1818 AN ACT CONCERNING HEALTH INSURER LIABILITY FOR DAMAGES
1919 AND HARMS CAUSED BY UNDUE DELAY IN AUTHORIZING OR
2020 APPROVING CARE.
2121 Be it enacted by the Senate and House of Representatives in General
2222 Assembly convened:

2424 That chapter 925 of the general statutes be amended to provide that 1
2525 no action may be brought to recover damages from a licensed health 2
2626 care professional that is attributable to adverse outcomes directly 3
2727 caused by a health insurer's delay in authorizing or approving care, and 4
2828 that such action may instead be brought directly against a health insurer 5
2929 for damages and harms caused by the undue delay in authorizing or 6
3030 approving care. 7
3131 Statement of Purpose:
3232 To ensure that a health insurer is held accountable for the insurer's role
3333 in restricting timely patient access to necessary health care treatment,
3434 while shielding a licensed medical professional from undue legal risks
3535 associated with the delay.
