1219 AN ACT CONCERNING THE USE OF SECOND -GENERATION
1320 ANTICOAGULANT RODENTICIDES.
1421 Be it enacted by the Senate and House of Representatives in General
1522 Assembly convened:

1724 Section 1. (NEW) (Effective October 1, 2025) (a) No person shall engage 1
1825 in the use in this state of any second-generation anticoagulant 2
1926 rodenticide. For purposes of this section, "second-generation 3
2027 anticoagulant rodenticide" means any pesticide product containing any 4
2128 one of the following active ingredients: (1) Brodifacoum; (2) 5
2229 bromadiolone; (3) difenacoum; or (4) difethialone. 6
2330 (b) The provisions of subsection (a) of this section shall not apply to: 7
2431 (1) The use of second-generation anticoagulant rodenticides by any 8
2532 state employee who uses second-generation anticoagulant rodenticides 9
2633 for public health activities in accordance with any provision of the 10
2734 Public Health Code and in furtherance of such employee's duties; 11
2835 (2) The use of second-generation anticoagulant rodenticides when 12
2936 used by any state employee for the purposes of protecting water supply 13
3037 infrastructure and facilities in a manner that is consistent with all 14

3144 otherwise applicable federal and state laws and regulations and in 15
3245 furtherance of such employee's duties; 16

46+(3) The use of second-generation anticoagulant rodenticides by a 17
3847 director of health to control mosquito or vector breeding areas in order 18
3948 to protect the public health; 19
4049 (4) The use of any second-generation anticoagulant rodenticides for 20
4150 the eradication of nonnative invasive species inhabiting or found to be 21
4251 present on offshore islands in a manner that is consistent with all 22
4352 otherwise applicable federal and state laws and regulations; 23
4453 (5) The use of any second-generation anticoagulant rodenticide to 24
4554 control an actual or potential rodent infestation associated with a public 25
4655 health need, as determined by a supporting declaration from the 26
4756 Commissioner of Public Health or a director of health. For purposes of 27
4857 this section, "public health need" means an urgent, nonroutine situation 28
4958 posing a significant risk to human health in which it is documented that 29
5059 other rodent control alternatives, including nonchemical alternatives, 30
5160 are inadequate to control the rodent infestation; 31
5261 (6) The use of second-generation rodenticides in any of the following 32
5362 locations: (A) A medical waste generator; or (B) any facility registered 33
5463 annually and subject to inspection under Section 510 of the federal Food, 34
5564 Drug and Cosmetic Act, 21 USC 360 et seq., and that is compliant with 35
5665 the federal Insecticide, Fungicide and Rodenticide Act, 7 USC 135 et 36
5766 seq.; or 37
5867 (7) The use of second-generation anticoagulant rodenticides for 38
5968 agricultural activities. For purposes of this subdivision, "agricultural 39
6069 activities" includes activities conducted in any of the following 40
6170 locations: 41
6271 (A) A warehouse used to store foods for human or animal 42
6372 consumption; 43
64-(B) An agricultural production site, including, but not limited to, a 44
65-slaughterhouse or cannery; 45
66-(C) A factory, brewery or winery; 46

79+(B) An agricultural food production site, including, but not limited 44
80+to, a slaughterhouse or cannery; 45
81+(C) A factory, brewery or winery; 46
82+(D) An agricultural production site housing water storage and 47
7283 conveyance facilities; or 48
7384 (E) An agricultural production site housing rights-of-way and other 49
7485 transportation infrastructure. 50
7586 (c) The Commissioner of Energy and Environmental Protection may 51
7687 adopt regulations, in accordance with the provisions of chapter 54 of the 52
7788 general statutes, to ensure that the continued use of second-generation 53
7889 anticoagulant rodenticides, in accordance with the provisions of section 54
7990 22a-50 of the general statutes is not reasonably expected to result in 55
8091 significant adverse effects to nontarget wildlife. Any such regulations 56
8192 shall include, but are not limited to, provisions for the use of such 57
8293 rodenticides if the eradication of invasive rodent populations is 58
8394 necessary for the protection of threatened or endangered species or the 59
8495 habitats of such species. 60
8596 (d) Not later than January 1, 2027, the Commissioner of Energy and 61
8697 Environmental Protection shall submit a report, in accordance with the 62
8798 provisions of section 11-4a of the general statutes, to the joint standing 63
8899 committee of the General Assembly having cognizance of matters 64
89100 relating to the environment on the potential implications of the 65
90101 application of existing statutory and regulatory restrictions and 66
91102 licensing requirements for the use of second-generation anticoagulant 67
92103 rodenticides. Such report shall include, but is not limited to, an analysis 68
93104 of the consistency of applying such restrictions and requirements with 69
94105 federal law and any potential effects, including, but not limited to, 70
95106 improved raptor health and expenses and delays that such changes may 71
96107 have on public health and agriculture in the state and requisite 72
97108 administrative resources for overseeing such restrictions. 73

98115 (e) Any person who violates the provisions of subsection (a) of this 74
99116 section shall be subject to a civil penalty of not more than five thousand 75
100117 dollars by the Commissioner of Energy and Environmental Protection 76
