17 | 24 | | Section 1. (NEW) (Effective October 1, 2025) (a) No person shall engage 1 |
---|
18 | 25 | | in the use in this state of any second-generation anticoagulant 2 |
---|
19 | 26 | | rodenticide. For purposes of this section, "second-generation 3 |
---|
20 | 27 | | anticoagulant rodenticide" means any pesticide product containing any 4 |
---|
21 | 28 | | one of the following active ingredients: (1) Brodifacoum; (2) 5 |
---|
22 | 29 | | bromadiolone; (3) difenacoum; or (4) difethialone. 6 |
---|
23 | 30 | | (b) The provisions of subsection (a) of this section shall not apply to: 7 |
---|
24 | 31 | | (1) The use of second-generation anticoagulant rodenticides by any 8 |
---|
25 | 32 | | state employee who uses second-generation anticoagulant rodenticides 9 |
---|
26 | 33 | | for public health activities in accordance with any provision of the 10 |
---|
27 | 34 | | Public Health Code and in furtherance of such employee's duties; 11 |
---|
28 | 35 | | (2) The use of second-generation anticoagulant rodenticides when 12 |
---|
29 | 36 | | used by any state employee for the purposes of protecting water supply 13 |
---|
30 | 37 | | infrastructure and facilities in a manner that is consistent with all 14 |
---|
38 | 47 | | director of health to control mosquito or vector breeding areas in order 18 |
---|
39 | 48 | | to protect the public health; 19 |
---|
40 | 49 | | (4) The use of any second-generation anticoagulant rodenticides for 20 |
---|
41 | 50 | | the eradication of nonnative invasive species inhabiting or found to be 21 |
---|
42 | 51 | | present on offshore islands in a manner that is consistent with all 22 |
---|
43 | 52 | | otherwise applicable federal and state laws and regulations; 23 |
---|
44 | 53 | | (5) The use of any second-generation anticoagulant rodenticide to 24 |
---|
45 | 54 | | control an actual or potential rodent infestation associated with a public 25 |
---|
46 | 55 | | health need, as determined by a supporting declaration from the 26 |
---|
47 | 56 | | Commissioner of Public Health or a director of health. For purposes of 27 |
---|
48 | 57 | | this section, "public health need" means an urgent, nonroutine situation 28 |
---|
49 | 58 | | posing a significant risk to human health in which it is documented that 29 |
---|
50 | 59 | | other rodent control alternatives, including nonchemical alternatives, 30 |
---|
51 | 60 | | are inadequate to control the rodent infestation; 31 |
---|
52 | 61 | | (6) The use of second-generation rodenticides in any of the following 32 |
---|
53 | 62 | | locations: (A) A medical waste generator; or (B) any facility registered 33 |
---|
54 | 63 | | annually and subject to inspection under Section 510 of the federal Food, 34 |
---|
55 | 64 | | Drug and Cosmetic Act, 21 USC 360 et seq., and that is compliant with 35 |
---|
56 | 65 | | the federal Insecticide, Fungicide and Rodenticide Act, 7 USC 135 et 36 |
---|
57 | 66 | | seq.; or 37 |
---|
58 | 67 | | (7) The use of second-generation anticoagulant rodenticides for 38 |
---|
59 | 68 | | agricultural activities. For purposes of this subdivision, "agricultural 39 |
---|
60 | 69 | | activities" includes activities conducted in any of the following 40 |
---|
61 | 70 | | locations: 41 |
---|
62 | 71 | | (A) A warehouse used to store foods for human or animal 42 |
---|
63 | 72 | | consumption; 43 |
---|
72 | 83 | | conveyance facilities; or 48 |
---|
73 | 84 | | (E) An agricultural production site housing rights-of-way and other 49 |
---|
74 | 85 | | transportation infrastructure. 50 |
---|
75 | 86 | | (c) The Commissioner of Energy and Environmental Protection may 51 |
---|
76 | 87 | | adopt regulations, in accordance with the provisions of chapter 54 of the 52 |
---|
77 | 88 | | general statutes, to ensure that the continued use of second-generation 53 |
---|
78 | 89 | | anticoagulant rodenticides, in accordance with the provisions of section 54 |
---|
79 | 90 | | 22a-50 of the general statutes is not reasonably expected to result in 55 |
---|
80 | 91 | | significant adverse effects to nontarget wildlife. Any such regulations 56 |
---|
81 | 92 | | shall include, but are not limited to, provisions for the use of such 57 |
---|
82 | 93 | | rodenticides if the eradication of invasive rodent populations is 58 |
---|
83 | 94 | | necessary for the protection of threatened or endangered species or the 59 |
---|
84 | 95 | | habitats of such species. 60 |
---|
85 | 96 | | (d) Not later than January 1, 2027, the Commissioner of Energy and 61 |
---|
86 | 97 | | Environmental Protection shall submit a report, in accordance with the 62 |
---|
87 | 98 | | provisions of section 11-4a of the general statutes, to the joint standing 63 |
---|
88 | 99 | | committee of the General Assembly having cognizance of matters 64 |
---|
89 | 100 | | relating to the environment on the potential implications of the 65 |
---|
90 | 101 | | application of existing statutory and regulatory restrictions and 66 |
---|
91 | 102 | | licensing requirements for the use of second-generation anticoagulant 67 |
---|
92 | 103 | | rodenticides. Such report shall include, but is not limited to, an analysis 68 |
---|
93 | 104 | | of the consistency of applying such restrictions and requirements with 69 |
---|
94 | 105 | | federal law and any potential effects, including, but not limited to, 70 |
---|
95 | 106 | | improved raptor health and expenses and delays that such changes may 71 |
---|
96 | 107 | | have on public health and agriculture in the state and requisite 72 |
---|
97 | 108 | | administrative resources for overseeing such restrictions. 73 |
