18	19		AN ACT CONCERNING LIABILITY FOR INJURIES INHERENT IN
19	20		CAMPING WHILE AT A PRIVATE CAMPGROUND.
20	21		Be it enacted by the Senate and House of Representatives in General
21	22		Assembly convened:

23	24		Section 1. (NEW) (Effective October 1, 2025) (a) As used in this section: 1
24	25		(1) "Camper" means any person who uses a private campground for 2
25	26		the purpose of camping or recreational vehicle camping; 3
26	27		(2) "Camping" means all aspects of visiting, staying at, using and 4
27	28		leaving a private campground, including the use of lodging of all types 5
28	29		while at a private campground; and 6
29	30		(3) "Private campground" means any parcel or tract of land, including 7
30	31		buildings and other structures on such land, that is owned or operated 8
31	32		by a private property owner where five or more campsites are made 9
32	33		available for use as temporary living quarters for recreational camping, 10
33	34		travel or seasonal use. "Private campground" includes recreational 11
34	35		vehicle parks operated by a private property owner. 12

40	43		arising out of the hazards inherent in camping. 14
41	44		(c) Nothing in subsection (b) of this section shall prevent suit or limit 15
42	45		the liability of a private campground owner or operator who in the 16
43	46		operation of the private campground: (1) Commits an act or omission 17
44	47		that constitutes negligence; (2) intentionally causes the injury of another 18
45	48		person; (3) acts with a disregard for the safety of the person injured; (4) 19
46	49		fails to use a degree of care that an ordinarily careful prudent person 20
47	50		would use under similar circumstances; or (5) fails to conspicuously 21
48	51		post warning signs of a condition known to be dangerous at the private 22
49	52		campground. 23
50	53		(d) Any written contract between a private campground owner and 24
51	54		a camper, or an employee or officer of a private campground owner and 25
52	55		a camper, shall contain in clearly readable print, a warning notice stating 26
53	56		that each camper shall assume the risk for any injury to their person 27
54	57		arising out of the hazards inherent in camping. 28
55	58		This act shall take effect as follows and shall amend the following
