1819 AN ACT CONCERNING WELL WATER QUALITY.
1920 Be it enacted by the Senate and House of Representatives in General
2021 Assembly convened:

2223 Section 1. Section 25-32 of the general statutes is amended by adding 1
2324 subsection (r) as follows (Effective from passage): 2
2425 (NEW) (r) The commissioner may implement policies and 3
2526 procedures necessary to administer provisions relating to cross 4
2627 connections between water supplies while in the process of adopting 5
2728 such policies and procedures as regulations, in accordance with the 6
2829 provisions of chapter 54, provided the department posts such policies 7
2930 and procedures on the eRegulations System prior to adopting them. 8
3031 Policies and procedures implemented pursuant to this section shall be 9
3132 valid until final regulations are adopted in accordance with the 10
3233 provisions of chapter 54. 11
3334 Sec. 2. Subdivision (1) of subsection (c) of section 19a-37 of the general 12
3435 statutes is repealed and the following is substituted in lieu thereof 13

4144 a private well serving a residential property or semipublic well in the 16
4245 state shall, not later than thirty days after the completion of such test, 17
4346 report the results of such test to the local health authority of the 18
4447 municipality where the property is located and the Department of 19
4548 Public Health in a format specified by the department. Results 20
4649 submitted to the Department of Public Health or the local health 21
4750 authority pursuant to this subsection, information obtained from any 22
4851 Department of Public Health or local health authority investigation 23
4952 regarding those results and any Department of Public Health or local 24
5053 health authority study of morbidity and mortality regarding the results 25
5154 shall be confidential pursuant to section 19a-25, except the local health 26
5255 authority and the department may, if approved by the commissioner, 27
5356 disclose the results or information obtained from an investigation of the 28
5457 results to (A) the owner of the property on which the well is located, (B) 29
5558 a prospective buyer of such property who has signed a contract to 30
5659 purchase such property, (C) other persons or entities, when such 31
5760 disclosure is necessary to carry out a statutory or regulatory 32
5861 responsibility of the local health authority or department, [or] (D) an 33
5962 agent of a state agency, or (E) the Department of Energy and 34
6063 Environmental Protection. 35
