, other than an outside consultant 56
9191 employed pursuant to subsection (a) of this section or section 16-330c, 57
9292 except: (A) In an aggregated form necessary to develop and maintain 58
9393 the map and data pursuant to subsection (a) of this section, or (B) with 59
9494 the permission of the broadband Internet access service provider. Any 60
9595 contract or data-sharing agreement entered into by the Office of Policy 61
9696 and Management with any other governmental [entities] entity or 62
9797 outside [consultants] consultant shall include a confidentiality 63
9898 agreement concerning the trade secret information obtained pursuant to 64
9999 this subsection. 65
100100 (d) Each state agency and political subdivision of the state shall 66
101101 provide all information requested by the Office of Policy and 67
102102 Management for the purpose of developing and maintaining an up-to-68
103103 date broadband map. 69
104104 This act shall take effect as follows and shall amend the following
