1819 AN ACT CONCERNING MEDICAID COVERAGE FOR MEDICALLY
1920 NECESSARY CHILDREN'S DIAPERS.
2021 Be it enacted by the Senate and House of Representatives in General

2324 Section 1. (NEW) (Effective July 1, 2025) (a) As used in this section, 1
2425 "medical necessity" means a determination by a physician or physician 2
2526 assistant licensed pursuant to chapter 370 of the general statutes or an 3
2627 advanced practice registered nurse licensed pursuant to chapter 378 of 4
2728 the general statutes that the provision of diapers to a child is medically 5
2829 necessary to prevent or ameliorate (1) severe and persistent diaper 6
2930 dermatitis, urinary tract infection or other disease of the skin related to 7
3031 inadequate diaper hygiene, or (2) another health condition, including, 8
3132 but not limited to, a developmental, psychiatric or neurological 9
3233 condition, that results in an unusual need to void or delayed 10
3334 developmentally appropriate toileting behavior. 11
3435 (b) The Commissioner of Social Services shall amend the Medicaid 12
3536 state plan to extend Medicaid coverage for diapers to children from 13
3637 birth to age three deemed to have a medical necessity for diapers. Not 14

4245 accordance with the provisions of section 11-4a of the general statutes, 16
4346 with the joint standing committee of the General Assembly having 17
4447 cognizance of matters relating to human services on the (1) number of 18
4548 children from birth to age three determined to have a medical necessity 19
4649 for diapers in the previous fiscal year, (2) cost to the state to provide 20
4750 Medicaid coverage for diapers for such children, and (3) estimated 21
4851 savings on state Medicaid costs for treatment of potential health care 22
4952 conditions averted by the provision of access to diapers covered by 23
5053 Medicaid. 24
