1312 AN ACT CONCERNING COURT -ORDERED ACCOUNTINGS OF
1413 COMMON INTEREST COMMUNITY FINANCIAL RECORDS AND
1514 REVISING THE DISCLOSURE REQUIREMENTS RELATING TO
1615 COMMON INTEREST COMMUNITIES.
1716 Be it enacted by the Senate and House of Representatives in General
1817 Assembly convened:

2019 Section 1. (NEW) (Effective October 1, 2025) (a) Notwithstanding any 1
2120 provision of the declaration or bylaws to the contrary and except as 2
2221 provided in subsection (c) of section 47-260 of the general statutes, any 3
2322 group of unit owners of an association comprising not less than ten per 4
2423 cent of such association may petition the Superior Court for an order 5
2524 directing such association to retain an independent third party to 6
2625 conduct an accounting of such association's financial records retained 7
2726 by such association pursuant to the provisions of subsection (a) of 8
2827 section 47-260 of the general statutes that are related to such 9
2928 association's expenditures and any other financial matters, provided 10
3029 such group of unit owners satisfies the following conditions: 11
3130 (1) Such group of unit owners certifies in writing that a good faith 12
3231 belief exists in grounds for an accounting of such association's financial 13
3332 records; 14
3433 (2) Such group of unit owners obtains a signed opinion of an 15
3534 independent certified public accountant who specializes in fraud and 16 Substitute Bill No. 7068

4039 financial forensics that there appears to be evidence of financial fraud or 17
4140 misuse of such association's funds. Such signed opinion shall identify 18
4241 the basis for the formation of such opinion; 19
4342 (3) Such group of unit owners holds not less than ten per cent of 20
4443 undirected or directed proxies of the unit owners giving authority to 21
4544 such group of unit owners to file such petition for an accounting of such 22
4645 association's financial records; and 23
4746 (4) No such accounting has been completed during the immediately 24
4847 preceding twelve months from the date such group of unit owners filed 25
4948 such petition for an accounting of such association's financial records. 26
5049 (b) Any expenses associated with the completion of an accounting by 27
5150 an independent third party of an association's financial records 28
5251 pursuant to the provisions of subsection (a) of this section shall be paid 29
5352 for by the group of unit owners who filed such petition for an 30
5453 accounting of such association's financial records. 31
5554 Sec. 2. Subparagraph (B) of subdivision (2) of subsection (d) of section 32
5655 20-327b of the general statutes is repealed and the following is 33
5756 substituted in lieu thereof (Effective October 1, 2025): 34

6564 use any part of your property, including, but not limited to, any 42
6665 easement or right-of-way? If YES, explain: 43
