AN ACT AMENDING SOLICITATION REQUIREMENTS FOR CERTAIN 
POWER PURCHASE AGREEMENTS, IMPOSING COSTS OF CERTAIN 
POWER PURCHASE AGREEMENTS ON CUSTOMERS OF MUNICIPAL 
ELECTRIC UTILITIES AND REPEALING CERTAIN REQUIREMENTS 
CONCERNING THE STANDARD BILLING FORMAT FOR 
RESIDENTIAL CUSTOMERS OF ELECTRIC DISTRIBUTION 
COMPANIES. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
That (1) section 16a-3m of the general statutes be amended to make 1 
unenforceable any agreement entered into or approved by the 2 
Commissioner of Energy and Environmental Protection with a nuclear 3 
power generating facility on or before July 1, 2025, pursuant to 4 
subdivision (2) of subsection (e) of said section unless such agreement 5 
was made, amended or renewed pursuant to a solicitation conducted in 6 
coordination with two or more other states in the control area of the 7 
regional independent system operator, (2) the general statutes be 8 
amended to impose a fee for a proportional cost of any agreement 9 
entered into by the Commissioner of Energy and Environmental 10 
Protection with a nuclear power generating facility pursuant to 11 
subdivision (2) of subsection (e) of section 16a-3m of the general statutes 12  Proposed Bill No.  85

on the customers of any municipal electric utility, and (3) subdivision 13 
(3) of subsection (a) of section 16-245d of the general statutes be 14 
repealed. 15 
Statement of Purpose:   
To (1) make certain agreements for the purchase of electricity from 
nuclear power generating facilities unenforceable unless such 
agreements are subject to solicitation conducted in coordination with 
two or more other states, (2) impose costs of electricity purchased from 
nuclear power generating facilities pursuant to certain power purchase 
agreements on users of municipal electric utilities, and (3) repeal 
changes to the standard billing format for customers of electric 
distribution companies imposed by section 14 of public act 23-102.
